RMC had failed to identify beneficial owners of the money, verify the authenticity of remittance instructions or assess if the customer's remittance activities were "consistent with the profile of the customer".

KUALA LUMPUR, July 25 — Malaysia’s enforcement agencies must take immediate action if the US Department of Justice succeeds to prove in court the allegations of financial misappropriation from state-owned 1 Malaysia Development Bhd (1MDB), Umno Youth chief Khairy Jamaluddin said today.
 
In the meantime, he advised Malaysians to let the due processes take place and refrain from speculating on the affair.
 
“We take cognisance that this case has yet to be proven and that it should be taken to court. The civil case will determine if the assets are procured illegally [as claimed] and we hope the process will be allowed to take place.
 
“We do not want any parties to presume anyone as guilty yet because [the suit] was only an investigation, so we let the court process to take place,” Khairy told reporters after chairing the wing’s executive councillor meeting here.
 
“Although we do not want to pre-empt or make any assumptions, it is important for local enforcement agencies to launch an investigation should it be true that there was embezzlement,” he added.
 
He also supported the call by Prime Minister Datuk Seri Najib Razak for those named in the US Department of Justice’s (DOJ) civil suit to step forward and clear their names to show that there was no misuse of public funds as alleged.
 
Earlier today, Najib said the government took a serious view of the US DOJ report and was prepared to extend full cooperation to all involved in the investigation.
 
“We agree with the PM that those identified in the suit must be responsible to defend themselves… so that there are no more speculation,” he said.
 
But Khairy denied that the person referred to in the US lawsuit as “Malaysian Official 1” needed to clarify.
 
“No, those who are named as the owners of the assets for forfeitures,” he said.
 
He also said he would not speculate on the identity of “Malaysian Official 1”.
 
The US DOJ recently filed civil lawsuits to seize assets acquired with money allegedly misappropriated from 1MDB, the government investment fund.

Lobang Pecah!

 

Whistleblower website Sarawak Report has accused Prime Minister Najib Abdul Razak's administration of colluding with main contractor China Communications Construction Company (CCCC) to hike up the cost of the double-track East Coast Rail Project (ECRP) from RM30 billion to RM60 billion to secretly pay off 1MDB debts.

"The PM’s ‘cunning plan’ is to get the government to agree to inflate the actual cost of the East Coast Rail Project from only RM30 billion to RM60 billion, all to be borrowed from the Chinese government, in order to disguise the payment of 1MDB’s (and financier Jho Low’s) company debts," said the website in an e-mail communique.

Citing a whistleblower who allegedly provided copies of internal CCCC documents which detailed the supposed plan, Sarawak Report claimed that the government is set to approve the award of the contract to the firm, but with "a differential" of RM30 billion on top of the initial estimate.

The extra RM30 billion would be allegedly used to pay off 1MDB debts after the proposed project is to be approved at an inflated RM60 billion by the cabinet tomorrow.

According to Sarawak Report, China’s state-owned CCCC would purportedly help pay off 1MDB debt in advance and progressively, through several engineered transactions.

This includes allegedly paying off Abu Dhabi sovereign wealth fund International Petroleum Investment Company's (IPIC) debts on 1MDB's behalf, with an unrelated Chinese third party to front the transaction.

Secondly, it alleged that CCCC would also pay 1MDB an inflated price for the Ayer Itam land it purchased to pad the investment arm's coffers, as well as assume responsibility for repayment of several other debts owed by the Malaysian state investment arm.

All this, claimed the website, is to be funded by a loan from China to the Malaysian government, which taxpayers would eventually have to pay for in the course of the next seven years.

CCCC to be ‘rewarded’

In return, the website alleged that the CCCC would be rewarded with high profits, land, and extra influence with the Malaysian government, quoting the internal report it said blatantly laid out the plan.

"CCCC says it has been given land on generous terms, including a chunk of land which was given cheap by Najib to 1MDB, then inflated in value at Ayer Itam – the land which is valued at US$1.3 billion will be offered to CCCC for US$850 million.

"CCCC will also get tax breaks including from GST for the next 10 years. And then, as a Chinese state-owned company, CCCC notes the benefit of the extended influence over Malaysia the project and the massive loan of the cash (at a generous 2% interest rate) will provide," read the report.

Sarawak Report also alleged that the secret 1MDB debt pay-off also included monies to be channelled through flamboyant tycoon Jho Low, via the purchase of two companies he supposedly controls, Loh & Loh Corporation Berhad and Putrajaya Perdana Berhad.

Jho Low was named  by the US Department of Justice last Thursday in court filings where the DOJ is seeking to seize assets that it said were the result of US$3.5 billion that was misappropriated from 1MDB.

Sarawak Report added that the two subsidiaries of Utama Banking Group, Putrajaya Perdana and Loh & Loh, were identified as companies controlled by Jho Low, with Putrajaya Perdana having been implicated by investigators in allegedly funnelling cash from 1MDB’s subsidiary SRC International into Najib’s own personal accounts.

 

Sarawak Report noted that the names of both companies appeared on the diagram held up by attorney-general Mohamad Apandi Ali detailing MACC investigation findings into the matter.

 

Malaysiakini has contacted the Prime Minister's Office, Transport Minister Liow Tiong Lai and the CCCC for comment and is awaiting their response.

The government has consistently accusedSarawak Report of being part of a conspiracy to topple the prime minister.

The ERCL will link Kuala Lumpur to Mentakab and Kuantan (Pahang), Kuala Terengganu (Terengganu), Kota Baru and Tumpat (Kelantan).

Good link. I've been reading about John Malott. He's been writing since 2011 and complaining about the Najib/Malaysia/Racial Bias and how the US has been failing a democracy.

 

Interesting and a different viewpoint from him about Malaysia.

PUTRAJAYA, July 26 ― Seputeh MP Teresa Kok was today awarded RM350,000 by the Court of Appeal in her lawsuit against the government over her arrest and detention under the repealed Internal Security Act in 2008.

 

In the judgment read out by Justice Varghese George Varughese who was part of a three-man panel, it said the authorities should have investigated the allegations against Kok properly before detaining her.

 

It then reversed a previous High Court decision dismissing Kok's suit and ordered the government to pay RM200,000 for general and RM150,000 in aggravated and exemplary damages to the DAP vice chairman.

 

“I really thank the Court of Appeal for giving justice to me. This proves that I have been arrested wrongfully and unjustly,” Kok told reporters after the hearing.

 

“And all these accusations thrown against me that time, we just came into power, the enemy tried to paint anti-Islam, anti-Malay image on the Pakatan Rakyat government and myself. Now you hear very clearly from the judges saying all these allegations are without basis.”

hmm.. i foresee Msia and PRC relationship will not last long..

 

soon PRC will flood Msia due to huge investments...

bumi cannot tahan their loud voice and yaya behaviour.. before we know it.. all hell break loose and all PRC run towards SG for hiding..

 

it could be another case of what happened in Indonesia 1995...
