Negligent drivers who cause death will now face jail time

SINGAPORE: Instead of a fine, the default starting sentence for motorists who cause death by negligent driving will now be a jail term of up to four weeks. This is before the extent of their negligence and other factors are taken into account, three High Court judges ruled in a landmark judgment issued Wednesday (Sep 3).

However, such traffic death cases — which fall under Section 304A(b) of the Penal Code — will not carry an automatic custodial sentence as the court will examine the circumstances of each case. The sentencing benchmark for such offences was set out by Chief Justice Sundaresh Menon, who led a specially-constituted three-judge panel in hearing an appeal by prosecutors to impose jail time on a sleepy driver who killed one and injured 11 others.

In upping her sentence from a S$10,000 fine to four weeks’ imprisonment, the judges agreed that Hue An Li, who did surveillance at a casino and had gone without sleep for 24 hours prior to the accident, had demonstrated egregious negligence.

Detailing the grounds of what the judges called a “significant change in the law”, CJ Menon distinguished between rash and negligent driving in the written judgment.

Different maximum penalties were prescribed for death caused by rashness and negligence, in amendments made to the Penal Code in 2008.

 

 

Guys... be extra careful while driving. No more pay money and case close....

It's time le :)

You kill a person and yet expect to escape with a fine?!

Unless it's really the pedestrians fault, then else prepare to go jail if a driver fails to spot the pedestrian and knock over him and kill him.

 

Many times, a rich driver expect to just pay fine and escape off ...

Does he think of the death pain that he has caused to the deceased family?

Poor people lives are cheaper.

 

Rich and elite lives are more important to society as evidenced by past cases.

If you look at the last 50 cases of FEMALE motorists knocking dead someone, the sentence is almost 100% a FINE and no jail.

Yes, guess all r equal................... need to be careful driving on the roads as well as being a pedestrian.....

Aiyah, no change lah. Instead of fine, you just won't kena charged with negligent driving lor. 'Failure to keep a lookout', slap wrist, then can go back to normal.

 

Just like speed limits, its there to hammer you if they want to, when they want to. Not to hammer everyone at 100% rate.

That one ah,,, her name was Cleopetra something.... the judge said... something like.. under the canopy of darkness coupled with the solid insulation of the lexus... impossible for her to know she farking knocked a cyclist.....

 

Another case was the newspaper editor.. use SMS and killed the bugger... but left the courts unscathed.

Her sentence is more than 4 weeks. Negligent is a lesser crime than dangerous driving.

SINGAPORE - A woman who beat the red light and caused the death of a motorcyclist by dangerous driving was sentenced to six months' jail and banned from driving for seven years on Tuesday.

Riana Sapuan, 44, a shipping firm secretary, had admitted to driving along Choa Chu Kang West Flyover on Nov 10, 2012 when she caused the death of Mr Ho Sheng Ngian, 59, at the signalised cross junction of Choa Chu Kang Way by Kranji Expressway.

She had failed to follow the traffic red signal and driven through the junction, thus hitting Mr Ho who was making a right turn from the Choa Chu Kang East Flyover slip road. The light was then green in his favour.

Mr Ho, a driver, suffered severe injuries and was pronounced dead at the scene.
