I bet no one will be jailed in this case

 

All past cases involved having commercial sex with girl under 18 were all given custodial term. There were 2 cases whereby the girls were all Vietnamese pros under 18, one of the men was sentenced to 9 months jail and the other got 3 months. In both cases, both men did ask the age of the girls, but the girls in these 2 cases lied that they are 19 years old.

 

If I m not wrong, this offence carries mandatory custodial term, and under such circumstances, the judge has no option, but to sentence the accused to jail sentence.

Sex is a prostitute above 16 is just a normal routine offence. At most 2-4 months. From the number of participants, I wont be surprised that a fine would be meted out since this is a collective purchase which possesses higher bargaining power.

Think after the 'sex with underage pros' case, next time all will likely to make a video with declaration that the gal is at least 18 yrs old......if kena caught can say GVGT mah!!! [laugh][:p]

To me I'd be willing to bet that the defence will go more towards how "reasonable" it is to expect the guy to check - and aslo how "hardcore" the girl was.

 

In effect - they won't be challenging the facts, but rather the very law itself.

In reality it is hard to comprehend why a gal of 17year 11 months is deemed incapable to making a decision on whether to be a social escort, whereas 1 month later she is suddenly enlighten to the ways of the world and can be paid for sex.

 

The crux of the matter is whether she is an "exploited teen" or was she the one doing the exploiting. The law is unfair in this regard imho.

 

I also like the way they put the onus on the men for checking the age of the whore. As if most whores would be happy to show their identity documents - don't most of them use fake "trade names" to protect their identity? And suppose she shows them a fake document? Who's at fault then?

 

This is especially incongruous considering that our courts have previously let a woman off for claiming she thought an innocent man being dragged to his death under her Lexus was a piece of wood. I wonder if the onus should have been put on her for being more cautious - well, exercising a completely reasonable standard of driving care, IMHO. [rolleyes]

 

What a "just" system we labour under! It's apparently contempt to cast aspersions on our justice system, but I will say that the jury's still out on whether there are pouched marsupials here. :angry:

easy, but if he prove otherwise, double the term -_- -_-

 

as usual with courts, prosecution will usually rely on doctors to give expert opinion whether each of the guy is suffering from ED and capable of erection

 

then defendents will produce another set of doctors to show that occasional inabiilty to erect is common even among normal guys.

In this particular case, she is in for business selling her body. Isn't it the seller / shop responsibility to provide necessary info, eg age, of the merchandise? New car dealers indicate the Year of Manufacture. Seller or his agent selling properties, same. [:)] At the same time, the buy also need to check, it is a shared responsibility.

Another issue:- has the media gone overboard to reveal the faces etc of the men? Other serious crimes have been committed and the persons caught were not subject to the same degree of media exposure.

i feel it is overboard. already persecuting the men with the prosecution taking the stand that the men are guilty until proven innocent

They are just trying to sell papers...

Irksome and unfair, but hey life's a bXXXh..

 

Actually, morality aside, the guys did what they thought was within their legal right, hiring a prostitute.

 

Now we will need to see, if the fact that the pimp and the whore mis-represented material fact/info (which was taken at face value) will consitutute a viable legal defence.

actualy in the real world, transactions go like that

 

1) seller advertises the goods/services with certain representation of terms and conditions of goods/service

2) buyer usually relies on the representations unless there is compelling reasons to believe there is misrepresentation

3) buyer does some standard check of the goods/services at point of receiving it

 

in this case

 

1) there is mispresentation from the pimp and possibly the prostitute

2) there is no compelling reason for buyer to suspect there is some lie there. cos the girl does look she is 18.

3) the standard check the buyer could reasonably do is to check she has the female sexual organs (ie the usual condition of goods/service buyers of prostitution would look for. a check of the nric of the prostitute is not normally expected in the prostitution industry. unless our statute now wants to enforce this for the pros industry)

3a) the hotel is also required by law to check the lady customer to be aboe 18. this could be a defence the buyer also can cite. they assume other parties (hooker, hotel and pimp) have doen the requisite check

What if she had produced false identity papers? What then? Is it on the guys to check if her papers are false??? Might as well run a background check when hiring a whore. :angry:
