Morale of story, if want to buy used car, don't bother to verify if ODO is true. Just assume is the mileage is fake so the disappointment won't be so great.

precisely! there is no way to “prove” the odometer is tampered by the dealer

the dealer can cry papa cry mama that when they take in the car, the odo could have tampered by the owner

then have to find the owner to testify in court that on the day he sell the car to dealer, what was the mileage ... may be also need hard evidence?

for fck sake ... just assume all used car odometer is tampered 99.99% ... as simple as that

The key question here is did dealer misrepresent the mileage?

It seems that the judge's comments is indirectly asking him to come back again when he has gathered the needed evidence.

But even then, the dealer can claim that they are the victim themselves as someone else had tempered the odometer, not them. If only he had tried to check with Mazda on the service records of this car, this can be avoided. ADs usually are ok with disclosing if the car has came back for regular service or not, the last service mileage and if they are still under warranty.

Fully agree, 90% are tweaked to make it low mileage to entice potential buyer, at times the number of buyer/s is equivalent to a well maintained car? depends on where it is being maintained by previous owner/s, not merely odometer or change broke pad, gasket, bushing, etc, has proof of receipt is equally important.
