Icebird Clutched August 6, 2012 Share August 6, 2012 Traffic was quite heavy and every one was driving quite slowly. A gap opened up on the lane to my right, when the car in front went ahead but the vehicle behind (lorry) was still quite a distance away. I tried to filter into the right lane. But when that lorry horned, I stopped my car just about at the lane markings separating my lane and its lane. I was pissed that it insisted on speeding up when it is still a distance away, but decided to stop and let it pass anyway. After I stopped my car, that lorry only came up beside me after about 5 -6 seconds. It has slowed down but came up so close to the right side of my car. I don't know why it could not drive more to its right but it insisted on driving so close to my car. As it slowly drove past my stationery car, it swiped my right side mirror and right panel in slow motion! What I cannot understand is (1) why it cannot drive more to its right? (2) if it cannot or dunno how to move, why not stop for me to move first? Now, even after I stop the car for it to move first, it hit my car! I put in a claim against the lorry's insurance company. But it is one of the worst driving habits here - always try to squeeze-in if a car delayed to start by few micro-seconds leaving a gap. What do you think are my chances of claiming? I believe your car bonnet might have eat into the Lorry's lane. If the lorry is far behind you, either you filtered quickly or do nothing at all. The lorry driver may have the same question: 1. What is this idiot doing? Why it cannot drive more to its left 2. if it cannot or dunno how to move, why don't you stay in your lane? Else, .. if 50-50 settlement, .. does the impact on your NCB (over a no. of years) outweighs the cost of your repair should you decide to bear all costs? P.S. Signalling your intent to filter is exactly that ... YOUR INTENT. Onus is still on you to do so safely, ... and not an obligation on the vehicles in that said lane to 'give way'. No photos to show I was at the lane markings unfortunately. I definitely did not recklessly cut into his lane, resulting in contact. In fact, the contact was in such a slow motion that i was surprised the lorry still can hit my car. Imagine, my car was stationery and letting him drive through ... and still can hit my car?!?!? What is there to protect someone in a position like me? The damage to my car is consistent with slow motion swipe rather than direct impact. Can you imagine, the lorry was so close to me it knocked my side mirror from the inside (ie. the mirror side) and not the right edge... but because it was slow motion, the side mirror bent forward.
