Ravi unfit for law practice Mr M Ravi's retort From Today's report Lawyer's condition called into question by Amir Hussain 04:46 AM Jul 17, 2012 SINGAPORE - On the first day of the hearing for what has been dubbed the "Hougang by-election case", a man turned up in court and tried in vain to get the judge's attention. He eventually got an audience with Justice Philip Pillai after he had listened to all the arguments and wrapped up proceedings for the day: Uninvited, the man followed the judge, lawyer M Ravi - who was representing Hougang resident Madam Vellama Marie Muthu - and Chief Counsel David Chong from the Attorney-General's Chambers (AGC) into the judge's chambers. The uninvited man turned out to be a Law Society representative with a letter by Mr Ravi's psychiatrist which stated, among other things, that the lawyer is "currently unfit to practise law". The case involved Mdm Vellama's application for the High Court to declare that the Prime Minister does not have unfettered discretion in deciding whether and when to call by-elections. Justice Pillai reserved judgment. But the spotlight was firmly on Mr Ravi. The letter - its contents were seen by TODAY - was dated yesterday. It was signed by Dr Calvin Fones Soon Leng from Gleneagles Medical Centre and addressed to the Law Society. Dr Fones said he reviewed Mr Ravi on May 14 "following the concerns expressed by his friends". Dr Fones added that Mr Ravi "is having a manic relapse" of bipolar disorder and he "lacks any insight into his condition, as is often the case for patients who relapse". Dr Fones said that Mr Ravi had "refused" to take a break from practice and to take medication. Adding that Mr Ravi's illness "is likely to affect his professional capacity", the psychiatrist said: "I hope to be able to engage him voluntarily in treatment, but would advise that if he remains very uncooperative, we may have to impose the Mental Health (Care and Treatment) Act upon him." The Act provides for the admission, detention, care and treatment of mentally disordered persons in designated psychiatric institutions. When contacted, a Law Society spokesperson confirmed that it received the letter from Dr Fones, who is a doctor "appointed by Mr M Ravi, and not the Law Society". The spokesperson said: "The Law Society informed the judge of the contents of the letter as it felt that it was in the public interest to do so, and as officers of the court. To be clear, there was no application whatsoever by the Law Society to in any way prevent Mr Ravi from appearing in court." The spokesperson said that the Law Society is "not in a position to comment on the contents of the letter, as this is a matter of a member's confidential medical records". Mr Ravi had reportedly been diagnosed since 2006 with bipolar disorder - which is punctuated by episodes of mania and depression - and was also suspended from practising for a year in 2006. In 2008, he was charged - and subsequently fined - with disturbing a religious prayer session, using abusive language and causing mischief, and went into remand for three weeks at the Institute of Mental Health. TODAY understands that Mr Ravi was allowed by the court to practise under certain conditions, including that he has to see his psychiatrist periodically. Attempts by this newspaper to contact Dr Fones were unsuccessful. Speaking to TODAY, Mr Ravi insisted there was a "conspiracy" against him and that "they were just trying to block me from arguing the case". When contacted, Mr Chong said that the AGC "didn't know about this letter at all". Also, it did not ask that Mr Ravi be prevented from arguing the Hougang by-election case yesterday, he said. "It's really done at the Law Society's initiative," Mr Chong added. Mr Chong said that in fact, Justice Pillai - after reading the letter - was willing to allow Mr Ravi to argue the case again today. The offer was not taken up.

The Senate's Permanent Subcommittee on Investigations said London-based HSBC (HBC) failed to review thousands of suspicious transactions and properly vet clients over the past decade. Among other issues, the report notes that in 2007 and 2008, HSBC's Mexico unit shipped $7 billion in cash to the bank's U.S. affiliate, a volume of shipments that law enforcement officials said could reach that size "only if they included illegal drug proceeds." HSBC Mexico had a number of high-profile clients linked to drug trafficking, the report says, as well as "a huge backlog of accounts marked for closure due to suspicious activity, but whose closures were delayed." The subcommittee also found that HSBC worked extensively with Saudi Arabia's Al Rajhi Bank, some owners of which have been linked to terrorism financing. Some evidence suggests Al Rajhi's "key founder" was "an early financial benefactor of al Qaeda," the report says.

