4 Singaporean undergrads given suspended jail terms for sexual assault on Taiwanese women

Four Singaporean undergraduates have been sentenced to suspended jail terms by a Taiwan court for sexually assaulting two Taiwanese women in Taipei in December 2016.
 
The four - Lau Wei Seng, Bryan Ong Kun Jun, Tan Juan Yin and Lim Wei Xuan - while not having to serve time behind bars, will have to live under supervised probation in Taiwan for the next four years or more.
 
Lau was sentenced to one year and 11 months in jail and Ong was sentenced to one year, 10 months in jail.
 
Both had their sentence suspended for five years.
 
Tan was given one year, nine months jail, with the sentence suspended for four years, while Lim was sentenced to one year and eight months jail, with the sentence suspended for four years as well.
 
All have been released on bail but are barred from leaving Taiwan, pending appeals, reports local media.
 
According to Shin Min Daily News, the four had sexually assaulted the two women whom they met in a dance club in a rented apartment on Dec 11, 2016, while three of them were visiting Lau, an exchange student in a Taiwanese University.
 
All four men were arrested by the Police at the limen subway station at Ximending shopping district on Dec 13, reports The Straits Times.
 
They were on their way to catch a flight back to Singapore.
 
In a media release by the Shihlin District Court in Taipei said the four men have expressed remorse for their actions and reached a settlement with the two victims, compensating them with an undisclosed sum.
 
The victims said that they have forgiven the four and even pleaded for leniency for them.
 
The court was quoted as saying:
 
"If they are sentenced to jail, this will not only hinder their rehabilitation but also add to social costs."

? they have to stay there for 4-5 years while avoiding a jail term of <2 years.

Criminal record overseas, or crime commited overseas, what impact does it have on them in future? Is it known to employers?

 

Anyway after compensation the ladies also forgave them and even request leniency ... this case not straightfwd one. That's the prob with some of these clubbing girls, they can give the appearance of being game for more then suddenly pull handbrake! Just speculating but likely another case of the girls agree to have sex with one or two of the guys but didn't consent to the others join in.

A 40-year-old man, who drove a drunk woman back to his home from nightspot Zouk and raped her while she was unconscious, was sentenced to 12 strokes of the cane and 13½ years jail yesterday.

 

Ong Soon Heng, who was a trainee bunker surveyor, is appealing against his conviction and sentence, and is out on bail of $80,000.

 

He had been convicted in July of abducting and raping the undergraduate in 2014, when she was 22 years old and working as an intern in his friend's company.

 

Surveillance footage showed that he hauled her limp body over his shoulder at Zouk and placed her in the back seat of his car.

 

It was about 4am on July 24, 2014, and he took her to his house in Hume Heights where he raped her while she was unconscious.

 

Her boyfriend found her in a stupor when he tracked her to Ong's home, using a smartphone app after she went silent on her phone.

 

Prosecutors had sought at least 14 years' jail and 12 strokes of the cane. The defence asked for 10 years' jail and six strokes of the cane.

 

Parties related to the victim are not named owing to a gag order to protect her identity.

 

Ong and the woman were at Zouk with friends. One of her friends had testified earlier that they were kissing, during which she was "standing up but wasn't very stable".

 

As the night wore on, she became intoxicated and passed out. The friend said that she trusted Ong when he said he would drive the victim home.

 

Meanwhile, the victim's boyfriend went in search of her when she failed to respond to his calls and text messages for hours. Logging into her Apple account and using the Find My iPhone app, he located her whereabouts.

 

He found her at about 6.30am, lying on a mattress with Ong.

 

Ong immediately denied he had done anything with her. She was wearing Ong's boxer shorts and T-shirt, and could barely open her eyes or stand.

 

Her family, suspecting she was drugged, took her to hospital. Later, a medical report, based on hospital test results, estimated her blood alcohol concentration to be between 210.50mg and 254.50mg per 100ml of blood when she was at Ong's home.

 

This means she was severely intoxicated and highly unlikely to have had consensual sex.

 

Her 57-year-old father, when testifying in court, broke down as he recounted how he had to break the news to his family, including his daughter, that she had been raped.

 

Ong, in his defence, said that he had been in an intimate relationship with the woman. He also claimed she was not so drunk and was able to consent to sex.

 

During sentencing yesterday, Justice Aedit Abdullah said that Ong had exploited the opportunity to be alone with the victim because the others thought he was taking her home.

 

The exploitation, however, did not amount to premeditation, the judge said, as there was no evidence that he had plied her with drinks.

 

Ong formed the intention to rape her after he drove off from the club, the judge added.

 

 

He noted that all rape victims suffer trauma but the psychological impact on the woman, while substantial, was not post-traumatic stress disorder, which would bring the case into a higher sentencing band.

 

The victim's father, who was in court, told reporters: "He deserves what he deserves."

 

Ong's defence, he said, "added more insult to my daughter".

Whoa!!!!!!

 

The three men who were taking turns gang raping her were taken completely by surprise as the mother went into a blind rage stabbing all three men repeatedly until they collapsed.

no excuse for rapist. but for some grey cases, we need to be careful.put yourself in the shoe of someone being wrongfully accused how? It is very difficult to prove consensual or rape when there is no injuries. hope we do have got it right most times.

So be a monk? like the case of underage prostitution, check passport or NRIC first? some young girls, 14-16 look older than 20 hor. Law is to protect but if not used properly, then???

check passport or IC if need be... if not then go for "older" women. those confirm not underage one... haha...
