Hi, anyone here ever patented something, either for themselves or on behalf of their company? Need some advice, cheers.

before you can patent an idea, it must satisfy 3 or 4 conditions depending where you want to file: Novel, non-obvious, patentable, and useful.

I know....I already applied for a patent....yesterday got a letter from IPOS....it says I may file for patent outside SG if I wish to, from the date of the letter.

 

What's the purpose of such a letter? If i wanted to file overseas patent, I could have done so without permission from IPOS.....are they trying to say my invention is novel only in SG, and i better get an overseas patent to protect myself?

 

The $#@% clerk at IPOS wasn't much help at all...kept leading me in circles [crazy]

I am not sure about patent but been dealing with trademark in many countries. what was registered in Singapore will not protect your idea overseas, i.e. you need to cover in as many country as possible, meaning it is very expensive process. if you really have a novel product or idea, get an IP lawyer to do the necessary registration overseas.

 

the letter from Singapore show that your idea been recognize and originated from Singapore. however did they check such idea has not been filed elsewhere?

patent or trademark filing need lawyer to handle cos it can be quite complicated, the staff at ipos is not lawyer, given the whole things about intellectual property is still in the infant stage here, not many are train in this area, NUS only start to offer full time IP law degree couple of year ago.

thanks for trying to help, but I need the actual experiences of someone who has successfully filed a patent.

 

Usually only companies or individuals with deep pockets can engage patent agent/lawyer to help. If i get one, before i even start production of my invention, me and my family already starve to death LOL

Bro,

I think in the IPS there a package which let u file patent in serveral countries at one time.

else u have to apply to every country.

 

for my case, my company did all the work for me [thumbsup]

Its not easy to register a patent & also costs a lot.

 

The SG patent office was just telling u your "invention" not exclusive enough to patent here. U can try for a UK patent as I think it covers SG also. But b prepared to spend a lot of $$$.

This is the reason why a lot of good inventions were not patented by the inventors & the "idea" was "stolen" by some other rich person/company who might have made millions but the real inventor got nothing at all.

 

If u think u really got a good invention, maybe u sud look for investors to back u first & with more resources, u can file for a patent.

 

The clue that your idea is worthwile to patent is the willingness of investors to back u up with their cash.

dude,

that's only a "security" clearance under S34 of the Patents Act to allow you to file overseas..

basically speaking, if you are resident in Singapore, you need clearance to first file overseas..otherwise you need to first file in Singapore (which you did in this case that's why they issued you a "formalities" letter clearing you)

no, that letter that skunk got has nothing to do with the substantive stuff of the invention yet

 

btw, no, a UK patent does not get protection in SG..only in the UK

The whole patenting system can be pretty confusing to the layman. The reason you need to get a patent agent (these are not necessary lawyers) is to ensure you draft a proper specification, which has to be in a cedrtain format. The claims has to be structured properly to ensure a good protection.

Patent is territorial and thus, you only get protection in countries which you seek protection. Oe more thing, you got to bring infringement to court and cannot just cal police to stop your infringer. THat's why it is a expensive game.

If you want protection in other countries, you can try filing PCT application with WIPO. Request for a search and examination result.

Search results will tell you that the examiners have found similar patents, publications, applications etc. The examination results will tell you on what basis did the examiner rejected your claims.

 

With these results, you can decide for yourself whether to carry on filing in other countries or abandon your application.

 

Unless you are very very sure of your invention and countries you would want to file, the above may save you quite a sum of money.

 

By the way, IPOS does not have any examiner. SG patent will be automatically granted by 5th year as long as there is no objection.

Of course the company do swee swee for you, coz they will own the rights, and benefit from it..

Oh OK.

 

But the letter seems to ask him to try to patent in another country. Seems like SG patent office dont want to handle it. Doesnt make sense?

 

So if want to patent around the world, means must file patent in every single country???

 

Wah like that is almost impossible to do. [dizzy]
