any private settlements between u and other party, always have it on paper and both parties sign it off.

 

u paid $$ to the rider upfront, and supposed not to pursue the matter, then write it on paper and sign off.

 

protect yourself. even if got no paper, send sms to the the other party and ask the party to reply bk with his agreement. SMS is considered usable in court.

 

no paper, no record, the other party can anytime come bk to u and claim for more.........

 

and take pics of his IC or driver license and his face.

I just changed into another car recently :(

and i've been driving very safely, really don't wana drive with 0 points, really kinda scary, gotta drive 60km/h everywhere !

Look out for everything and really dangerous with 0 points :( I also need the 24 points for insurance !!

My current car owner put mother, me as named driver, premium per year is 7k+ ! Need the 24 points ! Argh.

Firstly, i will need all the kind MCF forumer's help, hope you guys could really help me.

Behold a lengthy post.

 

Few months ago, around march, while driving during peak hour traffic with some drizzle, i got into an accident with a motorcycle.

 

I was on lane 1, the car in front of me jammed brake and i had to jammed brake too. As lane 1 was extremely congested and i was stucked in non-moving traffic, i decided to filter into lane 2. I checked my blind spot and tried to filter into lane 2, this moment i committed a catastrophic mistake here by not signalling, a speeding motorcyclist travelling in between lane 1 and 2 jammed braked and skidded right beside me before i actually even filtered into lane 2.

He fell down and i stopped my car and helped him and everything. His bike was okay but his arm was scratched. We exchanged particulars and he said i just had to pay for his medical bills which would not be too expensive(<$100), I agreed because i was partly at fault, even though i never did knocked into him.

 

Fast forward, he tried to extort from me saying he has pain here and there, the paint on his bike need to be resprayed and also need to redo some balancing on his bike, in total he wants 500 bucks. As i'm just a poor NSF driving a cheap tiong chia, i decided to consult my mother as the car is under her name and she has more driving experiences than me, and that the amount of 500 dollars is not a small sum. My mother told me that i do not have to bother because the most important thing is i never knocked into him. Therefore i told him that i'm willing to pay him like 100 dollars, anything more, he has to claim insurance. He told me it's okay and he's going to make me pay more, i didn't bother and thought much about it.

 

Insurance and his lawyer letter came, told me to file an accident report at both my insurance and at the police. I did so.

 

Fast forward again, his claim at the insurance was successful because he probably got some of his abangs in TP/working as lawyers or whatever because even my insurance co did say that it actually isn't really my fault and i don't have to pay, just didn't know why his claim went through. There goes my mother's NCD for second car. I sold the car not long ago too and i was unable to claim back my premium that I've paid like 3 months ago(meaning i paid a year's premium but used only 3 months) because the insurance said i'd been claimed before. That car's insurance was around 4k, the lost is around 3k but my mother just tell me to take it as a lesson learnt.

 

Fast forward till today, I just gotten a summon from TP dept claiming i didn't drove with due care or in an orderly manner and i have to pay a $200 fine and get 6 demerit points.

 

The fine of 200 dollars seem to be like just a small amount compared to the 50% NCD lost and the 3k lost in premium, but i'm really pissed for being faulted and getting demerit points. Is there a channel for me out there to get this summon of 6 demerit points voided? The reason so is because i need my 24 points back and i'm currently only left with 6 points. Can i write in some where or go to the traffic police department and look for someone to talk to.. or yea, really need help here.

Lane splitting is neither legal or not legal.

 

It is grey, up till now even in SBF there are no discoveries on a law pertaining to that.

 

If u look at the real road conditions, alot of car drivers like to press bikers hard when the bikers ride in the middle of the lane, or they like to try squeeze between the bike and another car on the right/left side to try overtake.

 

Its just a lose-lose situation for bikers in general.

 

That said, i used to think sinkies got bad manners when they drive, apparantly its worse here in manila!!!!

 

Guess bad drivers are a universal plague.

Most motorbikes need longer stopping distances than a car to brake and stop, with the same speed.

It is not enough distance to ride the motorcycle same distance behind a car, as a car would need to.

Other vehicles would fill the 'void' in between them.

A motorcyclist can feel sandwiched travelling between two other vehicles in parallel.

Many/most motorcyclists make do, by travelling within the blind zones of bigger vehicles as and when they found them.

A less alert/experienced driver could quite easily missed the motorcyclist, if the driver did not turn his head to look (some just depend on the mirrors).

Many/most motorcyclists also seem to assume that the drivers obviously knew the presence of the motorcyclists in within the respective blind zones anytime.

I was told in Japan they call motorcycle suicide vehicle, and the motorcyclists are considered immatured (except those racing in the grand prix)

here in SG, the "STOP" sign is taken quite lightly by drivers, ie most of the time ppl juz do a rolling stop, or some even dare to bo chup n not slow down at all.

Try doing tat in US, and u'll suffer heavy consequences.

I believe some imagination needed to believe in such 'rolling stop' theory. Either you stop before the stop line, or failed to stop before it. This can decide whose at fault if a coliision takes place.

Example: a driver claimed the cyclist cycled in the wrong direction (against the flow of traffic) resulting in his colliding into the cyclist. However, he can not deny that he had failed to his car before the stop line. So he became fully responsible for the collision, when the cyclist said she was hit by the car when she stopped cycling (with witnesses around)

I believe those 'rolling stop' drivers are plain negligent/complacent as they are able to stop before the stop line

usually, if the is any accident which have injuries... TP will step in.. and when they do... demerit pts and fine will be issued... to BOTH parties... IF i'm not wrong...

Why didn't anyone thought about how a factory worker who is riding a really cheap and old bike managed to sent a lawyer letter to me and got him to fault me? And why can just some scratch on his arm, he can claim to have body aches and need to claim thousands in medical expenses, he still told me he was okay and the bike was okay after the accident !

Just be a man and admit its a mistake made by u ... u cause ppl to skid, fell down & injured and his bike also damage. I think it's reasonable he ask for some $ to repair his bike. Put urself in his shoe, you will 1 to claim some $ to repair ur vehicle to original condition right? If you have paid him, he wouldn't have claim insurance & report against u and u would have gotten ur insurance rebate back & no summon & demerit pt ...

Fact basis. Both are at fault.

 

But the TP officer who earns 2.5k a month to feed his family, housing loasn and has to take a bus to work everyday won't see it that way when faced with a young punk with past speeding offences, is a NSF and drives a continential coupe with an insurance more than he can save in 2 years and driving a car he will never afford in his lifetime..... make your guess about the outcome....

 

This fella deserves to learn a lesson. If he can't drive properly...then he should not drive...i meet loads of incompetent(and that's the nicest word i can use to describe them) who are clearly at fault but nastily pushes the blame to you....

 

Had one experience with a conti car.... i was on 3 lane road with right lane turning only and in the centre lane going straight...the car like TS waiting for opportunity to filter out...when i was like a half car length away, signal and swerve out at same time...luckily beside/behind me is a biker who was attentive and managed to slow down and clear because i swerve out and brake to avoid that idiot....no danger to biker unless he really toot as i cut out like 1/4 lane... then the bugger wind down window and started F***ing me...."C** I signal why you never give way?" I look at him and said, "You signal BIG F***?! Don't come here and think you can bully a jap car driver...you got the balls, you do what you just did onto an oncoming trailer." Gave him the finger and drove off.... Bloody FTs...