Passenger was not at Lakeside MRT station: SMRT Train operator SMRT has refuted the presence of a passenger who had taken a picture of one of its train's carriage doors left open while it was travelling, saying that she was never there in the first place. Ms Samantha Francis, 23, a content producer with citizen journalism website Stomp, had uploaded a photo on Wednesday morning showing one of the train doors wide open. She claimed that the train was travelling despite the open door and only closed when it reached the next stop at Chinese Garden. Ms Francis had boarded the train at 10.15pm on Tuesday night. She told The Straits Times that after the train stopped at the station, the doors on the opposite side to the platform opened first. She then took a picture through the closed doors in front of her. When the doors in front of her opened, she entered the train and took another picture of the opposite doors, one of which remained open until the train stopped at the next stop at Chinese Garden. Ms Francis said a Chinese man in T-shirt and bermudas and an Indian man were in the same carriage as her. Yesterday, she met with SMRT staff at Lakeside MRT to assist in their investigations. She showed them where she was standing when she took the photo and described what she was wearing that night to help SMRT identify her in CCTV footage. When asked by SMRT staff if her current ez-link card was the one used that night, Ms Francis answered yes. However, SMRT told The Straits Times in a statement on Thursday that Ms Francis was not present at Lakeside MRT. "We thank (Ms Francis) for coming forward today to assist us with our investigations. We are checking a few more things, as from our records (CCTV footage and ez-link card trip details), she was not at Lakeside MRT station on 19 June," said the statement. It added that its trains will not be able to move if the doors are not closed properly and that the railings in her picture do not match those at Lakeside MRT. "We wish to reassure commuters that the MRT system is built with many fail-safe features to ensure passenger safety", said the company. Stomp editor Azhar Kasman confirmed yesterday that the photos of the incident were submitted by a Stomp content producer. Free water for bathing, and recreational welfare. Could be the trend for employers to house workers in condo. I guess the properties will always have support from more import of Foreign workers. AsiaOne Tuesday, Jun 12, 2012 A CHINESE national died Monday night after reportedly jumping into a swimming pool following a drinking session with friends. The construction worker had been drinking with about five or six others at a Kovan coffeeshop before heading back to Goodrich Park, an old condominium where they were staying. The Straits Times said the group decided to go for a swim and then shower at the pool facilities as they shared three toilets between 10 people. The worker, aged about 40 and who apparently could not swim, then jumped into the pool. He began struggling and was pulled from the water. A friend said a neighbour quickly jumped in to help pull him out. He was apparently still breathing when he emerged from the water. The Singapore Civil Defence Force (SCDF) said they received a call at about 10.35pm and sent an ambulance to the scene. The worker was sent to Tan Tock Seng Hospital. The friend told the English daily that the worker had been in Singapore for more than a year and had just moved into Goodrich Park condominium on the afternoon before he died. Most of the people living in the condominium are foreign workers; companies are known to rent flats as dormitories for their employees. The Star/Asia News Network Tuesday, Jun 05, 2012 Malaysia Nanban reported that a man committed suicide after he allegedly saw his wife in a compromising position with another man. However, the wife claimed that her husband misunderstood the situation as the man was molesting her. On Saturday evening, Puran Sahoo, 22, hanged himself in the servant's quarters of a bungalow in Bangalore. Police said that Sahoo and his wife Manju were working as servants in the bungalow and that Shiv was a fellow employee. Sahoo had entered the quarters at about 9pm and found Manju and Shiv in a compromising position in the bathroom. An enraged Sahoo slapped his wife twice while Shiv ran away. Sahoo then locked himself inside the kitchen. Manju told police that she had repeatedly knocked on the door but Sahoo did not respond. By the time she called her employer and broke open the kitchen door, Sahoo had hanged himself. She told police that Shiv had gagged her and forcibly taken her into the bathroom.

