Drunk driver bang into a stationary GTR waiting at traffic.

This is a loophole in the system. It's as good as driving without an insurance rite?! What rights does the victim has in this case when he is clearly not at fault. The vios insurer should pay the damages and they can use legal means to recoup their damages from the drunk driver. If the DD has to declare bankrupt then that is the consequence of DD and tio accident right.

 

Say if DD bang into a public property then would the authority claim from their own account or go after the DD? [confused]

Been following this thread for a couple of weeks. Seems like the GTR driver is damn suay. Waiting at traffic light, kenna banged by a drunk driver in a carbon fibre bonnet Vios driving opposite direction. Worst thing is Vios insurance don't wanna pay, gotta claim from own insurance. Repair cost coming to 70k on parts alone, haven't include labour and all. I read the thread, pity the GTR driver. Seriously, this can happen to anyone.

gtr insurance sure fight till vios insurance pants drop.

 

big payout+future wont insure him.

 

gtr innocently waiting at traffic light and kena HEAD ON.

Insurance don't pay for drunk driving.

That's an escape clause.

 

Some taxi drivers will teach you to sober up the other guy, if you want to claim their insurance.

This is the ridiculous. It's the kind of idiotic rule that encourages perverse behavior.

 

Driver drunk -> don't report him to claim insurance -> next time he'll try same stunt

There are 2 other glaring things about Singapore in this accident beside the drunk driver & poor consumer law (among others) in Singapore.

 

1) A lot of people see & take pictures of the license plate (Buy 4D?), but only one taxi driver bother to help the poor GTR driver who was hurt. Typical Singapore. Very sad, indeed.

 

2) How come the bill is so high. Parts already cost 70k. Plus repair, easily over 100k! You can buy a brand new GTR (or at least used one) in some other countries with this money! Us drivers are being chop carrot by dealers, insurers, workshops alike!

Dun think the drunkard driver would be so stupid to paid him for the repair. All he can do its to prepeared to get fine, kenna license kan tong and declared bankrupt and be prepared to go jail for few years and the GTR owner LL have go and buy another new ride.

If the GTR owner is smart enuf to know the loop hole of auto insurance coverage, he would not get the police to be involved and tell the drunkard driver to admit his fault and claims from his insurance.

from the forum, doesnt seem like he has the $ to even pay 20% of the repair..... the parts alone seemed to be quoted around 60 to 70k...

based on personal experience, it is likely that the GTR driver got to claim on his own insurance and i am not surprised that his current insurance company might automatically stop insuring his ride after the claim.

the GTR driver will definitely have a HARD time to source for his next renewal of insurance; the total claim is way too much, it is like a Jap car total damage cost.

 

i reckon that there isn't any major loophole in the claiming part.

the T&Cs had already stated clearly that the insurance company has the rights not to give claim if the driver is drink driving.

 

even if the GTR driver wants to fork out $$$ and sue that chap till dry dry, the only thing is to see that chap suffers more; nothing else.

nonetheless, whether to sue that chap or not, it is really up to the GTR driver.

 

my opinion, just see how much that chap can fork out now (which I believe it will not be much), sell the GTR after the claim and repair, close the case and move on.

accident by drunk is not crime , so it means our garmen encourages us to drink drive , as long as not caught , remb this everyone in sinkapore

But if the GTR owner just take pictures of the accident and just claims against the Vios driver just like normal accident without stating the fact that the Vios driver is a drunkard at the time of accident, is still possible what.
