Teen at Mac's burnt after table tips and spills hot tea on her - Whose fault is it?

 

Madeline suffered burns at the McDonald's outlet at Scape after spilling hot tea on herself when her table tipped forward.

Singapore, September 7, 2012

 

She placed her elbows on the table as she opened a sachet of chilli sauce, but claimed the table tipped forward, spilling a hot cup of tea on her.

 

The private school student, who wanted to be known only as Madeline, suffered first- and second-degree burns as a result.

 

The 16-year-old and her boyfriend claimed McDonald's did very little to help them, and her parents said they may take action against the restaurant.

 

But when contacted, McDonald's said it twice offered to send Madeline and her boyfriend to the nearest hospital by taxi, but they declined.

 

It also said it had checked the tables to "verify that they are stable and safe for use".

 

The incident took place last Thursday at 5am.

 

Madeline and her boyfriend, Alex, 17, were having a meal at McDonald's at Scape after a night out at the movies.

 

They were seated at a table outdoors.

 

Madeline had placed a cup of hot tea on the table and was about to tuck into her Fillet-O-Fish when she placed her elbows on the table.

 

"It happened so fast - the table slipped under the weight of my elbows, spilling hot tea on me," she recounted.

She got the fore arms of Popeye. That's why the table flipped.

 

Seriously, I dunno what she do to make the table topple. She's not telling the whole story. She probably deserve it.

If the water is not cooked to the boiling point drink already will lao sai. Anyway who would serve you a cold cup of tea/coffee when you ordered for a hot one?

happened in the US before right?

 

some woman sued macs for no warning label about the coffee being too hot and got scalded.

 

now all got "Warning: Hot" labels

 

yup there's a lot more to that case though. i suggest you read up on it if you are keen. i remember reading about it in one of my law classes ... the lady in that case suffered burns that required skin grafts iirc ... she was also burnt in sensitive areas ><

 

the jury awarded her the money for pain and suffering ...

 

(however, this is based on a 4yr+ old memory, so someone will have to double check if i remembered the facts correctly)

we went to a lounge in a club house, he pressed abit on the low table to stand up ,the whole glass shuttered into pieces and cut his hand, go A&E

 

iirc public area regulation, you must provide tampered glass..

 

end up he also never claim..suay lor..

can claim one, the lounge is covered with public liability right?

 

almost same incident like my friend

 

we went to a lounge in a club house, he pressed abit on the low table to stand up ,the whole glass shuttered into pieces and cut his hand, go A&E

How much is the medical fee? A couple hundred or a thousand? She's still a student, no income loss. Hire lawyer a few thousand already, just to claim that bit of money? I think the lawyer also no hiew. If her parents got buy medical insurance for her just claim from there lor.

maybe she can start a case again MacD for not only the hot drink, i also find the table too flimsy and unstable. -_-
