If your lawyer scratching his head, you should find another one. He obviously not good enough and no confidence. The sentence from prosecutor is just a "suggestion" for highest penalty. At the end of the day it is up to your lawyer to convince and bargain with the judge for a fair sentence.

If I swing out and another car siam me and crashes and not one scratch on my car I also happy happy drive away as if I had nothing to do with it.
