Corruption?

Ur co. MNC? My wife co. a US oil industry MNC also like that, cannot accept CNY hamper, moon cake, etc, they say its bribery. My side SME, anything also take.

Some MNC uses 'consultant' to secure deals or 'oil' the govt machinery (in foreign countries) to get approvals / awards etc. The so called consultant fee appears as such in the book. Totally 'transparent' and above board. Not sure such practices have been challenged in court though.

There is at least one type of situation I am trying to figure out whether corruption is committed:-

 

A is the manager in charge of say the outsourced security service for his boss. He went through a proper tender process, all transparent, and eventually appointed X company to provide the service for say 2 years.

 

During the 2 years, A manages the service provided by X in a fair manner not taking advantage of X for personal gains. In appreciation of A's fairness, X gives A a big expensive hamper and has it sent to his home.

 

Let's say A's boss has no specific rules regarding employees receiving gifts from suppliers/contractors, under CPIB rules, if A accepts the hamper, will he be found guilty?

 

well, it is a grey area since there is no rules. but to cover A's ass, he should consider declaring with the HR/Boss.

 

Sometimes, it is difficult to determine whether it is a bribery as the amount is small. It can be agrued that it is customary to give hamper during CNY.

 

Best way out of this is to ask the Supplier to give a treat (dinner/lunch) and also invite the boss. Eat and forget about it

Depends on your objective(s).

 

1) bad guy to cough out the money? If yes, better get your accountant to account for it properly in the books and declare it to IRAS in the next FY.

 

2) Report to CPIB for whatever motivation (teach the bugger a lesson / justice / company policy / warning to the rest).

 

 

If you have objective 1 and 2, i suggest you achieve objective 1 first then 2. probably easier.

 

Other considerations:

 

1) legal obligation to lodge report. you better get legal advice on this matter. From what i heard, there is no provision to compel the reporting of crime unless it is an attempt to the President

If the owner of the private company offers or recieves money to close a deal, since it is all his own money, can he be sued under CPIB law? After all, a person can use his own money whichever way he likes as long as nobody gets hurt physically?

let me ask you -

 

is it right for you to bring your potential customers to KTV, buy them drinks and girls during business negotiations? potentially if you don't bring them there, you will NOT get their business?

it depends.

 

if the hamper inside, got a big ang pao, placed between the items... A can keep quiet and take the hamper.

 

if the hamper is normal one, just the usual useless items, A should declare the hamper
