TS, your case (and also Jman's case), can argue on technicality.

I did once before, illegal park on double white line area and kena summon. On the summon slip, they wrote "Parking along double white line". I argue on technical basis that the white paint (of the line) has totally faded - i mean totally cannot see there's white lines there - even took photos to prove my case, so the summon is not applicable.

Got it waived, and a few days later, TC go and repaint the whole CP double white lines. [laugh]

I think TS case where the timestamp is wrong is quite different from yours. In TS's case, since they have the video, whether or not the time on the summon is wrong doesn't matter ma. TS was there in the video and parked illegally.

imo, u can siam the payment cos it's their wrong to put the wrong timestamp... argue ur way thru and u will not lose cos black and white states wrong timing... tis is how garment work and u shld follow their style... black and white is the most concrete proof...

If they want to, they can still prove the actual timing, based on other evidence, like length of shadows, last known time record, etc.

Trying to get a waiver based on technicalities could be difficult if they can prove an offence that is time-independent, eg parking along double yellow lines, speeding at 130kph etc.

Try to ask for waiver since it's wrong timing.. otherwise, insist they cancel this summon and issue another one with the correct timestamp..

Video and picture can be edited, or someone with the same colour and model of your car uses fake number plate etc..

Can't get waiver, give them more paperwork to do, make their life difficult. [sly] (Yes, i'm evil) [pirate]

Agree.

If that they can get the time wrong, they might get the date wrong.

Imagine 1 offence on different dates X 2 or more fines.

I did have a outstanding fine because, they got the VRN wrong.

Instead of SFH445L, they type FH445L.

Don't think that there is FH445L as the numerical system doesnt allows.

Furthermore, the fine amount surpassed the possible amount for a bike.

Hey TS, you not very honest and upfront leh. Misleading.

Merry go round and now saying you did drove to that location but banging on the wrong timestamp in hope to get summon wavied.

Trying to be funny with the authority. He wants to cheat by beating the system where it goes wrong. Done that means done that and wants to find excuses. Sad. [sweatdrop]

Neutral Newbie

Appeal to void the summon cause you were not in SG during the time of summon and neither was your car.

However, if it's an error in the imputting of timestamping then ask them to re-open a new summon so you can compound. Not that you do not want to pay, but just that you do not wish to pay for a wrong summon which can implicate more problems of anything else happened during the wrong timestamping. lol

Since i did not commit an offence in the said location, there is no legal justification for me to pay the fine.

If the location can be amended, i will pay.

If their timestamp is incorrect, that's their internal problem. During the time of the said offence, you are not in Singapore.

I agree, they always see technicality of law. if we are convicted, we must check the technicality. cannot be just your vehicle number and location only can confirm. need time also.

by the way if the location is amended, it is no pakay already. is like give evidence in court and then witness change testimony in court.. become unreliable evidence.

if location is incorrect, because the person key in wrong road name or wrong parking lot number, its very unfair to the victim, as all facts must be correct before an offence can be proven.

for my case, i did illegal park (of the car description and time) but they input the wrong address 2 block away....

can i argue all the way? i rather pay for it.

the evidence is based on the keyed in information. not picture?

even if picture, there is date and time stamp for sure.

so visual evidence and date/time to tie the car to the said time and offence.

location is keyed in wrong? is this crucial to the offence?

Yes:

like the example of the "double white line" cannot be seen, if the location parked does not have a double white line for example, how can the offence be made?

No:

The "Name" of the location is not crucial because they disregard the location name error, provided that there is other evidence (i.e. photo or GPS data) supporting the nature of the offence that proves visually the actual location or with reference to the "double white line" for instance.

For example: car parked between XYZ Road between lamp post 123 and 124. (XYZ road maybe the wrong road name)

that's the only foolproof way to get the offence proven I guess.

bro no one in my household drive wor... the man in video is prolly me la... coz my issue is with their timestamp being incorrect. ok thanks for all the advise... will guai guai go see video and pay up.

edit: could be photo too though.

Actually if ty indicate a wrong time or date on the summons, then the summons is in dispute.

Even if u r charged by police for any offence, if the date or time is wrong, technically that summons is invalid.

Eg: U speed on eway at 5pm but u get summons say u speed at 3pm. The summons is incorrect so invalid. U can dispute but ty might just issue another summons with the correct time but still its a discrepency cos the original report says time of offence is 3pm.

By right u sud not hv to pay. Ty made a mistake so the whole summons is inaccurate.

Well if the location is far off, technically u did not commit the offence stated in the summons.

Is this the start of TP/LTA sub-contracting out the issueing of summons to private contractors? I think its got off to a bad start.
