He go straight, you right turn, you salah. Unless he got stopline and you don't have, or there is traffic light in your favour. From your drawing looks like uncontrolled junction, so yeah you salah.

Although small road must give way to big road.. but I guess if accident is on the front bumper than TS is wrong.. if it is mid of car, around car doors then should be quite clear bmw is wrong...

 

I think is quite logical...

 

The only problem is TS did not make report within 24hrs, which may put him at disadvantage

if not direct at bumper, usually it is 50-50

 

but again, BMW is on the main road, side road show give way. Custom road usually not high speed so it may be TS oversight.

Base solely on the first picture showing TS's drawing, it appears TS is in the wrong as he failed to watch out for car on the left before making his right turn. Even if TS has a camera in the front, it would not have captured anything useful to fight his claim.

 

Secondly, TS didn't report to insurance. This could be a good or bad thing. Bad for TS as TS has to pay out of his own pocket as his insurance company is not obliged to. Good for TS if he decides to ignore, then the BMW driver has to sue TS to get any compensation.

 

Just guessing why the BMW didn't get out of car. Could it be he or she felt intimidated due to whatever reasons. People do panic when they get involved in accidents.

Provide TS already cover up those scratches AND that bmw did not have a cam.

It is customs lane immediately after stamping of passport.. if I not wrong.

 

There got blind spot, car must slowly come out then can see got car approaching anot...

 

Question did TS check?

I remember there usually has small humps along the main route when coming out of the customs booth. If after your lane there's a hump and he did not show signs of slowing down and bump into you, you might have a case, as video cant show that whether you have checked your left blind spot before proceeding out of your lane.

 

Do not post the video first, wait till investigation is almost done, as the bugger might use it against you. Except that you are sure that it capture the bugger is in the wrong.

 

Might be a 50:50 case but good to fight than to do nothing at all. Let us know the outcome. :mellow:

actually based on the video, the head of my car is already outside and then he came in.. but again, i may be in wrong...

 

so don't upload the video? i just show to the workshop tomorrow?

long story cut short, happen last saturday.

 

 

 

happen at custom, making a right turn when my car was hit by a BMW.

 

 

 

 

 

i got down from car, wanted to talk to the driver but he don't want, tell me to go away.

so i took a picture and left as i can't stop there.

 

later today, i received a call from my insurance that this joker wanna claim me.

and i had to go down to insurance's workshop to access the damage and file.

 

i don't have any intention to claim him as i felt it was superficial and now, he's trying to claim me.

this is exorbitant, damn pissed..

 

i will upload the video shortly.. what should i do?

strictly by traffic rule, side road should give way to main road so it's your fault. assuming there's no recorded video, insurers may not see this as a clear-cut case, so they may say you pay 70% of the damage and the bmw owner pay 30%. but if got video to show you really chiong out at the last second then cannot argue liao you will kenna 100% payment. you will also suffer double whammy as you will still need to pay for your own damage, assuming you're not claiming against the bmw.

Usually is the workshop that will use this opportunity to "chop" the insurance gao gao. Bumper scratch? Nvm, change new one. Door kenna scratch? Nvm, change new one. They always like that. Minimal work, maximal profits. Huat ah!!!

no choice, hopefully with the video. i can show it to the workshop and tell them.

 

I'm already out when he came in and if like that also want to claim, then no choice..

At custom area, its a unique situation where slow speed has to be observed. Either the bmw chiong too fast or was not paying attention.

 

Just give your side of the story and I believe its a no case. Each will repair on their own.

 

My friend experienced this situation before and that was the outcome.

Kurty, in our car insurance industry practices, if you are being claim once by others ? NCD shall gone and the next insurance premium will be exaggerate.

Don't be nice fellow in this kind of car accident, do your very best to claim against that BMW driver for not keeping safe distance in Woodlands Immigration Narrow Lane.

If in doubt, speak to your workshop or any motor claim lawyer to take-up defensive actions as quick as possible.

ask him to come down, don't want..
