Wa like one one.. If next time, I don't go report to my insurer.. The other party cannot claim me ar? WTF... TS , please update your claim le.

if like tat, wat if even small accident have to call ambulance den TP so other party cannot cabut? will be a waste of resources but i guess if encounter someone like tat, might have to consider....

KNS... liddat must invest in a camera that can record on all 4 sides liow~! [furious]

wah lao, like that pay so much for insurance for what man.....

 

being blacklisted is the only punishment?

 

when i complained auntie lucy for the long processing delay on my 3rd party claim, the supervisor told me they cannot proceed without the other party's report.

 

the only avenues i had were

1. to sue via my own lawyer,

2. own claim

3. pray to almighty the other party conscious wake up and file the report

 

and yes, i also asked about the penalties for not reporting, she said the non-reporting party will likely get blacklisted from insuring again.

This is what I learnt also. If you see the other person trying to pull these kind of stunts have to call in TP. Useful against malaysia cars also. If you ever get into an accident with a Malaysian car, just say u are in pain and need ambulance. Once ambulance and TP comes, you just say need to take ambulance to hospital.

 

In this kind of case, the TP will tow all the accident vehicles and impound until all the reports and insurance claim settled. The Malaysian guy sure faster settle private or get his insurance settled.

Even before when it is compulsory to report, the loop hole is here.

 

- Case 1: Claimed before because other driver reported, I illegally parked and she scratched my car accidentally as I was "blocking" her way. She said I shouldnt anyhow park so not her fault and I replied, people any cross the road and do you go knock them down?

 

- Case 2: Wasnt successful because other driver didnt report, bumper to bumper at old woodlands checkpt, was hitted from behind.

the bike hit me, the rider got sent to hospital.

TP were engaged also.

 

after my report was done, i was free to go. the bike was towed cos the rider was in the ambulance.

so if i were the one coming out stunt, my car should also be towed based on your description above,

but it didn't happen to me.

Maybe its different for Malaysian vehicles. The TP can impound the vehicle until they finish the investigation. Learnt about this from my dad who got involved in an accident with a Malaysian car. The TP told him they can impound the vehicle until all the insurance reports and TP investigation is settled.

just last month..there were letters upon letters in Strait Time newspaper about this issue that many people complain about this 3rd party claim procedure.

One guy wrote in that his car till now still not able to get repair because of the other party refuse to report.

If the other party did not make any report, the insurance will void the car insurance and a TP report will be make and it consider "criminal" offense as it clearly stated that all accident have to report even if you agree to private settle.

WE REFER to the letters on the non-reporting of motor accidents to insurers ("Governing body needed for motor insurance claims" by Mr Clement Foo Dun Jie, last Friday; "Motor insurance system needs fixing" by Mr Su Guaning, last Saturday; and "Raise penalties for not reporting accidents" by Mr Su Kim Teck, Wednesday).

Under the General Insurance Association's Motor Claims Framework, motorists are required to file an accident report with their insurer even if there is a private settlement between the parties. This is to protect the insured against the other party later having a change of heart and then filing a claim.

There are serious consequences if drivers fail to file an accident report, because it constitutes a breach of the insurance policy condition. This means the insurer is entitled to repudiate liability, and the insured no longer gets protection under the policy.

Worse still, policyholders who ignore their insurer's request to file an accident report are violating the Road Traffic Act, and may face serious consequences like non-renewal of their motor insurance policies.

Since May 1, 2011, under the Non-injury Motor Accident pre-repair inspection protocol directed by the Subordinate Courts, motorists making property damage claims to their vehicles must give the "other motorist" or the insurer an opportunity to inspect the damage to the vehicle prior to the commencement of repairs. This is aimed at mitigating inflated and fraudulent claims.

The "other motorist's" insurer will have two working days to conduct a pre-repair inspection of the damaged vehicle. After the two working days have lapsed, the workshop is entitled to proceed with the proposed repairs.

the insurance company won't renew/cover for that person... or even get blacklisted.

 

but...got loophole... it doesn't ban that person from driving another car insured by another person, ya?

unless the there are really stated penalties from TP for non-reporting.. i have googled around but found nothing other than getting 'prejudiced' when one tries to renew insurance [sweatdrop]

 

if i'm rich enough... i just sell and buy another car, get it insured under my relative name and bingo. i can drive again, right?

