Need help for car sold!

If he claims it is consigned, then say you do not want to have it consigned anymore. You have to weigh your facts properly, if you feel that they do not have intention to settle & you do not want to deal with them anymore, find the car and take it back asap. If you do not have the keys, engage a tow truck.

 

You & the bank are still the legal owner regardless. You can proceed to file case for breach of agreement if you have a strong case in your favor.

 

Regardless of the dealer, he is still a third party. You still have an existing legal obligation with the bank for the car.

It's a case of words against words, since your friend did not get the dealer to tick on the purchase option, they are not obligated to honour what your friend claims ir to buy the car.

 

Reckon your friend will be incurring cost in vain to sue them, basically sue on what premise? There isn't any black and white to prove his case. Dealer might have their own version of the story.

 

Perhaps it was indeed a misinterpretation on your friend's part? If not, then lesson learnt, always ensure that whatever agreement must be in written form.

Is there any "proof" of the $42k price?

 

First priority is to try and settle the summonses. Go to TP / URA / HDB NOW with whatever proof / evidence you have that you were not driving the car.

 

If you have some sort of documentary proof that they offered $42k and are now only willing to pay $36k, take the $36 k first and then sue for the balance through small claims court would be my advice.

 

Why? for $42k must engage laywer and go high court - YOU WILL NOT GET YOUR MONEY BACK.

 

If keep it to the $6k that is actually at dispute, can be settled without laywer and the fee for small claims is only a few $10s of dollars.

 

BUT - in the general sense, whatever is written in the contract trumps everything else - so you may be S.O.L - UNLESS there is something that you did when passing over the car that indicates this is a sale, rather than a consignment.

Infact I got the agreement stating sell the car _____ at $42,799.37! To the exact cents cos its full settlement from the bank

 

 

But one thing lta officer called me and say that I'm not the owner of the vehicle but the agreement is under my name so the chances of losing is very possible

 

But in the first place why would e dealer allow me to sign when I'm not the owner?

 

I believe if its written 36k agreement wit my name on it they will definitely take it for good right?

 

Now I'm very piss off is that why is there isn't any channel to protect buyer and seller or rather consumer against against these cb dealers?

 

Last thin is am I able to post the name of the car dealer? Will I get into trouble?

 

But it's at by bt timah shopping centre 5th floor.. Quite a big company with 30-40 vehicles

You're not the owner of the car and yet you are trying to sell it to a dealer? Care to explain that before further accusations against the car dealer?

think he mentioned above the dad is the registered owner of the car. guessing its because of insurance.

Ok.. my bad. But I wonder why he's the one who signed the sales agreement instead of his dad. If it goes to court, he can be charged for misappropriation instead. Maybe the dealer used that to play punk with him.

 

Anyway, I suspect the $42K++ is only the full settlement amount, and not the dealer buy price. I don't think dealers will quote a buy price down to the exact cents. It's usually a round figure. At least I haven't come across any.

I guess is LL... welcome to the loop hole of law ..some of them like to play wif words .. Must read carefully next time ..btw if u are not the owner they are not allow to let u sign anything or let u place the car wif them because anything u sign will not be approve unless u have a letter of approval n photocopy ic of the owner.. Go any nearby CC seek help from those volunteer lawyer .. Need to make booking wif them it's free but there is time limit .. Bring as many supporting document for them to see :) hope this help .. N ask about the summon too ...counter them !!

I think I know which company is this. I bought my first car from them. They sold me a decat car and I went back to fk them. The car I bought was generally ok except they didn't bother to rectify the problem when handing over. I have to do checks before taking over and point out all broken down items. Also, they promised delivery on Monday and on Monday morning told me that I can't collect. I also fk them and they work on it to deliver. Over all I find this company needs to be pushed to work. Else tough luck.

errrr....why would u expect the dealer to be responsible for ur own finances?

Im surprised that your friend handed over the car without getting cash. But having said that, i think the safest option now would be to go get the car back. Call a tow truck with experience in repossessing vehicles to get it back to you with the keys. Sell it yourself after that.

For those people who sell car to the dealer, you only give the PIN to the dealer (transfer you car) when

 

1) you received cashier order, if you car is fully paid,

or

2) let you finance company to deal with the used car dealer.

 

NEVER NEVER give the pin to the used car dealer and expect them to do everything. like Chinese say

 

one hand money, one hand goods

 

一手交钱,一手交货
