Wrc206 Neutral Newbie April 1, 2010 Share April 1, 2010 Just forward the letter to your insurance(at that point of the accident) and they will settle for you.
Mrjay Neutral Newbie April 1, 2010 Author Share April 1, 2010 Thanks for the reply bro. But I am curious? How come only now then the lawyer's letter came? And since i have changed to another insurer, my ex-insurer at the point of time should take up this case rite? Also, do i need to appear in person? Anyone got any experience on this? Mrjay Neutral Newbie April 1, 2010 Author Share April 1, 2010 I had not changed my ride lah... just my insurer since they offer me a better deal... Cos the contents of the lawyer's letter sounded quite serious... like I am going to jail like that... luckily i search through my pictures and still able to find the evidence of the incident... What I am angry is that the farker's car not even slightly dented!!!!

Diamond2006 1st Gear April 1, 2010 Share April 1, 2010 by law, any claim can be done within 3 year from the date of accident.
Mrjay Neutral Newbie April 1, 2010 Author Share April 1, 2010 WTH!!! That means this stupid incident got to stick to me for 3 years??? Hard luck!!!
Airwaver 4th Gear April 1, 2010 Share April 1, 2010 Yes it can take up to 2-3 years. It could be due to the claims whereby the claiming insurer find that the claims are unjustifiable, therefore the delay.
Firehorse 1st Gear April 1, 2010 Share April 1, 2010 NCD not affected, I'm the 3rd car of a 4 vehicles chain collision, but insurance still get loaded the next year though not excessive. Keep the statement of claim of yours & the other party, so you can remember the incident of what happen that day. Keep the photos. Forward/Fax all lawyer letters to your insurer to follow up. The rest is just waiting. That was my 1st collision claim and I'm also learning to understand the process. Very draggy & frustrated. Was told to meet up the lawyer next week for discussion. sigh! Airwaver 4th Gear April 1, 2010 Share April 1, 2010 But i thought your insurer will "hold" your NCD until the case is closed?
Civic2000 Supercharged April 1, 2010 Share April 1, 2010 As far as I know, the lawyer representing the claimant will write to both the driver (the party at fault) and his insurer. A copy of the letter is sent to the Insurer by Hand, and another copy is sent to the driver by post. The copy that is sent to the driver is known as Certificate of Posting. The lawyer is required to send a copy to you b'cos you were a party to the accident and that they have to notify you that they are now claiming damages against you. Nevertheless, your insurer will handle the claim and there is no need for you to do anything.

Kia0042 2nd Gear April 2, 2010 Share April 2, 2010 (edited) Yes, just let your insurance company do all the things. Expect layer's office to call up for interview. Well, I actually dislike to mention my experience but since..... sigh... here is my story. My experience with my previous ride 4yrs ago- it took about 2 yrs to settle. I lost the case. My insurance company paid the other party $25k (the initial claim was a new car replacement 66k, medical fees and other claims 50k). 66k was: "internal injury" caused the car fully demage, need to change almost every parts - claim a new car replacement. medical claim & other claims - 50k for ambluance transfer from house to a private hospital at Orchard Road at 1 am (14 hours after the accident), this person address resident in AMK. medical report - almost 1 inch thick, cost of the medical report is 5k. No hospitalization needed, neck injury, MAY permantly lost ablity to work. Car rental for 1 month. lost of business opportunity that worth his one year income lost of income coz unable to work for 6 months. You may curious want to know how the accident happened and how bad the accident was? Well, I "kissed" a old Honda City (made in thailand one) who suddenly turned out from a car park and e-brake immediately, I can't react to stop in time and "kissed" on his bumper, leaving a 3cm dent on it. That's it. And how's the driver looks like? A 29 yr tall big man with tatoo and dyed gold hair. He won the case but he did not get what all he claimed. I think 25k is still good money for him. I duno how he can get a specialist to write him a medical report, he also has 2 eye witness which i have no idea. I consider myself unlucky at that time. Yuan 6th Gear April 2, 2010 Share April 2, 2010 Thanks for the comments... maybe i will just give a call to my insurer on monday... and sit back and wait... Check the letter whether it is addressed to you direct or it was addressed to the insurer but copied to you. Whatever the case, let your insurance company know and pass the letter to them. You might want to check the progress or outcome of the outstanding case from them. Don't worry too much. Don't lose sleep too. Enjoy the long weekend. I hope this wont happen to me in my case... The damage on the other's party car is only a small scratch nia. The bumper is still intact as though nothing happened... ↡ Advertisement
