Dear all,

Newbie here advise needed.

Say I kissed someone's backside, minor scratch and misalignment. No report to insurance co/ police for record purposes. The other party agreed to repair at my workshop, all repairs done. He happy say settled, signed indemnity form.

1 week later, he go report and wanna make a claim. Will I be penalised for not reporting for record purposes and my insurance makes a payout?

What can I do to prevent the above mentioned scenario?

Any accident (irrespective of whose mistake) has to be reported to your insurance. You can always tell your insurance that you opted for private settlement when you make the call. Better to settle with the other party again in private. If your insurance comes to know, you would be in trouble.

If you do not have black and white on private settlement...4 letters....L P P L.

 

Under the rules of insurance....the other party reserve the rights to file a claim within 1 year of accident...there after...he files in intention...he can wait for up to 6 years to complete the claim...(stand to be corrected)

 

He also have to make his claim 1 week late mah....so call your insurance company and tell them the story lah...he will have to explain why he took one week as well...cos under IDAC...he has to make a report within 48hrs.

Just report even if you are settle privately. Just inform your insurer that you are settling privately and do not make any payout without informing you first.

He might have made the report within 48hrs already but changed his mind and told the insurer he wants to claim instead. Thats what I did before when there was this guy who agreed on private settlement after rear ending me but he kept on dragging the payment.

lets say both parties agree to private settle,and both sign the black n white stating they will not make claims against either parties. do we still make a report to respective insurance agencies? from wat i heard, some insurance companies will withhold ur NCD once u make such a report (even if u specifically tell them that its private settlement). their reasoning is that if the other party decides to claim,hence why they will withhold ur NCD first. won't this jeopardise ur premiums for next yr even if its private settlement? experience fellas pls comment, tks.

These days, vehicle insurance matters are a bane to motorists. It's a catch 22 situation regardless whether you report or don't. The rule of the thumb is, despite the fact that they may withhold your NCD unless you fight for the release, you are supposed to make an insurance report. It helps if you have a written agreement to complement your report.

Accidents often give opportunities to workshop, insurers and surveyors to exploit the situation for their pecuniary interests at the expense of the motorists.

Let's do our part to reduce accidents by observing basic traffic rule and road courtesy every time we are behind the wheel.

Ic... thanks for all the inputs. Now I have a clearer picture.

 

Rest assure I am not trying to shrink responsibility, I sincerely want to settle the matter asap and peacefully as the other party is extremely detailed about the damage and its a car with huge patchy bodykits and a cracked front lip which is why i am worried he might try to inflate claims and such.

 

I was foolish enough to just take a picture of his scratched bumper as it was dark and drizzling and didnt have a proper camera with me. He took more pics and sent it to me the next morning saying there were misalignment to his chiong tail-light and I am sucking thumb big time now.

 

It's really a minor impact cos I was already approaching the traffic light and already slowed down to about 10km/hr. and i assure him that i will pay for the repairs to his bumper which os also chiong JB kind. I just hope he be fair and just about this matter. I want to close this.

Wow...then TS will be in D E E P Cowdung !!

 

Insurance can chose not to accept the claim as TS fail to report within 24 hrs.

The guy claims that his tail light is out of alignment due to the impact of the bump. which i think is quite ridiculous. as ours is a small march and no injury sustain on our part. I doubt it was caused by us.

i've attached pictures pls advise...

My workshop tells me that his aftermarket bumper have been previously repaired as there were Fiber fillings when they took out to do the repair works.

sigh... i think he is not honest at all... but i did repeatedly tell him we will repair the bumper and he is still nit picking on other areas which i dont think its fair.

 

Now repair works has been done on his car and he is still not happy, what can I do on my part if he choose to report or change workshop to re-do?

Sometimes, just have to be a bit firm la. some people are just 欺善怕恶. He not happy not happy lo. hit hit a bit mis-align tail light, ask him go LPPL lo. If he claim, also no choice.

 

Just remember next time keep a safe distance from the car infront of you. keep at least half car space, no need die die follow bumper to bumper closely. Some bohboh car driver might suddenly reverse or some manual car might slide down abit on slope before going forward will kiss your front liao.

well you just got to bear the cost.

just fix for him or ask your workshop to check.

 

after fixing everything that is within reason, if he still tries to be funny, just report to the police as cheating case and LL inform your insurance.

under private settlement if there is black and white doc everything should be fine.

first question. what document did you sign for private settlement?

second question. did the workshop witness the process of the private settlement made.

if there is legal documents you can handover your case to a lawyer, if he still pursue on.

now he have make a report if you have sign the right documents for private settlement your insurance will reject the case.
