Dear MCForumers

 

I agreed to it and the guy's boss told him to write a letter stating he would pay for the full damage to the car. I was impressed with the boss, really helping his employee.

 

Just curious. Did you get this letter stating that the guilty party will pay in full for your damages? If so, just claim his insurance.

 

If you worry abt paying the excess, I think going back to AD for repairs would solve that problem (Repairs would be more than the excess).

Always claim insurance from the driver(s) who bang from behind as it is to your advantage.

Make it sweet and short , i.e name/rank/ic nbr / time / date/place of engagement/weather /witness.

yeah..the boss told him to write in black and white regarding that. I was naive enough to accept and acknowledge it. The reason why I asked for the transportation compensation is because I have to send the car to my friends place so that he can view the car being repaired. I go to work using the car. If I dont have the car, cos it needs to be repaired, therefore shouldnt i be compensated for that? Anyway, I told the boy if I am being unreasonable. the boss can discuss it with me. I dont think I deserved to be 'threatened' about the insurance claim.

 

Before this incident, I was banged by another car. Again, I acceded to the driver's request to go to his workshop. As I drove to his workshop, i asked for $20 for the OPC coupon. As I left the car at the workshop, I needed to travel back to work and then collect the car from the workshop again. I claimed for the taxi fare which the guy agreed. He was 'gentleman' enough to compensate me for that as I was kind enough not to do a claim and not complicate matters. However, I now realise that sometimes thats not the way to go.

 

Learning Pt 1: If u get hit by a car from the back, just claim and dont entertain compensation.

Learning Pt 2: Always deal with the person directly and not involve his other associates.

since he dare you to report to insurance,i think you should.

you have a very high chance of winning.

at the same time,tell the insurer that the other party did not display "P" plate.

in my point of view,you have the right to claim the transportation fee for your own convenient.

Thanks bro for ur advice. As I am a new driver, every bit of feedback is a learning point for me. It is quite sad that they stated they are in the car trade and knows what needs to be done. I hope the other new drivers here can learn from my experience and not make the mistakes that I did.

Rule #1. Never, Never ask for $ from the other party.. He can accuse you of extortion. [shakehead]

 

Just claim from the other party's insurance who bang you from behind.

 

Afterall, you will be either offered a courtesy car from the workshop or a small amount not more than S$50/day for loss of use from the insurer.

You're not wrong in thinking that you should be compensated for loss of use for the car. But all these should have been discussed during the initial talk with the guy's boss where you decided on the settlement.

 

He proposed that he will pay for all damages, but did not mention that he would pay for your OPC coupon or other transportation costs. You agreed. That's why you were wrong to ask for extra again later.

 

An agreement is an agreement. If one party can ask for this and that later, then it will make things very problematic later if the list of things asked for never ends. You must put yourself in that guy's shoes.

The rest have already pointed the main point. Therefore, I shall only talk about the compensation part.

 

If you have wanted to claim for the transport (as stated in your 'previous' experience), you should have stated that in the first place and not after the 'agreement' was signed.

Bro, most likely, the boss is pissed off and think that you are playing punk because you have asked for 60 bucks as your transportation fees after you & him have agreed to settle the thingy earlier [:p]

 

Jus like previously i kena kissed on the rear by a lorry but i jus collect from him the charges involved in re-spraying the bumper back [;)] I did't demand a cent more other than that cos we had agreed to settle the amount just for repair only [;)]

As u are claiming his insurance - wat excess r u talking?

 

U will be paying the excess stated in yr insurrance unless u are claiming yr own insurrance.

 

Most incident case like yrs - if agree settlement on the spot, if change consider NOT GentleMan. But still can if u think u being bullied or threaten to.

if i were you, i'd just call the cops back down to the accident site upon discovering that the driver is a p-plater who did not display his p-plate. somemore with his kind of driving attitude, i will give no chance.

 

then you'd have a sure-win 100% claim. together with courtesy car during the course of repair.

 

all this would have been avoided if you just went by the book, esp in cases like these when u have no clue about the opposite party(if they're good trustworthy ppl)

yah i argee with the rest once an offer had been and you argeed to it, a contract is formed bwt 2 parties...any addition after the contract can be consider ungentlemen le bro..

 

For me, if I was bang at the back and when upon it's clearly the other party fault, i will write down the singapore accident report then make him sign the the report and in blue & white that he will be responsible for all the damages and compensation (reasonable) then take photo with either my handphone or camera (if i had one at the time) then go idac to report the matter...the matter i think should settle on the spot and dun let the other party advised you to go his workshop or to settle by his associate...You will never know what they will do next..

 

then after sending to idac then send to your motorshop and ask the shop to claim against his insurance.

 

i kanna this kinda of case before while i was riding a bike and i crashed into a honda bumper which just had a slight dent...after so many weeks without any news, i thought the driver was kind enough to let the matter rest as maybe he pity that i had a slight fracture to my collarbone.To my shock, he ask his lawyer to send me a huge fat bill of i think around 8k to 12k claiming for his bumper, rental of cars, loss of income etc....

hijack this thread, last wkend i sit a cab and the cab bang with another cab, but i walk away unhurt, in this case, can i claim or ask them for compensation for the shock i got and the time i wasted being stuck at the accident scence?

well...tried to fight back and up till now still did not know whats the result of it as my ncd for bike was not cancelled off....

I do understand that you would like to be a kind soul but for your info, at the end of the day, you will be the one that is losing out, if they back out last minute. Moreover, there is the TP passing by so let the TP handle by saying that you are feeling a little giddy.

 

I do have a similar incident before, and being a kind soul, we tried to settle ourselves. Who knows later they back out and to my surprise, they have reported to police about the accident without my knowledge and in the end, they claim me back. [furious] Although that is a expensive lesson but at least learn from my mistakes so there is a saying - ONCE BITTEN, TWICE SHY, [shakehead] from there onwards, no way I will ever settle the dispute within ourselves......that is just my little piece of advice..... [rolleyes]
