In short, effective control and administration trumps prior discovery under international law.

Sorry, but there is no need for you to re-post information of China's prior to me which I already mentioned but did not dispute.

You don't have to apologize since you have missed the examples you were asking for.

In fact, that is precisely one of the most effective evidence to support one's case. [cool]

Common sense tells you the world will be in a very messy place if

I am surprised that you do not know almost all International legal arbitration involves some form of historical evidence and documentation - messy or not/

You are not familiar with the The Treaty of Shimonoseki and Taiwan.

I already stated in earlier posts that:

Taiwan was annexed thus was part of the above treaty but Senkakus were not annexed but "no man's land".

So you familiar loh? Do educate me, please...

Let's start with sharing with the Forummers which countries are and are not the signatories in The Treaty of Shimonoseki ?

And how did this Treaty came about?

I humbly await your expert input. ^_^

If what you say is true, then why did China only start this farce AFTER there were indications that this area may have oil? [rolleyes]

Checked and mate. This and the fact that the chinese power transition is not smooth (Bo Xi Lai saga) and it happens at a time when the economy is kinda bumpy - nothing like a common enemy to bash to divert attention - are the only 2 reasons why these are happening now.

China had sent 6 surveillance ships near the island liao...

Personally I felt that since Japan already brought the islands from its private owner, case close liao what, when u buy down something, that thing will belong to you what...

Any one knows why the Japanese gov suddenly decided to "buy" Diaoyu Islands after so many Donkey years claiming it is theirs from 1895?

After the civil war, the ROC was badly defeated and flee to taiwan and the CCP had weak naval so both cant challenge the might of USA. Since mainland was taken by CCP the USA simply give it to japan. If you have 2 kids, you bought 1 toy for one and the other will fight over it. This is the same theory that USA is using.

Dun forget China has Russia which is japan neighbor and she also has the mad dog who will volunteer to stand in the front line if she is whacking Japan. This mad dog had sinked a south korean patrol ship, bombard the island at will and still scot free.

Anyhow, I dun think USA will go to war. Japanese are too naive that they will shoulder to shoulder with them. Dun forget these are the person who forefather gave them a surprise attack do you think they will trust them? Also the Japanese can ask the Chinese about how trustworthy the west are since we had a fair share dealing with them these hundred years. In short, when a wolf meets a fox they create b------ds.

The most obvious reason is because Japan have been exercising

effective, continuous control & administration of Senkaku Islands from 1895 to 1945,

which is what really matters in international law in territorial disputes.

Sounds like horsburgh lighthouse case [laugh]

japanese are just chinese in disguise.

take back the fishing islands and also the mainland japan as well.next stop, reclaim back the whole korea peninsular.

US tried to split up the PRC which they had successfully done with the soviets.lucky DXP was good enough to crash those TAM troublemakers.

those tibet and xinjiang extremist troublemaker trying to play a fool with PRC.just crash them all,do what the PRC is famous for.

Hellooooo....why are u all fighting/debating so hotly in this topic? This is all a show....get it? Each country is trying to stir up their nationalistic pride...so whatever unpopular taxes, policies they implement during this period, they can do so without much protests because all of their ppl are busy protesting outside each other embassies....

Both are not comparable case, in both physical, administrative and historical factors.

Physical:

On Pedra Branca, Singapore build permanent official structures (lighthouse, helipad, generator station etc) and exercise control on and seas around the Island - All done continuously since Singapore's independence from both the British and Malaya.

Pedra%20Branca.jpg

In contrast, there was hardly any structures built on Diaoyu islands in 1945 until today (before nationalised by Japan).

Senkaku-islands-008.jpg

Administrative:

Japan lost the island in 1945.

It was the WW2 victor, US, who took over the islands under Treaty of San Francisco since 1951 - a treaty which both PRC and ROC rejected as they did not agree on the terms.

Come 1972, US made the unilateral decision to "handover" to the Japanese without consultation with the original owner.

In simple words, here is nor was any "effective, continuous control & administration" under the Japanese until today.

*Note:

CKP's source used in his post only refer to period 1895-1945. Whatever happened BEFORE 1895 and after 1945 ?

I let the the Readers to arrive at their own conclusion.

actually during that time were their equipment equal? i mean, I have the impression that last time most Qing soldiers all use sabre to fight wasten guns. so if their equipement wasnt equal. having a larger army doesnt really give you much advantage.

You are not too far off..

Whilst the japanese have a smaller fleet, the fleet is modern and more advanced. (think firepower, maneuverability, speed, endurance, etc)

The Qing dynasty bought obsolete equipment at outrageous prices.. no need to guess where the money went.

I saw some documentaries on the wars between china and japan, japan and russia and invasion of manchuria.. parts of it documented the naval war, and how the new military tactics became so vital in the new paradigm of warfare, especially naval warfare.

On paper it's always easy to compare.. but the quality of the commanders are harder to compare, even if battle tested, just like the battle of midway. There is the element of luck and even skills of soldiers at the lowest level who can change the course of the war/history.
