Of course it was driver's fault. Say TP directing traffic, and you drive without care and checking on coming / nearby vehicles / blind spot, who's fault? TP>? Still the driver...

....however i find that the owner of the exhaust shop has got attitude problem too.

it gives me a 2nd thought in visiting them.never....

I guess a lot depend how that driver approach the owner of the exhaust shop. I may have reacted likewise if someone was rude and keep wanting me to take part of the blame when I'm 100& innocent.

 

I guess the boss probably said that cos the driver 'threatened' to 'bad-mouth' him if the boss refused to share some cost.

Cannot blame the illegally parked car. In this kind of workshop area, there's always cars illegally parked left, right, centre, everywhere. One-way road but cars facing all sorts of directions. No choice because there's not enough space in the workshops to contain all their customers' cars.

 

The driver has himself to blame for being kayu.

Sadly, as sympathetic as I can be, the fault is entirely yours. These "marshals" are not exactly the smartest tools in the box so it'll be suicidal to trust their judgement in directing traffic. Even if you're to lay claim with the insurers, you'd be 100% liable. The illegally parked vehicle will be exonerated in this case cos it is a stationary vehicle. Putting it simply, if you see a vehicle parked at the side of a road or a person standing at lane 1 waiting to cross, you slow down & take evasive measures, not hit them because you got the right of way. In TP terms, that is failing to keep a proper lookout....

 

My sincere sympathy lies with you for being "conned" by a workshop "marshal".....

Good practice to always check the surroundings of the workshop and around your car for hazards before you reverse out. If unsure, stop and double check. Tough luck for this driver. Hope he learnt his lesson.

Urm..

actually... I read somewhere that someone bumped into a illegally parked car..

 

ended up... ruling was that was a 50-50 blame..

 

so the moving car only payed for his own damages..

Never take things for GRANTED,

his staff is trying to direct the traffic and allow you out,

not your car. you on the other hand in controlling your own

car and have you own look out for objects obstructing your way.

so who do you think is at fault??? YOU lah...

Agree.

 

And to add on:

Illegally parked car is just that: illegally parked. Doesn't mean anyone else hitting into it can blame the car for being parked there in the first place.

 

Else, we can end up being 'right' to knock down all the illegally crossing pedestrians on Serangoon road or Geylang rd liow [:/]

Just trying to extrapolate to some other scenario:

 

1. If a road marshal is directing a van or lorry out and the vehicle hits something, is the driver still at fault? There is genuine blindspot involved.

 

2. There are road marshals with those stop/go signals. Will you trust them? I've seen some with two go'es on both sides of the road because they can't be bothered to flip the signs when there's light traffic. (You see a go and stop from your view.) What if one side is out of view? Is any accident still your fault?

 

My view is that both parties are at fault.

of course mainly driver fault lah. it's still his onus to keep a lookout for himself.

 

from what i know the boss of JC is not an unreasonable man. the driver must have pissed him off in some way.
