You can have your opinion.. i respect that..  

 

personally.. i just read a transcript of what he did.. compared to what others did..  and find his sentence to be insufficient. 

 

The 2 girls .. in a matter of fact way.. i can consider him to be a ''technical pedophile'' but the 6yr old is a separate story.. 

 

And.. for the guys who like me.. are advocating a tougher sentence. I would say again.. as per precedents, the sex with 15yr was fair. If you keep bringing that up .. we sound like some passionate bang table AM haters. and that defeats the purpose

 

I think the context is also different...the earlier cases you brought up...maybe the couples were already lovers  :wub:  and committed the act in a moment of folly....

 

this AMDK one..clearly..is calculated to trap the victim...

Oh, didn't realise that the petition is for harsher sentence. Seems like Singaporeans really hate FTs alot. Really don't make sense, I thought the petition was for lighter sentence... 

 

Chapter 338 provides the rest of the sentence I think.

 

(1) Any person who imports, publishes, sells, offers for sale, supplies, offers to supply, exhibits, distributes or reproduces any prohibited publication or any extract therefrom shall be guilty of an offence and shall be liable on conviction for a first offence to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 3 years or to both, and for a subsequent offence to imprisonment for a term not exceeding 4 years.

(2)  Any person who without reasonable excuse has in his possession any prohibited publication or any extract therefrom shall be guilty of an offence and shall be liable on conviction for a first offence to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 12 months or to both, and for a subsequent offence to imprisonment for a term not exceeding 2 years.

Yup. His jail term seems quite harsh compared to other guys who got sentenced for having underage sex. Dunno why the double standard. Just because he is FT he gets heavier sentence?

For the 6 yr old kid incident, it's sick but then he didn't touch the girl. Sentencing for molest is based on, where you touch, how long you touch, how shiok it made you after you touch.

i prefer to search for precedent cases to decide for myself whether the punishment was imho proportionate

i dont want to be caught up in my disdain for AMs and start bashing for the sake of it.

 

Now take a step back and ask yourself..  the 31yr old guy who had sex with an under 14(at time of offence) 

punishable for up to 20yrs and/or fine and/or caning..  only got 12months

 

vs the AM.. who got 4 out of a max of 10... 

 

I let you make your own judgement.

I am curious. In history there are incidents of wrong judgement.

 

What happens if a "criminal" was found guilty of a crime and was sentence to 10years imprison and 10 strokes of cane. Years later, DNA evidence found him NOT guilty.

 

Obviously, he will be released from prison. How to take back? How to erase all public record that he is not a criminal?

 

How about the 10 strokes of caning he already had? If memory serve me well, there is no such case (known in the public at least). Then how? How to make up to for the caning he already had suffer?

 

Anybody any clue?

 

Possibility: The judge who made the wrong judgement, get a free pass to prison,  get tied up with his butt exposed, then he get caned by the "criminal" who was wrongly caned. This would forever ensure that judge don't make frivolous judgement.

Counter point. What if all the evidence indeed points to you being guilty? Can you blame the judge when he is only able to review the evidence put before him?

 

I believe the judges only make a determination of guilt beyond reasonable doubt. If you want them to be 100% sure, wrong I chop then maybe there will be no judges left.
