Need case study to understand who pays for what. :(

the law is that the drunk driver insurance company must pay for the medical costs - but sometimes they try to use their power to screw people over as in Adrian's case

But not the car damages only medical cost. My friend repaired her car from her own pocket.

If your friend was drinking, then of course must pay from own pocket. What is surprising about that?

Can claim

FACT: If you are hit by a drunk driver, you can claim for damages to your own vehicle under your own insurance policy. However, your no claim discount will be deducted unless you can prove that the other party is totally at fault for the accident. If it is a claim for injuries, the drunk driver

What if you're covered under third-party insurance only?

Same recourse?

What type of motor insurance coverage should I buy for my car?

Insurers offer three main types of motor insurance policies. Optional benefits are available to meet your individual needs.

There are 3 types of motor insurance

Comprehensive Cover

Covers repair or replacement of your vehicle if it is damaged or lost as a result of theft, accident, vandalism or weather-related damage. It also covers accidental loss or damage to your car, its spare parts and accessories and liability of claims from third parties for damage to property and people.

Third Party, Fire and Theft Cover

The bankruptcy law will come in and takeover his property....can sell one will sell to raise money, remainder the OA will work out a repayment scheme for him to pay back.

This is why Singapore is the best place to do business IN THE WORLD! Businesses are protected by the government in the expense of innocent parties. Insurance co can absolve liablility in an accident involving drunk drivers. While the logical scenario is for the insurance co to pay the victims and sue the drunk driver for compensation, the illogical thing happens whereby innocent parties have to fork out money to sue because their own insurance co can't do s--t if the other party can't pay.

For the avoidance of doubt, if the drunk has no assets other than his car, which most likely has a high loan, you will get nothing from a lawsuit if he declares himself a bankrupt. By the way, HDB flats are immune to bankrupcy orders because it is the government's way to ensure a bankrupt still have a roof over his head.

if sell all and still cannot pay off then how?

what if he wont work since 100% goes to repaying his debt so he has the why work thinking.

Yes but that's only on order from the OA if he is declared a bankrupt. Normally he will have to service his other debts first before he "service" you. Banks first most of the time. Then companies. Last will be you with the smallest slice of the pie if there is any left.

In a bankrupcy order, he will have to repay using a percentage of his salary. This will have to work around 7 years IIRC. After 7 years he will be a discharged bankrupt to start anew. Debts remaining normally written off.
