Third Party Claim against SG Car in JB

Hi bros, got a question to ask if anyone experienced the same situation and how you went abt it...

 

Yesterday went Malaysia to visit relatives for CNY. Stopped at a traffic junction when suddenly a Malaysian Truck rammed towards the line of cars waiting at the traffic junction ahead. In total there were 5 cars damaged.

 

Malaysia Truck -> Malaysia Car -> SG Car -> SG Car -> my Car -> Malaysian car

 

I am thinking of going for 3rd party claim against the SG car that hit my car. The car in front of my car does not want pursue and drove off cos minor damages.

 

While my bonnet caved in, the engine is intact and radiator is leaking. Boot is caved in too. As radiator leaking I asked the tow company that approached me at scene to tow my car back SG. But the tow company said traffic at customs too heavy yesterday and today so will do it tmr. This tow company works with a SG workshop that is also an authorized workshop for a insurance company in Singapore.

 

My car will be towed back SG to my workshop tmr, so I thought can ask some suggestions here as to whether wise to claim 3rd party against the SG car behind me.

 

Any advice? Thanks in advanced.

All of the cars involved made police report at TP yesterday. The SG car that hit me out in the police report that it hit my car.

sorry to hear your plight.

 

it is a standard procedure that you claim from the one behind that hit you. As of how everything would be settled ultimately would be in the hands of the insurance co.

 

if it makes you feel any better, you are in a way lucky that its a local car and not a foreign car that hit you. Hope all are fine in your car.

How does 3rd party in the above scenario works?

 

I think if look to just claim from the SG car behind, it would be simple and straight forward. I am thinking of asking few WS for opinions tmr.

 

if WS suggests to repair for me and claim 3rd party, but claim my insurance if 3rd party is not successful... Is this reasonable and advisor to go for it?

While you are 'lucky' that the car behind u was a sg car, my heart is with that sg car... Damn suai for such thing to happen during this period...

Claim is not straight forward because it involves M cars.

You claim the insurance of the SG car who will pull in M insurers => takes a very long time

 

I think WS will have some "protective" clauses in the document you sign to protect WS interests (not your interests!)... please check carefully & clarify with WS if you are not sure.

I hope not that complicated. Unless all cars want to claim against the Malaysia truck.

 

I hope it is easier to claim against the sg car that hit me from back.

does it require to have a picture of all the cars in the accident as well as all those involve must mak a report before can cliam?

yours is a straight forward case so i believe they will proceed with the claim & repair first and settle with the rest of matter later.

Sorry to hear about your situation. But M cars owners might just "disappeared " before you can claim. Unless he is really honest person. Anyway, see if can settle it privately. At most go to his JB WS for repair. Dun expect him to come over to SG.

Heard from a Taxi driver today that in the situation of chain collision, the car in front will claim from the car behind. And so on. It seems that the one that started the chain collision will only be liable to the immediate car infront that it bangs.

 

So if true, then during chain collision, claiming will be easy if the immediate car that bangs you is SG car. If it is Msia car, it will be very difficult.
