Accident Plus insurance claim...advise???

Hi Guys,

 

Please advise,

 

18 months ago, involve with an accident.

The other party admit fully his fault and will bear the 100% claim from his insurance( A )

He arrange my vehicle to tow back to his appointed workshop. So I never report to my own insurance becasue there is no claim on my insurance(B).

When I collected my car from the workshop, I had checked with the workshop owner how much is damage but he never reveal to me the price and told me not to worry as not my fault and will claim 100%. damage from the other party insurance A.After 2 week, the worshop owner called me and ask me to drive my vehicle to his workshop for taking of photo from insurance A investigator or so. Since then I thought the case already settled.

 

So after 12 months , I change my Insurance A to another company insurance C.

 

but today, after 18 month from the accident, I received a lawyer letter and told me this case had not being settle.(This lawyer is engage by the workshop to fight the Case with Insurance A)

Request me to go to lawyer office to take statement. He told me now Insurance A only willingly settle 70% of the claim and 30% will be bear by me.However till today, I still do not know the price that the workshop claim from the insurance A. I thought the case already closed since 18 months ago.

 

Now my question is.

1) if really the case now is 30% bear by me. Will insurance B liable for the 30% as I did not report to them 18 months ago when the accident happen?

2) And if insurance B do not want to bear the 30% and will the workshop chase me for the 30% cause till today i still do not know the actual reparing cost???

Good luck. If A is willing to settle 70%, u have to pay the remaining 30% on ur own. B will deny ur claims as it was not reported to them earlier.

 

In fact, u could initiate 3rd party claims against A via B. If there is any shortfall, B will take it as own damage.

According to what I know as below.

 

- 18 months ago, the workshop probably has reported to insurance B about the accident on your behalf.

 

- The workshop probably did a mark-up on the repair cost, so 70% compensation by insurance A should be enough to off-set that cost. Example. They maybe charged $10,000 for replace of bumper. Even if they get 70% compensation, that $7K would be more than enough.

 

- You don't have to pay for the repair cost. DON'T PAY THE WORKSHOP.

That's also the reason why the workshop refused to tell you the cost they claiming for.

You would faint if they say claim $10K for a bumper right.

 

Now, don't waste your time to go to the lawyer. Tell him to talk to the workshop since he is representing the workshop, and not you.

The workshop is going to make a pile out of your case.

 

That's the way i see it.

If the workshop really cannot claim from the insurance the balance 30%.

 

1) Should I have the right not to pay any single cents??Cause I never agree on the reparing price on the damage till now i do not even know how much workshop claim from insurance and never sign anything on the price agreed.

 

2) Will it be an offence not to go to the workshop engage lawyer for statement cos now is workshop fighting the case against the insurance A and not workshop against me.

 

I have check with insurance B after 2 months of accident and ask anyone claim against my claim. And the insurance B say so far , no claim made against me.

 

 

By the way,

I feel that this is a set up,

After the accident, the other party lorry driver told me not to worry, he will bear 100% and call a tow trunk.

After 10 mins, a Tow trunk came. And its was going to be 10Pm. when i reach the workshop. there seems like people waiting for buinese to come in.

Car repaired, ask for the price, workshop say no worry and everything will be taken care off, no need to worry about the repair cost.

Everything was like already being planned before hand.

After 18 months, lawyer told me 30% from my side..&@E*&@$*@^$@*(^$*@$^

Just my luck....a hard lesson learn......

Confirm you no need pay the workshop. So don't worry.

 

The lawyer is not the police. So they cannot force you to go help with investigation.

That's as far as I know.

 

The actual case might be much more complicated.

Maybe should check with your insurance company B.

I do not think the lorry driver will Fxxx care me now.

Cause he may say 100% his fault, he admit to his insurance but insuarnce only pay 70%, he also cannot do anything.

 

During the accident, the driver told me that its not better to report to my insurance cause both of us report to our own insurance. The case will take very long to settle. So he say he will admit 100% to his insurance and the claim will be more easier to settle.

 

Maybe i am to naive to trust him.

Hope that my lesson learnt can serve a warning to those bro out there.

If end of the day you have to pay for the damages, then the workshop you sent to is really a rogue shop.

If they alread state that it is not your fault, then dont pay i will not go to talk to workshop laywer

This is very strange, the issue is between the insurance coy and the workshop. If need to pay 30% it should be the driver at fault to pay whatever excess, not you.

 

Did you clarify with the both parties that you are not the driver who caused the accident? Skully these goondoos mix you up with that driver at fault. Cos things happen so long already there might be a mix up.

 

Since you did not inform your insurance coy, they cannot hire lawyer to represent you. You will have to look for your own lawyer if needed.

As the case is not closed, the final amount is unknown yet because besides the repair cost, legal fees involved also form a large part of the final amount to be settled.

The lawyer letter never even state any amount. Only say take statment, bring accident photo and location photo.

I ask the workshop, dun want to say the price.

Ask the lawyer, also dun want to say how much. Only always say its 70%-30% now...70%-30% blah blah blah

I also need to know the 30% is how much of the 30%.

But what I think is that, the driver insurance A feel that its the driver fault thats why agreed to pay 70% of damage.

Maybe the workshop jack up the price too high at the repair cost that the insurance feel is not justify to pay that.

 

If it is my fault, i do not believe the Insuance A will bear 70%.

 

I also dun know what to do now...
