SINGAPORE: A lorry driver in an altercation with a cyclist that was caught on video was found guilty on Tuesday (Dec 17) of causing hurt to the cyclist by a rash act and of failing to make a police report within a day of the accident.

Teo Seng Tiong, 58, had contested the charges, saying he had swerved to avoid a taxi and did not injure the cyclist, 35-year-old British national Eric Cheung Hoyu. 

However, District Judge Chay Yuen Fatt said he had considered the evidence and found that the prosecution had proven both charges beyond a reasonable doubt.

"I find that the accused had deliberately swerved his lorry into the path of the cyclist. I reject (his argument) that he swerved instinctively because he collided with a taxi," he said. "There is simply no basis to support his defence."

The incident occurred along Pasir Ris Drive 3 towards New Loyang Link on Dec 22 last year.

 

Teo's lawyer Chia Boon Teck argued during the trial that his client had swerved left into the cyclist as he had heard a honk on the right that he thought came from a taxi beside him.

Mr Chia also claimed there was "never any physical contact between the lorry and the bicycle". Cheung had jumped off his bike and rolled onto a grass verge.

After the incident, video clips showing part of the altercation went viral, and a petition was set up online urging the traffic police to return Teo his impounded lorry, with more than 8,000 signatures.

Cheung was fined S$2,800 in April for mischief and for not cycling in an orderly and careful manner as required under traffic regulations.

The judge adjourned mitigation and sentencing to next year.

If found guilty of causing hurt by a rash act, Teo faces up to a year's jail and a maximum S$5,000 fine. 

The penalty for a first-time offender who fails to make a police report within 24 hours of a traffic accident is a maximum jail term of three months and a fine of up to S$1,000.

He could also be banned from driving.

I agree with the verdict.

For me he swerved into the cyclist on purpose no matter what he says about taxi.

We can all see he was upset with the cyclist's actions and who wouldn't be, but it doesn't give him a free pass for what he did.

JUDGE QUESTIONS DEFENCE'S ARGUMENTS

Justice Chan Seng Onn raised several questions in response to Mr Tan's arguments, asking him "you mean the cyclist fell off on his own?" and asking the lawyer how he expected him to "buy" his defence if the district judge had not bought the same defence during the trial.

Justice Chan said that even if the hurt to the cyclist had been indirectly caused, the hurt was still caused as a result of Teo's actions.

"This lorry driver did a very rash act to 'squeeze' the cyclist, that he had no choice but to fall off and hurt himself," said the judge.

Mr Tan argued that Teo had heard "a long horn" from behind him, followed by a sound which he thought was the sound of the taxi colliding into him, and so swerved into the cyclist's path to avoid the taxi.

"What long horn?" answered Justice Chan. "Many people 'horn' me, I don't care. Basically you just ignore the horn. Cannot be - if someone horns you from behind, you just run into somebody in front. (It) cannot be, right."

However, Justice Chan acknowledged that the cyclist was "one-of-a-kind also", after hearing the lawyer's arguments.

"The sentence is not manifestly excessive given the fact that this is not only a rash but intentional act on the part of the appellant when he swerved the lorry to hit the bicycle, causing the cyclist to fall off and fall onto the pavement," he said. 

"It was a very dangerous act, having viewed the video, and I will therefore also uphold the period of disqualification," said Justice Chan, adding that Teo will serve his jail term immediately.

From the Judge respond to, the logic sound fair and mundane lor.

I ever drive my bicycle to petrol kiosk to pump air, when all done, drive off.

Half way home the bicycle tyre burst lor, very loud burst, like a balloon lor.

The street a bit crowd, luckily I never lost control of my car lor.....

 

Lorry driver 2 year suspension means all driving class(s) he is finished lor.  Can apply a Class 3 in 2 years time lor.
