I already submitted 3rd party claim to her insurer. Hoiwever, the motor insurance regulation here doesn't allow me to claim if the owner didn't even submit an accident report! I was surprised to learn of such a stupid rule.

 

 

Spore is full of stupid rules n regulations. This is just one of them.

 

Now those who r in the wrong in an accident just dun inform their Insurance Co. n ty prob get away scott free. What kind of regulation is this?

 

The guilty party sud b fined heavily to discourage dishonest pple from taking advantage of this loop-hole.

I think the thinking behind the rule is that the other party wasn't there so no accident report to submit.

 

You can think about claiming from her directly, instead of her insurance.

 

 

 

We buy insurance cos we dun want the hassle of claiming direct from the other party. Legal issues can drag the claim for years n cost quite a lot in legal fees too.

 

Like that buy insurance for what?

Can submit to your insurance to claim from her, her insurance will inform her that someone is claiming against her and she die die got to go down and make a report.

 

get a specialized workshop to do it....

 

 

What if she isnist she was not involved in the accident n its a case of mistaken identity?

 

Insurance Co wil b only too happy to wash hands cos then ty dun need to pay out any claims.

 

Its all a big racket n con-job. Again its the poor innocent consumer who suffers in Spore in the end.

i just got the reply from GIA as below. in summary, when the third party insurer found out that the culprit did not report the accident, the insurer may void the culprit's policy hence repudiating all claims relating to the accident. you will then be left with the only option of pursuing the damages directly with the culprit via a civil case by hiring your own lawyer.

 

seems like it will only be a worthwhile venture if the damages concerned is significant. if it is a relatively small accident, i guess you can "win the case" by at least following-up with the culprit's insurer to void the policy so that the culprit will have a big headache of finding coverage to continue driving. since you have video evidence, the culprit's insurer will not be able to deny that the accident did not occur simply due to the lack of a report.

TS.. If the other party die die don't report and your insurance in the end still refuses to help u, the other way is to engage a lawyer to sue.

 

It's pretty straight forward since u have the video evidence.

See how much the lawyer quote then u compare vs your damage and u decide if u wanna proceed with this.

I also kanna accident with a bike two saturdays ago. Was rainy day, I signalled long time and turning left and bike probably could not stop in time and skidded into my rear bumper. First thing I asked him is whether he ok or not, then after awhile he said 50-50...I almost wanted to shout at him. It was a straight and left turn lane. If he had wanted to go straight, he should not be attempting to do it on my left and the the light was amber. Where was his brain?

 

Anyway now I left everything to the ws. I withheld a video which a fellow driver passed to me in case I need it. Will present it if the other party bulls**t to the insurance.

 

First thing to do is make sure got report. Get a good ws who will try to settle everything for you.

Something is wrong with the way people obtain their bike license - (1) they travel almost all the time in your blindspot and you have to "hunt" for them, (2) they maintain high speed or speed up when you signal and changing lanes, (3) dun signal, and (4) lane straddling.

 

Either they are suicidal or they think they are superman protecting their bikes.

 

Lastly I would like to qualify that there are good motorcyclists too.

 

yes, i dun know whats inside the brains of these bikers.

 

combine this with a kuku driver and u will get a fatal accident [lipsrsealed]

but at the ending part it was pretty clear that she was not in the left most lane pocket. She did cut into part of the pocket for the centre lane..

 

Anyway, I do understand why insurance company require both parties to lodge a report to their agent when an accident happens.

This is to prevent fraudulent cases where some funny clowns just call in and try to claim your insurance for their own damage.

May sounds impossible to happen? but judging from the different types of clown on the road, I won't rule out the possibility of that.

 

People dare to drink/drive, use fake number plate. I wont be surprise if people buang and try to file a claim under a innocent victim if there was no such measure in place.

 

Then again, if there has been video prove provided to the lady's insurer, they should actually take investigation into their hands.

 

As it looks, since the Ins Co knows the rules n law is on their side, ty happily wash hands n still got the cheek to collect your premiums every year. [speechless][furious]

 

Ty happily declare "You are on your own buddy/sucker". [grin]

Juz slap her with a letter of demand + legal cost. She will have to make insurance report.

Chill. Actually there is sense in the rule, imagine if otherwise you were not at the place and someone just report your car number and you have to spend much precious time and resources just having to prove you were not there. If the rule was not there, all someone has to do to make your life a living hell having to spend all your waking hours dealing with this, is to report your car number and you have to defend yourself for nothing. That would be crazy rite?

So the lesson learn here is to act gangster and don't report the accident if you ever get into one. Insist its both parties fault so that other parties will think twice if self engage a lawyer to sue you because both side may need to pay for lawyer fee (Not sure win).

On a side note, i have been paying 1st party for 8 yrs. Now that I have no loan, should I renew my coming 9th year under 3rd part fire theft ? Are there any implications that I should be aware of?


So the lesson learn here is to act gangster and don't report the accident if you ever get into one. Insist its both parties fault so that other parties will think twice if self engage a lawyer to sue you because both side may need to pay for lawyer fee (Not sure win).

but in this case, ur name may get blacklisted & the inconvenience will be that u may need to look for family members to piggyback insurance.

If it happens too often, may just run out of names.

Insurer will not void your insurance immediately when ppl claim against you because they will always go the easy way out. That is to wait for you to file before they even allow any claims against you which is mention by many ppl in this thread. If they are so on the ball, then we won't even have this thread in the first place.

To sue a person is not so easy. To win your case is more difficult.

 

To collect your morey can b almost impossible.

 

Many pple end up spending more money to sue n never get back a single cent even.

Thats why I said, also make it compulsory to make a police report when u r involved in an accident.

 

So if the other party dun make any report, the police wil take action.

 

Last time any accident must b reported to the police. Hardly hear of pple make false reports cos pple scared of being charged by the police for making a false report.

 

Now its so common for pple to make a false report to the insurance co. or no report at all cos ty know there is not much that can happen to them.

 

Long ago I was hit by an aggressive Ang Mo driver n he dun stop n just drive off. I made a police report of Hit n Run. The police called him up n he was scared shit and offfered to pay for my car damage. Luckily the damage was very slight n I let it go.

 

But the effect of the police calling u up to investigate an accident is more scary than receiving a silly letter from the ins co asking u if u were involved in an accident.

Exactly.

 

As it is now with the current system, that is what many pple find the best way to address the issue if they r in the wrong.

 

Probably ty get away scott-free in many instances cos its just too troublesome n costly for the innocent party to pursure the case further.

Firstly once u go to 2nd or 3rd party, u cannot go back to 1st party.

 

Also the premiums for 1st party is usually only slightly more than 2nd n 3rd party.

 

I now try to stick with 1st party as long as possible until the Ins Co says I have to switch to 2nd/3rd party.

 

Even 2nd/3rd party u pay premium but get back only scrap value plus a bit for TOTAL LOSS. U can actually claim that yourself back from LTA when the car is scrapped. Any other damage to yr car u cannot claim a single cent.

 

So if u buy 2nd/3rd party u r mainly paying for the cover to others vehicle damage.

but in this case, ur name may get blacklisted & the inconvenience will be that u may need to look for family members to piggyback insurance.

Refer to section 84 of Road Traffic Act. It clearly states that both party has a duty to exchange name & address.

 

It usually boils down to how good a ws is.

 

I met an accident 2 yrs back. 3rd party nvr report to insurer. WS pursue 3rd party insurer for 3 wks. 3rd party insurer came down to assess my damange & it was fixed up in 3 days.
