HS case is by district court, so if there is a precedent from a higher court, bobian have to follow unless case circumstances distinctly different. There is value in precedents mah, imagine the chaos if every judge is allowed to pass sentences based on his or her own distaste for the accused. Drive BMW get 1 year, drive Merc get fine only. Like that how can?

 

Also how much has societal values and the underage exploitation situation change in just 3/4 years? Probably very little. Anyway, change law is for parliament.

i don't disagree with the reasons you put forward but yet if the judge presence is merely to apply precedent cases, might as well set up a library of cases for public to access and no need to have a judge present to listen to the pleas and merits put forward for each case.

 

also like i say, the setter of the law may not be entirely correct in setting the law to cater to the merit of each case. when they set it, they assume that girls under 18 is gullible and therefore needs to be protected. there is a need to assess whether the girl is indeed gullible and this cannot possibly be catered for by the parliament when there are no such persons they could visualise in the process of setting the law.

a crime is a crime because of all the ingredients of the crime must be present.

 

in this case, calling a person who whose act of not checking nric a crime is judging the act retrospectively. on a prospective basis, so many people dealt with other people without checking NRIC yet it is not a crime.
