There is no proof that the jaywalker was the SOLE cause of his death. Imagine a different scenario. Three cars travelling on e'way. First car gets puncture and emergency stop. Second car following at correct distance and stop in time. Car three was following too close and bang car two. Is it car one fault? While there would not have been a need to stop if not for the jaywalker, it is still the reponsibility of each and every roaduser to drive in such a way that they can stop if need be. And unless / until it can be proven that the evasive action of the lorry (rather than simply stopping) caused him to hit the motorbike then we cannot only blame the jaywalker. Remember - having the "right of way" is not some sort of startrek deflector shield that keeps you safe from harm. As in ANY accident there is always more than one factor that contributes. e-brake alone is not enough, but e-brake plus following to close (maybe - we don't acutally know) causes problems.
