  5. Hi guys I face the following scenario. My friends told me it is weird and better let the workshop do the claiming. I was hit by a van from behind. I was stationary at traffic light when it is red. Sent my car to workshop for repairs and was advised that law firm of insurance company will contact me with regards to claim for doctor visits (anyway I see doc for 1 day MC only - $20+). The law firm contacted me and I furnished the receipts and MC. That was in May 2014 last year. Now, law firm calls back and says that the judge (dont know simi judge) says that in order to expedite the claims, the other party will pay 90% while I foot my own 10% (huh? SMLJ, must I die from the accident then the other party will pay 100%?). Anyway, to cut the long story short. I refused to accept the explanation of 'expediting' the claims. My question - has any bros here deal directly with the lawyers on such matters? Or will workshop settle for you? And also, if I settle with the 90/10, will this translate to me admitting that I was 10% at fault in the first place and will this affect my car repair claims also (meaning also become 90/10, then NCD kana affected)? Can any kind souls help me out here?

After Cravath, Swaine & Moore LLP said last week it would boost starting pay for its junior-most lawyers to $180,000, law firms across the country stumbled over themselves to announce salary increases for their own associates. But now companies are pushing back. Bank of America Corp.’s top lawyer recently sent an email to a group of law firms calling the increases in associate lawyer pay unjustified, making it clear the bank wouldn’t help firms absorb the cost. “While we respect the firms’ judgment about what best serves their long-term competitive interests, we are aware of no market-driven basis for such an increase and do not expect to bear the costs of the firms’ decisions,” David Leitch, Bank of America’s global general counsel, wrote in the email, reviewed by The Wall Street Journal. A Bank of America spokesman declined to comment. The latest law firm salary raises boosted first-year pay by 12.5%, and gave comparable hikes to the rest of the associate lawyer ranks. Pay generally went up by between $20,000 and $35,000 for every associate, topping out at salaries of $315,000 and above for the senior-most associates, typically with eight or nine years of experience. The chief litigation officer for a Fortune 100 company said $180,000 for a first-year isn’t justified, pointing by way of comparison to a lawyer in the company’s litigation department with 20 years of experience who doesn’t make that much money. “Why would we ever think a first-year associate is worth that?” the lawyer said, adding that they recently denied a firm’s request to charge $400 an hour for a first-year. The identities of the law firms that received Mr. Leitch’s message aren’t known, but the email appeared to target firms that handle the bank’s litigation. “We value the work performed by our Litigation Roundtable firms and seek to maintain a true partnership that meets our reciprocal needs—thoughtful, strategic, and cost-competitive representation at rates and alternative billing arrangements that are attractive to our counsel,” wrote Mr. Leitch. Advertisement The email ended by saying Mr. Leitch entrusts the firms who receive the email with its work because of their “legal expertise and entrepreneurial instinct,” and looks forward to continuing to partner with them. Like many other large companies, BofA has worked in recent years to reduce its legal spending; in 2013, the bank told the Association of Corporate Counsel it slimmed the number of firms it hires to defend it in litigation to 30 from around 700. Bank of America spent $1.2 billion on litigation in 2015, according to its earnings report. BofA has used firms including Skadden, Arps, Slate, Meagher & Flom LLP; Paul, Weiss, Rifkind, Wharton & Garrison LLP and Cleary Gottlieb Steen & Hamilton LLP for big litigation matters in the past. Paul Weiss declined to comment. Representatives for Skadden and Cleary didn’t immediately return calls for comment. Cravath didn’t immediately respond to a request for comment. The push-and-pull over pay and rates has for decades been a source of tension between corporate legal departments and the law firms they hire. Historically, law firms charged their clients in only one way: by the hour. While many in-house lawyers grumbled about the arrangements, saying they encouraged inefficiency and led to eye-popping bills, they mostly paid them. But within the last decade or so, companies have pushed back. They now routinely demand “flat-fee” arrangements for a single piece of work, like a lawsuit or a transaction. And many have stopped paying for photocopies and legal research, items that were once rubber-stamped. In-house lawyers have also ramped up resistance to paying for the most junior lawyers, often saying they won’t pay for first- and second-year lawyers even if they are staffed on assignments. Such lawyers, the thinking goes, are too often billed out at hundreds an hour to perform relatively menial tasks, like reviewing documents. Not all in-house lawyers are railing against the raises. Edward Ryan, the global general counsel for Marriott International Inc., said he believes “law firms are responsible for their own cost structure” and that what ultimately matters is “the value of what we pay for.” That said, he questioned if clients will “take their business elsewhere” if law firms try to pass off the costs directly. Before Cravath raising its salaries, associate pay industrywide hadn’t budged in nearly a decade, a time during which law school tuition has skyrocketed, leaving many graduates with upward of $100,000 in debt. Many associates had complained to law-firm leaders that in recent years their pay scale had failed to keep up with cost-of-living increases. It isn’t entirely surprising that dozens of firms have followed Cravath’s lead and matched the new salary structure in recent days. Large law firms view keeping pace with market leaders like Cravath as part of staying competitive in recruiting and retaining their younger lawyers, even if their profits are lower and they operate in smaller markets.

