Aesthetic design is a lot harder to protect. And you have to get your patent worded right to minimize loopholes. And yes, sometimes it's not worth it to litigate.

yep.....courts will throw out some frivolous copyright or patent or trademark suit if the product in question shouldn't or can't be suitably protected.
