Edwardtkh Clutched December 16, 2004 Share December 16, 2004 Hi all.. Have this situation, which I'm very newbie to it and requires alot of advices. I've a close friend, together with his GF, were taking a cab from orchard to jurong point last sunday. During the journey, my friend and his gf were happily chatting with the cab-driver, who was in his 20s. Everything was well until it came to one point when the cabby asked my friend if he had passed his driving test. My friend had just failed, and so the story goes. Before reaching jurong point, that cabby asked my friend to take over the wheels and he wanna see how good my friend's driving skill is... this is where the exciting part comes in.. my friend stupidly take over, and when he was making a U-Turn, he hit a bus. Luckily it was just minor damages to both bus and cab.. but the point is, he wasn't holding on to any driving license! Then the bus driver came down, jotted down both the cabby's and my friends particulars.. upon realising that they are in trouble, the cabby turned to my friend and said.. he has no driving license too!! Tat cabby refused to take any responsibility but nevertheless, his particulars were jotted down as well. Now, i've a few enquiries to make. 1.) What is the penalty for driving on the road without a driving license, and somemore, no cab-license as well? 2.) given the above scenerios, how to assess it? any mitigating factors available? 3.) who is at fault primarily? shall tat cab driver be involved as well? the only witness is my friend's GF who was present in the cab as well. TP had already been informed... please help.. any kind advice is deeply appreciated! ↡ Advertisement

Burnings Neutral Newbie December 26, 2004 Share December 26, 2004 I think in your fren case it is very serious because 1. He does not have a driving license. 2. He does not have a Taxi license. 3. He drove the vehicle without the owner's permission (Assuming the driver is not the owner of the cab) For the 1st charge, he will prolly get his license disqualified for at least 1 year and fine not exceeding ($2000 if I am not wrong). 2nd charge he will definitely be fined but dunno how much. 3rd charge, depending on the prosecutor, he will be charged with theft without arm in daylight which carry a 7 years jail term. Upon multigation, the charge can be changed to theft in dwelling which carries a max of 3 year or fine or both. As for the cabby, I dun think he will be charged court. However, he will be sued by the cab company under their own agreement or contract signed. I dun think insurance will cover in this case so the cab company or the owner (whichever is registered) will be required to pay for the damage and in turn your friend will be sued for compensation. Get a good lawyer. Tatz all I can say.

Your friend should have the common sense not to take up the cab driver offer to drive. What is he trying to prove?? And i do not know why the stupid cab driver will want to make such ridicules offer to your friend in the first place. If both party had show some sense, this will not happen. Looks like it is a chargeble offence. Hopefully, they just enact a fine instead of confinment. Let's all pray for your friend....BUT definitely not the stupid caddy whom i think ought to be whip. Mazdaowner Moderator October 8, 2005 Share October 8, 2005 This is not possible as there is a minimum age criteria for obtaining a cabbie license, and it's 30+ if I'm not wrong. SMRT does allow it's drivers to drive without a valid taxi license, as long as trhey have a driving license, as they take the lesson in the evenings, and the test as they go along. Rest like Comfort, TIBS etc..have to pass the test first prior to driving. This one takes the cake, and crumbs as well.
