What's the best way to settle this?

a fren of mine ask me this question. Can you also help me?

 

this fren of mine drives a WISH.

He purchased a brand new oil cooler & installed from a mod shop.

all looks fine until a week after collection, his engine kapoot due to oil leaked & towed back to the same mod shop while travelling in PIE.

 

Though the shop insisted that my fren shud have stopped if something has gone wrong to his car.

I understood from my fren that it took him about 5min to get to the shoulder in PIE with crawling speed when he noticed the check light appeared.

I told him to have the repair done up 1st with the shop before discussion on blame.

 

now, the total parts repaired is $2200 (with proof of purchase) and $900 on all labor.

 

I told my fren to discuss with the mod shop:

- shud my fren settle 50-50%?

- shud my fren pay up the parts repaired only?

- shud my fren settle all by himself?

 

above is not even accounted for the car's down time - 5 weeks!

 

yr constructive advice and best view pls?

Its the shops fault. Shoddy workmanship. Unless it was the oil cooler itself that leaked which means its the manufacturer's fault.

Does the shop explicitly offer a warranty on their workmanship? If not, they can wash their hands off this case, and the owner has little recourse. He also has a part to play, because if oil leak, low oil warning light would come on on his dashboard. But engines nowadays also so fragile. We once ran a cheapo 4A Toyota engine without engine oil (broken sump) and it still lasted months before it finally died and we called the wreckers (this was in Australia) to come take the carcass away.

it seems that the shop is trying to push the blame by replyt my fren dat way - refer above.

but my fren told me that he was unsure since the car was still moving when he saw the lite.

when he swerved to the shoulder & restart again, then the eng seized.

i'm aware that mod shops will always verbally give positive reply when you 1st step in but . . . . not constitute to a MUST

 

so the final doubt still is:

- shud my fren settle 50-50%?

- shud my fren pay up the parts repaired only?

- shud my fren settle all by himself?

 

Which is more reasonable?
