I wouldn't say not mature.. I would say contentious.

why? because all along ideas can be patented even if practice it can never be engineered.

 

take light bulb. patent expired for donkey years and nobody could make one last long enough until Edison came and took it on.

If the patent was still valid, would Edison still try to make one even if he had to pay the patent royalties? or worse, the patent-ter would not license Edison's own invention to him?
