Side track.

I am curious. In history there are incidents of wrong judgement.

What happens if a "criminal" was found guilty of a crime and was sentence to 10years imprison and 10 strokes of cane. Years later, DNA evidence found him NOT guilty.

Obviously, he will be released from prison. How to take back? How to erase all public record that he is not a criminal?

How about the 10 strokes of caning he already had? If memory serve me well, there is no such case (known in the public at least). Then how? How to make up to for the caning he already had suffer?

Anybody any clue?

Possibility: The judge who made the wrong judgement, get a free pass to prison,  get tied up with his butt exposed, then he get caned by the "criminal" who was wrongly caned. This would forever ensure that judge don't make frivolous judgement.

in the US you can sue the govt gao gao and get multimillion award.

in SG, we call this honest mistake, let's move on.

actually you can sue the govt but have to prove malicious prosecution. very hard to prove.

Your reply sounded very logical.

Then should we not have capital punishment.

I am not against capital punishment.

But it has to be held to a higher standard and not just beyond reasonable doubt.

But it has to be held to a higher standard and not just beyond reasonable doubt.

DPP v Sunny Ang. He bought her insurance policies, took her diving, flippers were cut, body never found, no witnesses, only circumstantial evidence. Beyond all doubt? No. Beyond reasonable doubt, court decided so.

If test is more than reasonable doubt, such cases will never end in conviction.

Mind you it's a good question and I think up to today jurists and law students still debating.

I didn't say cannot convict. I said no capital punishment.

I'm saying I support capital punishment but the test for it has to be higher than "beyond reasonable doubt".

So what is higher than beyond reasonable doubt? Beyond all doubts, both reasonable and unreasonable? Or sibeh beyond reasonable doubt?
