Would you relate these products sold in the mentioned departmental store to the REAL thing?

 

when the mentioned trademark was not used in their own product line and sold at 1% of its price?

High-end French fashion house Louis Vuitton Malletier, better known as LV, is suing a local footwear company which sold URS and Andinc women's shoes. The suit is for using trademarks on these shoes that are similar to its flower trademark.

 

It also named two major retail chains, Metro and Takashimaya for selling the products in 2009.

 

However, Fashion Street, the shoe supplier, was wound up last month for unpaid debts under a High Court order, and all legal actions against it are stayed. But LV could file a debt claim after establishing that Fashion Street can be held responsible for the breach.

 

The Straits Times reported that LV had hired investigators in April 2009 who raided Metro outlets together with officers from the Intellectual Property Branch of the Criminal Investigation Department, and seized 34 pairs of shoes there. They also confiscated a further 144 pairs from Fashion Street's own outlets.

 

LV said in its defense suit that the flower trademark, together with the LV monogram trademark registered by the fashion house, are well-known to the public, and alleged that the defendants had used trademarks similar to its flower trademark that could confuse consumers.

 

But Metro argued that the shoes were sold at vastly different locations, were priced differently at between $24 and $49, and targeted at different shopper groups.

 

Takashimaya said it would defend against to claim.

 

A High Court pre-trial conference is due to be held next month.

Like that Chanel can sue Charles & Keith (partly owned by LVMH) for copying the Chanel weave pattern on their bags? Bottega Veneta can sue ah kow ah ngiao shop for selling those ketuput weave pattern items?

 

These weave patterns are trademarks leh...

Then Salleh should sue Bottega for infringing on this ketuput weave that his great-great-grandfather passed down since 1862. Hopefully no house will copy his kambing satay design.

Good luck in proving that someone actually believes the $25 shoe he or she just bought is a LV. :D

 

The LV lawyers are just dumb to try to convince the court that metro and taka are selling fakes.

Are the trademarks really the same ? If LV lost, I wonder what will happened to the Intellectual Property Branch for taking part in the raid. :blink:

 

 

IP department only act on request of the brand owner, they are not responsible in winning the case.

 

The trademark could look alike but if they never use it in their product line sold in taka or metro, hard to prove of infringement, I think.

Nonsense la , if thats the case then LV can sue those manufacturers for making these paper bags that we burn during 7th month.

 

 

Still can sue, if they win the judgement with compensation, they get hell note, they probably can keep the change [laugh] [laugh]

Not only the person who buy, LV needs to prove than other can be mislead to believe that these products are real when they were carried or wear in public.
