Tansrb Neutral Newbie September 16, 2010 Share September 16, 2010 hi all. had an accident today. how it happened was like this: it was green light so i went past the junction. i was on the centre lane. there was a there was a side road on the left hand side, a bus was waiting to filter out into the main road. after my car was about 3/4 past the junction, the bus saw that his left lane was full, thus without signalling, accelerated into my lane instead. i no choice had to jam brake hard, but too late. so to avoid an accident i swerved to the right lane. just nice there was a car on the right and i hit it. i admit im at fault for hitting the car, but is it possible to claim the bus indirectly caused an accident due to driving recklessly? i have witnesses. btw, i was not speeding. my foot was off the pedal as it is everytime i approach a junction. i was travelling at around 60-70km/h. how do i know? there's a speed camera at that junction so i glanced at my speed while i went past. and my foot was off the accelerator while cruising past the junction ↡ Advertisement Link to post Share on other sites More sharing options...

Ken4555 1st Gear September 16, 2010 Share September 16, 2010 i'm not an insurance guy or watever... seriously just my point of view... legally this is only between you and the car you hit... dont know how you are going to prove the bus caused this... logically it would have been better for you to hit the bus... i'm sorry this happened... i think the best think to do is to see what responses you get here, then compare them with the best person to talk to, your insurance company lawyer/rep... i know this sucks... good luck with a speedy settlement... Make a complaint to SBS, did you take the number down? Also for your case, its better to have hit the bus but i believe natural reflexes cause you to swerve the car, it happen to me twice and both times fortunately i am safe... I remember basic theory also got test a question that writes about similar scenario, and the answer is keep to your lane, those who chose other answers other than keep to your lane I think its immediate failure, though they say its 5 wrong, but its not really true i think... But anyhow if hit the bus might have been better, now the bus driver gets to drive away a free man... SICKENING (Some of them are MIC, seriously... feel like slapping them sometimes... cos i seen have they just cut into my lane without signal... makes my blood boil... I encounter 4-5 near misses with the bus... ARRGGGHHHH!!!!) SO I feel for you brother.... Anyway I think its very sad that this unfrotunate incident happen to you... but unfortunately the guy you hit will probably claim from you cos I think maybe got no case to claim from SBS bus... cos the driver will deny... Brothers and Sisters of MFC, I got into a stupid accident which is NO fault of mine before and cos of that I bought a in-car video camera... I suggest brother transrb and other fellow brothers, please go buy one, maybe with the footage you could have claim indirectly from the bus... From this, i have a feeling its gonna be hard to claim from the bus, BUT if you have about a couple of a thousand dollars, you can sue the bus company for that incident... I believe that if you both are agreedable, and have the bus number plate, you may both have a case, against the bus. It depends on the report presentation by both of you. May accidents all over the world are like that: the actual culprit knowingly/unknowingly got away without a scratch Wishing you both all the best in your claims against the bus (I almost became similar victim's victim a few years back: culprit got away as I was obstructed from the culprit's number plate) Link to post Share on other sites More sharing options...

Chrispie 5th Gear September 17, 2010 Share September 17, 2010 another pt to consider for the car TS hit is that if you guys cannot put the bus at fault, and let the insurance companies settle the resolution agreement between TS and the other car, it is probably gg to be a 50/50 case. Usually when its a sideway collision, it is settled at 50/50. When i kena such incident, i spoke to the surveyor and what the companies do is that they arrange a day for meeting to go through all the cases. And to settle matters quickly and 'fairly' if its a sideway collision, they will meet halfway and move on. ( i kena this.. taxi into my lane, yet i paid half). so... the car that TS hit also really lan lan... Hope TS get some justice by pinning down the bus... if not.. both him and the other driver really suck thumb.. Link to post Share on other sites More sharing options...
