Pedestrians belong on the pavement. 

Cyclists may belong on the road, but they sure as heck don't belong in a "draft" formation, i.e. tailgating behind a heavy vehicle. 

If I "drafted" by jogging behind a lorry or a bus in slow traffic, I wouldn't expect the law to protect my dumbass.

Similarly the law shouldn't automatically protect cyclists (and penalise drivers) when cyclists pull dumbass stunts.

The law does not differentiate btw tailgate and drafting.

If the law don’t protect tailgater, it will not protect drafter.

Especially in the case of bike rear end lorry.