Sunday, Jun 03, 2012 The New Paper Three cab firms get LTA nod for in-car cameras By Rennie Whang THREE of the seven taxi companies here have obtained approval to install cameras inside their taxis, aLand Transport Authority (LTA) spokesman told The New Paper on Wednesday. They are Comfort, CityCab and TransCab. At least one more company, Prime Taxi, is going through the application process. The LTA spokesman said that applying companies need to provide the objective for installing the equipment, its technical specifications and mounting mechanism, as well as the implementation schedule for installing the equipment. She said: "LTA will take into account the information submitted by the taxi company and consider factors such as the safe mounting of the equipment, and whether it will unduly affect the safety, comfort and privacy of passengers." Prime Taxi general manager Eric Ang said yesterday that his company was still sourcing for the right product and vendor. He said: "In-car cameras in all our taxis will happen, but not immediately." Both SMRT and Prime Taxi said information on costs - including how much a driver would have to foot - would come at a later date. In-car cameras would benefit taxi drivers and their passengers as it would expedite accident claims, defence lawyer Gloria James said. It would also come in handy if, say, a passenger sues the cabby in an accident. Such insurance claims can be hefty. In 2003, a lawyer was awarded $300,000 compensation when a taxi slammed into the rear of a taxi he had been riding in, resulting in whiplash. Said Ms James: "In an accident, the passenger sues the driver even if the taxi has been hit from behind. "The taxi driver then has to bring in the driver of the other car as a co-defendant. Letter from Brian Nelson 04:46 AM May 11, 2012 HAVING visited Singapore, one of our favourite destinations, many times in the past 25 years, my wife and I were shocked at the deterioration in attitudes towards tourists. The signs were already there on our last visit four years ago. The first thing we noticed as elderly people, particularly when using the Mass Rapid Transit, was that the youth have no respect for the elderly and the seats reserved for them and pregnant or handicapped people. It is also dangerous getting on and off the train when one is shoved out of the way time and again. Another observation is that nobody smiles or returns a greeting any more. Taxi drivers, particularly, used to be a wealth of information and eager to point out areas of interest but are now, mostly a surly lot. Service has also deteriorated in shops and restaurants, where many of the staff can hardly speak English, are rude and abrupt. As for the words "please" and "thank you", they do not exist. It will not be long before it becomes just a rat race, like in many other cities. Has progress taken away Singapore's soul, the essence of being human, of recognising one another? Your city is beautiful, your buildings tall and proud, yet to walk along the streets and see the surliness of a face is disheartening.

By Samuel Ee As the government looks at two possible ways to ease the COE supply crunch, some motor distributors are hoping it will go further and tweak the certificate of entitlement system itself, in particular, the Open Category COE. The Open Category or Category E COE is transferrable, unlike Cat A for small cars (under 1,600 cc) and Cat B COEs for big cars (above 1,600 cc). But with Cat B COEs in short supply, Cat E has recently been used by motor traders to register luxury cars. As a result, the Cat E premium currently tracks the Cat B premium, and they stand at $92,010 and $91,000, respectively. On the other hand, the premium for Cat A - for small cars or those under 1,600cc - is only at $64,201 now. "Dealers of luxury models have bigger profit margins, so they are able to bid more for a COE," said the sales manager of a Japanese dealership. "As sellers of cheaper bread and butter models, we can't compete with them. So we have been priced out of the Cat E COE segment." For a fairer system, George Lee, general manager of Opel distributor Auto Germany and Chevrolet dealer Alpine Motor, would like the government to consider splitting the Open Category so that some Open Cat COEs can be used only to register Cat A cars while the others are reserved specifically for Cat B models. "Right now, the system is unfair to Cat A models because Cat B car sellers are monopolising Cat E with their stronger purchasing power," said Mr Lee. "This defeats the purpose of having an Open Category COE that can be used to register all vehicles." Opel and Chevrolet have models in both Cat A and Cat B but the majority of the two marques' sales - about 80 per cent - are Cat A cars. "Right now, if a customer walks in and wants to register a Cat A car immediately, it will not be possible unless he is willing to pay the price of a Cat B COE," said Mr Lee. "If the Open Cat COEs can be allocated in such a way that no one class of cars can monopolise them, it will be more equitable." One senior executive of a dealership, who declined to be named because of company policy, agrees. "Yes, I think it will be better to apportion some Open Cat COEs for Cat A and some for Cat B, so that everyone has a chance to secure an Open Cat COE." However, he added: "I think the best way forward is still to abolish Cat A and Cat B based on engine capacity and just go with a system determined solely on exhaust emissions." Neil Fiorentinos, managing director of BMW Group Asia, said that the recent hike in the COE price resulted from a combination of strong vehicle demand and short-term price pressure, due to the quota limits experienced this year. "This price hike happens across all categories, even for commercial trucks and lorries, not just passenger cars. At this moment, any short-term measures, including the separation of the Open Category for Cat A, Cat B, etc, to alleviate the price pressure sentiment, will likely be welcomed by the general public." BMW is a luxury carmaker and the popularity of its models made it Singapore's top make last year. But the general manager of a small mass-market dealership does not agree with the suggestion. "This is effectively saying that Cat E should be abolished. This is rubbish. With this small COE quota we have now, it will push COE prices even higher." He said that Cat E now gets 25 per cent from the deregistrations of each respective category. Under the suggestion, if there are 100 Cat A COEs available for bidding, 25 pieces will be turned into a so-called Open Cat A COE, or a transferable Cat A COE. The general manager asked: "Cat A, Cat B and Cat D (for motorcycles) were made non-transferrable to prevent speculation. If you allow speculation in Cat A COEs, plus reduce the supply of non-transferrable Cat A COEs, won't that raise premiums even further?"

