But if the errant couple refuse to move, Mr See could find himself saddled with another long court process to privately prosecute them for breaching the court order.

i think its a big insult to our system if the errant couple refuse to move with this order in place, and police cannot thow them in prison and the victim have to suffer longer.

we shall see.

Sadly there is no law here to enforce on neighbours who are a nuisance to others. If they have law that if the neighbour continue to create noise, they would get fine or house get confiscate by HDB, maybe these people will scare and stop all the nuisance.

system is working as it should.

this kind of problems don't affect rich people since their neighbors are all far far away so why need to have a system that properly handles such problems?

except for the siaolang ferrari lady case of course.

actually there are law on fixing ' being a nuisance to others' if not the court order wont be out.

its only whether our police is able to implement the law.or its a white elephant only

there is a law but the law has no teeth for enforcement and that's the problem being highlighted in this case.

After two years and multiple trips to court, a man has succeeded in barring his noisy neighbours from returning home for a month.

For the first time, the Community Dispute Resolution Tribunal (CDRT) has issued an Exclusion Order and directed a couple to leave their residence, after they were found to have breached an earlier court order to stop creating a din and preventing Mr Daniel See, 29, from enjoying his home.

But i still think difficult to enforce. Lets see if every flat start to kei siao than will be bad.

Two years seems a long time to come to a conclusion. I wonder if its a matter of ...

I can do what ever i want and theres nothing you can do about it.

Or

You compliant , clever, go lor, i got human rights.

After two years and two court orders, a man in Bukit Panjang says he is still being plagued by noise from his neighbours living in the unit below — and it shows no signs of stopping.

Daniel See, 29, who left his job in June in order to spend more time collecting evidence against his neighbours, has now applied for an Exclusion Order to evict his neighbours from their flat, according to a Straits Times report.

But his neighbours, identified only as the Lius, denied See's allegations in an interview with Shin Min Daily News and said that that they will file an appeal if they are ordered to evict.

If proven is a nuisance,  then should punish them properly. Mental problem send to mental doctor. Why waste court time and tax payer money?

Should just confiscate their flat and throw them out. But that would give rise to the fact that hdb is a lease and not own as one would expect,

Confiscate their flat then people would scare. Cause now no law can do anything to them, so these people can continue creating noise since nothing will happen to them at all.

The Law...

https://www.straitstimes.com/singapore/courts-crime/noisy-neighbours-case-couple-who-flout-court-order-risk-jail-minlaw

Quote

A noisy couple who did not comply with an Exclusion Order to move out of their home risk facing "serious consequences" including jail of up to three months, said the Ministry of Law (MinLaw).

They could also be prosecuted by the state, said a State Courts spokesman.

The Community Disputes Resolution Tribunal (CDRT) has barred Madam Iwa and Mr Low Bok Siong from their home for a month, with effect from Monday. This was the first-ever Exclusion Order issued by the tribunal.

The couple were found guilty of breaching an earlier court order to stop creating a din and preventing their upstairs neighbour, Mr Daniel See, 29, from enjoying his home.

Mr See lives in a three-room Housing Board flat a floor above the couple. Their dispute started in 2017.

Mr Low's son had told The Straits Times on Monday that the family did not intend to comply with the order because it was "full of typo (errors)" and served to him by the complainant, Mr See, and not the court.

In response, the State Courts spokesman said "the effective date of the exclusion was erroneously stated to be 6 January 2019 when it should have been 6 January 2020. An amended Exclusion Order was issued to the complainant on 6 January 2020 to correct this error".

Yesterday, Mr See pasted this order on the couple's front door.

Addressing the suggestion by Mr Low's son that an order served by a complainant need not be complied with, the spokesman said: "This is not true. In civil proceedings, service of documents, including court orders, on a respondent/defendant will be carried out by the complainant/plaintiff."