No need buy a new car also can. Just transfer the car to the relative and get the insurance under relative's name lo. But based on the sentence does it mean this insurer don't renew the person can just go and get from another insurer?

already there are a lot a thingy that was made a mockery...e.g erp..if population of vehicles maintain as it is...congestion will continue and population keep increasing due to migrants...mrt will be crowded...cost of HDB will also increase if New citizen keep increasing....many many more

it is not a loophole. it's simply just wrong, but people do it anyway, esp P-platers using parents name to escape the exorbitant P-plate insurance premiums.. just dun get caught loh...

 

there is a very recent case quite well documented, too lazy to search. Think insurer is DA. basically, car and insurance is mum name, but car is almost always driven by son. one day son accident, and he stupidly told DA that this is the arrangement or something to the extent (mum name but i driving all the time). DA immediately terminate his insurance and did not cover for said accident.

 

something like because the application was fraudulent. main driver was falsely declared. The kind of cover, pricing etc was assessed according to the mum's details and driving history. I support DA in this case. Other insurers weighed in and say more or less the same thing.

The white car came only when the lights turn green (thus it didn't stop at all). All this while, there are only 2 cars (me and the car next to my right) at the junction.

 

I had barely stepped onto the accelerator and there is no time for me to react at all.

 

let me play the devil's advocate. you did not "barely moved", your car moved off for close 4 seconds before the contact. Also, it was not clear the other car was moving continously. It could be stationary but slightly behind you while waiting for the lights to turn green. The video does not show lane markings and veering or turning angle is far from clear.

 

So.... if the other driver sees this video, she could report and simply say, I moved off and followed lane markings, the car on my right turned into my lane. who can say she is wrong, certainly not the video imho. .... why dun take the video down?

I also kanna accident with a bike two saturdays ago. Was rainy day, I signalled long time and turning left and bike probably could not stop in time and skidded into my rear bumper. First thing I asked him is whether he ok or not, then after awhile he said 50-50...I almost wanted to shout at him. It was a straight and left turn lane. If he had wanted to go straight, he should not be attempting to do it on my left and the the light was amber. Where was his brain?

 

Anyway now I left everything to the ws. I withheld a video which a fellow driver passed to me in case I need it. Will present it if the other party bulls**t to the insurance.

 

First thing to do is make sure got report. Get a good ws who will try to settle everything for you.

Something is wrong with the way people obtain their bike license - (1) they travel almost all the time in your blindspot and you have to "hunt" for them, (2) they maintain high speed or speed up when you signal and changing lanes, (3) dun signal, and (4) lane straddling.

 

Either they are suicidal or they think they are superman protecting their bikes.

 

Lastly I would like to qualify that there are good motorcyclists too.

Well, I do encounter cars that constantly hides in your blindspot despite the fact that your turn signal was on all the time too.

 

So it is not just bikers but I believe it is everyone on the road. Who knows bus drivers may find us a nuisance that hide at their super long blindspot too?

but at the ending part it was pretty clear that she was not in the left most lane pocket. She did cut into part of the pocket for the centre lane..

 

Anyway, I do understand why insurance company require both parties to lodge a report to their agent when an accident happens.

This is to prevent fraudulent cases where some funny clowns just call in and try to claim your insurance for their own damage.

May sounds impossible to happen? but judging from the different types of clown on the road, I won't rule out the possibility of that.

 

People dare to drink/drive, use fake number plate. I wont be surprise if people buang and try to file a claim under a innocent victim if there was no such measure in place.

 

Then again, if there has been video prove provided to the lady's insurer, they should actually take investigation into their hands.

Under insurance proposal form, there would be a question whether the insured had been denied insurance previously?

 

In addition, t & c may render the policy void if involve in accident.

i'm also very interested in this scenario and the course of action that is available to us. below is the most relevant info i can find from GIA. but it pertains to disputing with a driver's own insurer, not the other party's insurer. nevertheless, i have just written to GIA to ask them about this loophole. will keep you guys posted if i receive any response from GIA.

 

i just got the reply from GIA as below. in summary, when the third party insurer found out that the culprit did not report the accident, the insurer may void the culprit's policy hence repudiating all claims relating to the accident. you will then be left with the only option of pursuing the damages directly with the culprit via a civil case by hiring your own lawyer.

 

seems like it will only be a worthwhile venture if the damages concerned is significant. if it is a relatively small accident, i guess you can "win the case" by at least following-up with the culprit's insurer to void the policy so that the culprit will have a big headache of finding coverage to continue driving. since you have video evidence, the culprit's insurer will not be able to deny that the accident did not occur simply due to the lack of a report.