Wednesday, May 09, 2012 The China Post/Asia News Network Taiwan drivers to face fines for using electronic devices while driving Car drivers who use hand-held mobile phones or tablet computers while driving will be fined NT$3,000 (S$130), and motorcyclists NT$1,000 in the near future, according to an amendment to a road traffic safety regulation passed by the Legislative Yuan, yesterday. The amendment to the Road Traffic Management and Punishment Code will see drivers using mobile phones, computers or similar devices fined NT$3,000. Those who fumble with such smart gadgets while waiting at red lights are also subject to the code and will be fined similarly, Ministry of Transportation and Communications (MOTC) Deputy Minister Yeh Kuang-shih said. Under the amendment, those who wish to answer phone calls either need to use headsets or park their vehicles first. While the Legislature cleared the amendment, lawmakers voiced concerns about the new regulation's enforceability. The MOTC replied that its plans to reach a more practical approach, which could include sporadic inspections. Another amendment cleared by the Legislature raised fines for car drivers who race past level crossings from NT$6,000 and NT$12,000 to between NT$15,000 and NT$60,000. The MOTC said the current plan is to pass supplementary amendments by early September, after which the announcement of the implementation date of the amended Road Traffic Code will be up to the Executive Yuan.

AFP Monday, May 07, 2012 KUALA LUMPUR - Malaysian clerics have issued a fatwa against demonstrations, days after Prime Minister Najib Razak said a quashed election reform rally was being used to topple the government ahead of polls. Tens of thousands defied a government ban and took to the streets on April 28 to demand clean elections, breaking through barricades and clashing with police, who fired tear gas and chemical-laced water, arresting 513 people. "Rioting, causing disturbance and damaging public property are all forbidden by Islam," National Fatwa Committee chairman Abdul Shukor Husin told state media late Sunday. "This also applies to any intention to topple a duly-elected government by organising such demonstrations," he added. Najib is widely expected to set a June date for what is predicted to be a close battle between his ruling coalition and the opposition led by Anwar Ibrahim, but observers say polls may be pushed back over the rally fallout. Although video sharing sites like YouTube have shown many scenes of heavy-handed action against protestors, Najib told state media Friday that the Dataran Merdeka or Independence Square rally, which was supported by opposition groups, was aimed at more than just electoral reforms. "They had the intention to take over Dataran Merdeka, not to gather for two or three hours but for two or three days or even longer, to show that the government cannot control the situation," he told the national news agency Bernama. "They wanted to make Dataran Merdeka like the Tahrir Square in Egypt," he added. Federal police chief Ismail Omar told the Star newspaper they had started an investigation to identify the mastermind behind the alleged overthrow attempt. Analysts say Najib may delay expected polls following the rally, as his reform credentials appear to have been dented. Najib was also hit by heavy criticism of a police crackdown on a similar rally for electoral reform last year and has since launched a campaign to repeal some authoritarian laws and pledged to expand civil liberties to regain voter support.