Dear forumers, thanks for taking time to read my story. hope you can provide me with some solutions and advice on how 2 handle my debtor. what happen was a friend that i've known for 5 years approach me asking for a loan of 10k to help him with his investment. he assured me that once his loan from the bank was approved he will return me the money which he said was about 2 weeks. in addition, he showed me prove that he was also selling his HDB by showing me his post in Propertyguru, saying that he will have the money in no time. being naive, i borrow him the 10k with a IOU stating that he will return me the money as soon as his bank loan is approved. 2 weeks passed and i had yet to hear from him. so i called him up and he start giving alot of excuses saying that the renovation loan was delayed as the banker need to visit his premises to ensure that the renovation was done etc. however, i found out who the banker was through my own means and after talking to the banker. i realised that his loan has been disbursed to him! to make things worse, i contacted his property agent and ask how is his property doing. to my dismay, the property agent said the owner rejected an offer of 330k! ( his price to sell is 340k). now it has been about 4 months since i borrowed him the money but he has yet to return me a single cent. i have considered getting a debt collector to collect back the money but i understand that it is not a guaranteed procedure. the debt collectors will only go up and ask for the money the debtor until he give up.i have also approached lawyer but the fee is 4k to sue him to court. i am at my wits end as i do not know what to do. i have the IOU with his signature. after discussing with lawyers he said my case is 90% win(provided the guy dun declare bankrupt). this has been a traumatic an painful learning experience not to trust people too much.... Appreciate if some brothers give me advice? am open to any low cost methods to collect back my money! thanks in advance!!!
  10. Hi bros, I was involved in an accident last month at newton circus, at Bukit Timah Road exit. My car was in the 4th lane of the bend and just as I passed Bukit Timah exit, there was another car in the 3rd lane which had knocked into my right rear bumper. That car was actually attempting to take the exit and just swerved left despite seeing my car 3/4 ahead of her. Then came this PRC woman shouting and insisting that it was my fault. We exchanged verbal war, one China style and the other S'pore style. During the conversation, she claimed I should have stopped my car, since I am ahead, for her to take the exit. She told me since it is my fault, I should pass her $300 to compensate her and she will not pursue anything. Told her go back mainland and play stones first. Never mind, I took down the details of what happened in my accident form which stated what had happened. On my copy, we both signed on every page to certify it's accurate. She has a similar copy too. The next day before she reported to her workshop, she called again to ask me to compensate her. All those she said the night before. Not wanting to waste time talking, told her it's ok, just go claim insurance since no one wants to private settle. After a month of waiting to know the outcome, my workshop C&C called today to tell me the china woman is engaging a lawyer to claim my insurance. Therefore, her insurance company will not be part of this process anymore. Accordingly to C&C, I can only do the same since she initiated this. I was told that her report to her insurance company is the direct opposite of what had happened. But because I have a black and white on the whole story bearing her signature, I have a strong case in my favor. Now before I decide what to do, can anyone advise if they have been in a similar situation before? Any comments on my next step? Appreciate if anyone or a legal advisor can enlighten me with the questions below. 1. If I decide not to engage a lawyer, what would happen then? Does this give her the right to claim my insurance straightaway? 2. If I lose the court case, do I pay for the other party's legal fees and then her car damages will be claimed against my insurance? 3. How long would such a case drag for? 4. What would my chances be? 5. What are the procedures for this whole saga? Thanks everyone for the time reading my long post!
  11. Hi all. Sorry if my topic title is not clear. Made a 3rd party claim this year. Then, a few month later, received a lawyer invoice to pay lawyer fee. Wrote back to the lawyer to ask why I need to pay since its a 3rd party claim? The lawyer replied that the legal costs is a different issue from the cost of repair. Workshop claim legal fee...no? If i pay the legal fee can I claim it back from the workshop? Need your advice. Thanks.

  16. Hi All, Anyone can recommend good lawyer with reasonable price for willing making arrangement when we are still healthy and living? Am thinking to make this arrangement for my next generation. Who knows what will really happen after we passed on. Also was thinking to make arrangement for CPF nomination also. If the child is still a minor below 21 years old means what ever that is nominated by me to my child will only distribute to him at 21 yrs old? Any one can recommend a good laywer with reasonable price for the will? Many thanks.
  17. Seriously something is wrong here. A disgraced, on-the-run lawyer here could practice his trade in the Land of the Free & even travel frequently overseas for work? For 6 freaking years?!! Is it that the authorities never raise to INTERPOL's attention or if done so, no one basically "hue" our little red dot? Luckily some German was alert enough to arrest this joker and justice was served. Madam Ho is PM Lee's wife. He also asked for an apology to be posted on the website by Feb 24, and which must remain on the website for the same number of days as the offending post had been.   20. It was report in today's The Straits Times that Michael Puhaindran, who is the surviving husband of Lo Hwei Yen has afterall found himself another soul mate. They are going to tie the knot on 1/1/12. After all the intensive media attention and focus on how he felt about the loss of his wife and from the newspaper reports, internet discussions and his blog we empathise his devoted love for her, this news came a bit of like an anti-climax. There is no right or wrong in this issue but my point is we got to have some reservations with what we post or said in the media or social network because news like this will definitely leave a bad taste to someone has negative views about remarrying soon after the passing of spouse. Especially in this case.

Hi guys, i was involved in an accident ith malaysia lorry. basically malaysia lorry at fault as it lost control. lorry has to also pay for damages done to public property other than damages to my car. Howver my workshop reluctant to make claim against malaysia vehicles, saying very troublesome etc and ask me to claim my own insurance. i am quite pissed off as it is not a situation where my 3rd party claim is a weak 50%-50% chance of winning, but rather it is a 100% clear cut claim. So would appreciate recommendation of lawyer or workshop that is expereinced in claiming against malaysia vehicles.. that also has quality repair as well. thanks
