Whiplash claim against me!

Some background of the incident.

On a single lane road, i have signalled to turn right but my car was more to the left hand of the single land road and when i turned right, the car behind me banged into the right hand front bumper. my insurance company took very long and case not settled yet after 6 months and now suddenly receive lawyer letter claiming whiplash injury. i know in the industry there are many such false claims of whiplash and not easy to fight back as they have certificate. anyone encounter such issues before? super duper angry my well known insurance company like accepting these claims without fighting.

 

not sharing any video as the case is ongoing and not sure will jeopardise my unclosed case

These claims are very common and no point raising your blood pressure over it . Just let your insurers handle the case .

sounds like behind car is trying to overtake since TS car is towards the left side. The behind driver probably thought TS car is trying to stop at the road side. 

 

Always try to position your car in the middle of the lane whenever situation allows even when turning left or right.

 

Turning right yet the behind car can bang the FRONT right bumper?

behind car probably claimed that TS car stopped at roadside and while he's trying to overtake TS car, TS car suddenly turned right.... BANG.... onto right front bumper. (Reckon it's right front fender rather than head-to-head bumper).

 

Most single lane roads will have wider width; the more you must position your car in the middle when turning. 

 

Behind car knock you but claiming against you? How does that work?

Exactly my thoughts. The other car probably claimed that TS didn't check before moving off from a stationary position. Else the other insurance won't be so confident of winning to ask other driver to claim GaoGao through lawyer for injury.

I suspect the story not so simple.

 

This is more likely:

TS wants to do an illegal U-turn in a narrow road.

So positioned his vehicle to the left of the lane as much as possible to give him more clearance.

Signal or no signal, if your vehicle is in that position stationary and there is no perpendicular road to turn into, the other vehicle will have assumed TS's vehicle is either parking/waiting at road side or wanting to sieve back into the lane after stopping at the road side.

Either way, the other vehicle have right of way.

TS did  not check clear before attempting to make that U-turn resulting in the collision.

 

Of course TS will not tell the insurance or anyone else that he is in fact trying to make an illegal U-turn.

Bro my car is moving not stationary when i tried to make a right turn. Yes is kenna right side of bumper and a bit of fender when he tried to overtake. And my intention was trying to turn right into the road and turn out as i know there are cars behind me. Not making illegal uturn Edited by Pentux

Yeah, I am just speculating based on what little info you posted. Understand you are not releasing the cam recording till the case is solved. Then we will have to just wait for that.

 

Just to say that in my 17yrs of driving, I myself have not tried or even witness anyone attempting to overtake a right turning vehicle from the right. That is simply foolhardy.

Bro, base on your explanation and video evidence, you should not have any problem claiming against the other party? Your insurance company will handle the lawyer's letter on the injury.

sometimes vehicle positioning can give the wrong cue to other road users although it's everyone responsibility to check and proceed safely. Just saying only.

The video clip will tell exactly what had happened

 

But it's really hard for anyone not to wonder why you keep your car more to the left when you intended a right turn.

I have a near miss few years back after signalling to right to turn in a carpark. A blue taxi just zoom past overtake from right....

 

back to topic...

 

Whether the party is right or wrong, can he make injury claim on other party? Anyone can enlighten?

 

I think this bugger try to test his luck and hope TS do not have cam.

yep! at the point of collision, ask got injury or not. all say ok, no injury.

6 months later got slapped with a $12k claim for whiplash!

let the insurers sort it out.

 

now i kenna loaded again for no reason at all. CCK, karma will slap you back! and the only wish i have? is to be there to witness it. TMD!
