Help! Advice needed for accident claim

Hi all,

 

i was involved in a car accident in 2009 as a passenger. Our car was stationary at the red

traffic light. Lorry failed to stop in time behind us and hit us. The car (Axio) was quite badly damaged,

the back of the car caved in and glass shattered. Photos were taken and car was sent to the work shop.

 

I saw the doctor subsequently and filed for a police report. My colleague (the driver) saw our lawyer and filed for

traffic accident claim with the lorry driver's insurance company, China Taiping. We were also sent to hospitals to

do check ups to substantiate our injury claim.

 

China Taiping finally responded after 3 years in June 2012 and claims that the culprit did not

report the accident. My lawyer now advised me to go for another round of check ups

to update my injuries so that we can attached it to our claim and let China Taiping decide.

 

My question is, how much longer is this going to drag and what are my chances of getting full claim?

Hmmm ... police and ambulance wasn't summoned there and then?

 

Given your description, I would reckon the impact to be rather hard, and warrants immediate medical attention?

 

I know if it's moi, I would call for cops & medic on-the-spot, and take multiple photos from all angles - nobody can subsequently deny involvement (as per this case).

 

I hoped you had photographic evidence, yea?

If you were sent to hospital by ambulance at the accident scene, Then this is a police case due to injuries. So police should have a record on that accident.

As for how long, Should be 14 to 21 days. If no reply from the insurance, Your lawyer should File a writ of summon. Your lawyer Sent Your LOI (Letter Of Intention) & LOD (letter of demend) 3 Long years ago. They should have file writ of summon 2 or 3 mths after that if theres no reply. This is a straight forward case. Unless No license or drink driving, Then it might drag a year or so. But 3 years for a straight forward case, Thats too bloody long. I don't know what your lawyer is doing.

Ya what u say is very logical. With ambulance n police there, the driver sure dare not play punk.

 

Or is the Insurance company playing punk in this instance?

 

But I tot any accident with injuries need to call police or at least make a police report?

 

Then with the police report the police sud follow up with the lorry driver if he failed to make his police report?

This is a warning to all reading.

 

Dun think that u r 100% not in the wrong so wan to claim directly on the other party insurance. U dun know the ins n outs of the trade n may end up looking like a fool n get nothing in the end.

 

I will always leave it to my insurance company to do the claims. Ty know all the tricks of the trade n not easy to bluff them. If ty screw up (which I doubt) at least u wil still get yr money from yr own insurance company.

It looks like your lawyer is not familiar with making accident claims. He did not follow up on yr case till 3 years when the other ins coins co only responded. So if the other lns co did not respond at all, yr case wud hv been left hanging on the wall? :blink:[confused]

Let the insurance company handle. As long as you have photographic evidence and strong witness, the I sur wife company should be able to claim.

 

I.had a taxi backed into my front bumper years ago. It took almost 2 years for insurance co to come back and request for witness testimony / info. That's because the case finally heard in court. Insurance vs Insurance.

 

The funny part, the taxi claimed I hit his rear. Lucky got security guard witnessing everything.

You mean insurance company to file 3rd party claim ?

2 years...amazing that the witness still can remember the details...

 

I had a similar incident like yours...carpark...car infront reverse into mine...send to insurance for 3rd party claim...done liao...discharge voucher sign...everything all done...then my car was scrapped...cos 10 yrs...when I was driving my new car...the insurance company called to request to view the damages on the car...I was shock...more than 2 years then they come and ask...I fark them upside down on the phone...and they never call back again.

If you were sent to hospital by ambulance at the accident scene, Then this is a police case due to injuries. So police should have a record on that accident.

wow.. within 3 years u/ axio owner never chase? ifme, i call minimum once a week. not to chase them but remind them not to sleep on it...
