One thing i see from here... waste of taxpayers $ and a waste of Court's time

Civil case. No taxpayer's money was wasted. No worry :D

I think this SMRT Feedback FB page is merely using Xiaxue to generate views and advertising dollars. Their expose on Xiaxue was hardly any expose, just saying Xiaxue is very good at creating controversies (who doesn't know) and non-stop name-calling and laughing at her plastic surgery and her son etc. But I think it achieves its objective by driving readers and likes to its FB page.

Read through "plastic noses" blog post...

A few things I note

1. Everything she says about SMRT applies equally to her - she has done exactly what she accuses her of doing

2. I notice that whenever I see TQ here now - XX isn't in the picture

3. One of the requirements is to "take down" offending material - not sure if they have done that, can't be bothered trolling back through their past posts...

if they dunno who to serve the notice to then how are they supposed to sue smrt?

This is under the new harassment act so it isn't a private suit. If SMRT doesn't obey then they can compel facebook to disclose the identity or IP since a crime was committed. With the IP, they can then go to the ISP and get the subscriber's details.

Of course, this is all determined by how much work our police is willing to do for her. This is also why posting on MCF is more "dangerous" than posting on overseas websites. SPH will be more inclined to share your IP with others but if you are posting on an overseas website, they might just ignore the police's request or court order.

Can they?

I don't know enough to even start reaching an opinion on that,

But can Facebook be forced to reveal the IP of the page?

Is this included within their terms of service?

Advertising on Pages
Third-party advertisements on Pages are prohibited, without our prior permission.

Here are Facebook's terms community standards - which I don't believe SMRT is breaching

  • Bullying and Harassment
Facebook does not tolerate bullying or harassment. We allow users to speak freely on matters and people of public interest, but take action on all reports of abusive behavior directed at private individuals. Repeatedly targeting other users with unwanted friend requests or messages is a form of harassment.
  • Hate Speech
Facebook does not permit hate speech, but distinguishes between serious and humorous speech. While we encourage you to challenge ideas, institutions, events, and practices, we do not permit individuals or groups to attack others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability or medical condition.

It has nothing to do with facebook's community standards as they are also bound by the law (Singapore's law in this case).

How do we respond to legal requests or prevent harm?

We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; or to prevent death or imminent bodily harm. For example, we may provide information to third-party partners about the reliability of your account to prevent fraud and abuse on and off of our Services. Information we receive about you, including financial transaction data related to purchases made with Facebook, may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm. We also may retain information from accounts disabled for violations of our terms for at least a year to prevent repeat abuse or other violations of our terms.

SMRT has exposed so many people and nothing has been done to them. What in the world can one XX do? [laugh] [laugh] Just because she applied for a court order?

SMRT didn't even harass her. They just wrote facts (whether true or not, only she knows) about her. Police won't be bothered with such trivial matters.

Well...

In reply to my own post - it certainly seems so...at least in the UK

A woman has won court backing to force Facebook to reveal the identities of cyberbullies who targeted her with a string of abusive messages on the website.

Well...

Now she's been granted the court order -

And as shown in the UK, Facebook will comply with court orders against "bullies" ....

So it is indeed time for popcorn now,

Wonder what will be the next word.

For the sake of intelligence, I really really hope XX loses

Her blog is not clever, but it is bullying and crude and follows the theory of Paris Hilton - its famous for being famous.

SMRT on the other hand is wickedly funny

Court order was supposedly already issued.

True or not, SMRT cannot keep posting without defending themselves against her claims and proving that what they said is true and should not be considered harassment. In order to do this, I think they have to expose their own identities which they might not want to do.

Anyway, she is a "public personality" so she should be open for all to criticize. IMO, this harassment act should not apply to public personalities.

Hahaha :))

So, they made all these noise to generate more awareness to their respective blogs, etc ?!

Maybe in the end, they will just shake hands and sit down lim kopi, while enjoying the huge crowds generated (whether online or physically at the Court) to see how they "fight" :D

Not just for the sake of intelligence, for the sake of the general public, someone need to get XX to STFU. People she terrorized should go get court orders too -_-

Interesting development. Can see who is behind the SMRT Feedback FB page after all. They are rather obsessed with Xiaxue and everything Xiaxue posts gets a lot of comments and likes. FB is not meant to be anonymous anyway, its meant to be using your real identity to keep a social network. So I'm not surprised at all. I guess if they want to attack Xiaxue anonymously, there are other means, e.g. using foreign hosted websites or forums but that is not gonna generate as much hits (and advertising dollars) to their page.

There are many avenues for SMRT to keep posting. Not just on Facebook but on other platforms and websites overseas.

Just to nitpick -

Profiles are not supposed to anonymous

PAGES are meant to represent an interest, brand, product etc etc - the people administering the page should be considered "anonymous" in the sense that the content is posted in the name of the page - not in the name of the person administering it.

I would be very scared if I had to put my name to the content I generate for a page. (not because there is anything wrong with it, but just because there is too much space for people to come and scold me for stuff they don't like)
