Accident 50-50 cases, anyone been asked to go on trial b4?

pending and pending and pending and dragged for quite a long time and both side still can't agree on the settlement.

 

just wanna know if it's possible to go on trial for such cases?

 

been asked to go down to sub court for CDR, CDR = case dispute resolution, both side relate the story in front of a judge with both side's insurance lawyers cross examining.

 

end up judge says 50-50 but the so called plantiff may bring this further to trial cos they wanted 95 - 5 %.

Just let them go.. In the end if still 50-50... Both side pay.. Or defendant may contest for plaintiff to bear further legal expenses.. Yr insurer will take care.. Dun bother anymore. Just drive safely and get a car video cam protect yourself

Plaintiff wanna challenge, his own insurer also not free to carry on for him already.

 

He can use his own money to hire a lawyer. You just refer any such case back to your insurer filed under the accident date and ref.

it's not me. it's the other party. i don't think he can u-turn cos he went ahead claimed me lots of stuffs despite the fact that it wasn't a clear cut win case. he went to see specialist etc..

 

i was quite surprised as my insurance's lawyer told me that usually there won't be a need to attend court, but still got called up to sub court to attend the CDR.

ya my side the lawyer from the insurance also told me this.

 

hopefully they accept the 50-50 and close the case.

 

but he told me to be mentally prepared cos they might bring it to trial. cos the plantiff overclaimed me, if they u-turn now they lose also but if they bring it up to trial and lose they might end up losing more on legal fees.

 

cos for me, no matter who wins or what it will not affect me, i've already switched insurer and moved on but this case dragged for 3 years, time consuming. [:(]
