Hondavvvtec 1st Gear September 18, 2012 Share September 18, 2012 why not you try approaching the Small claims tribunal? There is a step where you can actually apply to seize their property. I have not encountered such an amount of $22K yet. but i did managed to help my friend get his money back from the dealer, who owed him few K which he refuses to pay up after a couple of months. I have not encountered such an amount of $22K yet. but i did managed to help my friend get his money back from the dealer, who owed him few K which he refuses to pay up after a couple of months. i went to the tribunal and it was there that i told to sompah infront of a magistrate and then the case was then referred to Bedok Police Station. went to the station for an interview with an IO .... abt 2 months later, they sent me letter saying i am on my own. i produced all the bounced cheques and an IOU by the dealer - all also no use. Ysc3 Twincharged September 20, 2012 Share September 20, 2012 (edited) So did you engage the lawyer in the end, or just continue driving the car that's not under your name? One last route is to talk to your MP. Believe me sometimes it works. PAP under a lot of pressure to get things right after the last GE. Worst case bring it to the press. Spend $5 do a business profile search, bring the owners of the company to shame. Luckily it's $22K, not some $220K BMW or Merc. went to see a lawyer who adviced me to forget it. not worth to pursue the case coz like i mentioned above, the lawyer told me : can fight, can win, but might end up footing all the court fess if the dealer cannot pay. anyway, this happened 10 years ago liow ....and i can sort-of say can be considered a $220k conti ... coz i lost total of $22k for driving a 9 year old imprezza for 11 months only. Galantspeedz Turbocharged September 20, 2012 Share September 20, 2012 ****LATEST UPDATE**** Dad had called again, and the boss ask for leniency to extend the transferal to 1 MONTH Apparently, Dad had proof that he had paid the FULL AMT in CASH, in black & white (carbon copy) Dad had asked for "insurance", in case of them not paying, they.. 1) promised to write a guarantee letter, stating that they WILL TRANSFER in 1 month's time. they had claimed, we go to police, at most their boss go jail, car later cannot drive how ? etc etc.. Had said they need one month (maybe to gather money la) Can any wise brother/sister help to advice, what we shld do now. SINCE we have proof and recipe of purchase, i was thinking, isnt it SOLELY on the company side to settle with the bank? since we had paid and they had acknowledged, HENCE, Bank cannot touch my dad's car right? pls advice.. thanks in advance!!!! is the company a private limited or sole prop? If private, i think close company and you no recourse liao... i won;t give them a month unless i have some form of collateral + a guarantee by the boss himself and not the company
Ysc3 Twincharged September 20, 2012 Share September 20, 2012 What is the company name? Should warn everyone about it. Just report to LTA and police, easier to settle. Involve authorities if possible! the MF wound up his company and that's why i was left in limbo ... he opened a new outfit with someone else somewhere in Katong i heard but cannot confirm .... the IO investigating my case had the details but said he cannot give it to me. Hubwee Supercharged September 20, 2012 Share September 20, 2012 The company is a Pte Ltd or SP ?? If PL , try to get the director or owner to sign a personal guarantee with his NRIC number , nothing under his company . This way , even if he closes it down , he cannot get away with it . Ah_bock Neutral Newbie September 20, 2012 Share September 20, 2012 I think it's better for TS to name the company for this case. All of us will be able to take note and avoid this dealer.... Encountered this problem about 10years ago (This company is no longer around) , trade in my car for another then realise that the bank is still deducting $$ from my acct for the old car. I went to check with the dealer end up they haven make the full settlement for my old car. It went on for abt 3-4mths and each time the dealer will give me a cheque to pay off the instalment that was deducted from my acct. Luckily the cheque didnt bounce. macrosszero Turbocharged September 20, 2012 Share September 20, 2012 I'm not entirely sure about this suggestion, maybe other people can comment. Should the TS's father go to the bank/finance firm that "owns" this car to inform them of this situation? He has the relevant paperwork proving that he paid for the car and that it is the dealer that didn't complete the transfer by clearing the loan still owing. Otherwise should installment payments lapse, he might find his car towed away for no reason at all...
