no excuse for rapist. but for some grey cases, we need to be careful.put yourself in the shoe of someone being wrongfully accused how? It is very difficult to prove consensual or rape when there is no injuries. hope we do have got it right most times.

 

many years ago my M'sia colleague said in M'sia is very disadvantageous for women.

 

for them to prove they were unwilling, they need to get 4 men to be their witness!!! Dunno what he said was/is true or not. If so, this law si bey illogical...

Then whoever comes up with this idea, we know where he should go and he will never be able to get 4 women or men to witness haha

Roger Yue Jr, then the president of Rope Skipping Singapore, is also accused of sexually assaulting the teenager on multiple occasions, including once with a skipping rope, and making the girl perform oral sex on him.
 
At the opening of his trial on Tuesday (Nov 21), Yue denied the seven charges against him, including two for rape and five for sexual penetration of a minor.
 
Another 41 charges against him will be dealt with at a later date.
 
The victim, who testified against Yue behind closed doors on Tuesday morning, cannot be named due to a gag order.
 
Yue allegedly sexually abused the teenager over two years, from 2008 until 2010, when she “finally stopped associating with him”, Deputy Public Prosecutors Winston Man and Nicholas Lai said.
 
The prosecutors said the victim will testify that she met the coach in 2005, when he started to coach her school’s rope skipping team.
 
Yue subsequently invited the victim to join his “private" competitive rope skipping team known as the Jumping Jewels, and also sought her help to coach several other skipping teams, the prosecutors said in an opening statement.
 
“It was in the context of this relationship with the victim that (Yue) committed the offences against (her) at his now defunct studio, at his home in Tampines, and at (a secondary school),” they told the court.
 
The victim lodged a police report against Yue four years later in April 2014, after confiding in her polytechnic lecturer and counsellor.
 
The prosecutors will call on 15 witnesses to prove their case against Yue.
 
They said Yue had made “crucial admissions” to the police in May 2014, and to an Institute of Mental Health psychiatrist at a psychiatric assessment in August and September 2014. Yue had also “reiterated some of these admissions to the police … (in) August 2015”, it added.
 
If convicted of rape or sexual penetration of a minor under 16, Yue faces up to 20 years’ jail on each charge. As he is above 50, he cannot be caned.
 
The trial continues.

i always hate the wordings of the charges... coz the inference is there... which.. i think .. has no link to the severity of the crime(s) involved...

Man who broke into woman's home, raped her gets 21 years' jail, 18 strokes

He had broken into the second floor of a shophouse looking to steal valuables but when he spotted a woman asleep in the unit, he decided to rape her as well.

 

As a result of Muhammad Sutarno Nasir’s actions, the 27-year-old victim’s wedding that had been scheduled for July this year was called off as her fiancé said that he did not want to start a new phase of life on a negative note. The couple also split up within two months of the rape.

 

The 30-year-old Sutarno was sentenced on Monday (20 November) to 21 years’ jail and 18 strokes of the cane after he pleaded guilty to one count of aggravated rape, one count of housebreaking by night with theft, and one count of possession of drugs. Five other charges relating to housebreaking and drugs were taken into consideration for his sentencing.

 

According to court documents, the victim – who cannot be named due to a gag order – was staying with her 75-year-old grandmother in a walk-up unit of the shophouse when the incident took place on 23 July last year. The two slept in separate rooms.

 

Sometime after 10pm the woman fell asleep in her bed. Her belongings, including an iPhone, laptop and her handbag, were by her side at the time. At around 5am that night, Sutarno – who had been loitering in the area with the intention of robbing homes – spotted an open window leading in the woman’s unit and decided to climb in.

Once inside the unit’s living room, he took a handbag belonging to the victim’s grandmother. He later entered the victim’s bedroom, where he found her asleep. Sutarno then decided to rape her.
 

The victim woke up upon feeling a light brush on her arm and found Sutarno kneeling next to her, which prompted her to scream. Sutarno then covered the victim’s mouth as she began to struggle.

 

He began to strangle the victim and when this failed to silence her, he proceed to punch her face multiple times. Fearing for her life, the victim pretended to pass out and laid still with her eyes closed. Seeing the woman immobilised, Sutarno removed her shorts and underwear, and proceeded to rape her. The victim continued to feign unconsciousness throughout the act.

 

After about two minutes, the man wiped the woman with her underwear before getting up. He took the woman’s handbag and entered an office on the first floor but did not find anything of value to steal there. He then left through the rear door which he unlocked with a key from the woman’s handbag.

 

The woman, who was afraid to move after Sutarno left, eventually got up after hearing no signs of activity for a few minutes. She found her iPhone missing but her laptop untouched, and used it to contact her boyfriend and friends to ask for help.

 

At around 5.32am, a male friend who saw her Facebook post contacted her through Facebook Messenger and called the police.

 

The woman’s grandmother became aware of what had happened only after she was woken up by noises in the living room, whereupon she found police officers in the home and saw that her granddaughter had blood on her face.

Around $4,000 worth of items had stolen from the woman and her grandmother. Sutarno was arrested at 10.20am the same day near an MRT station. Utensils for drug consumption were also found in his pocket.

 

The woman was later conveyed to Changi General Hospital where she was found to have suffered extensive injuries to her face and abdomen, including and bruises on her cheeks, chest and lips.

 

She was also found to have tears in her hymen and Sutarno’s semen was found on a swab taken from the woman’s cervix and her underwear. A scan conducted also found her with lesions in her brain.

 

In a psychiatric report from the Institute of Mental Health, the woman was diagnosed with Post-Traumatic Stress Disorder (PTSD). Since the incident, she has lived in constant fear of having intruders in her room and has been unable to sleep soundly. She also keeps the lights on at night and has a pair of scissors beside her bed to defend herself.

According to the report the woman also “struggles with thoughts of self-blame, blaming herself for moving into a separate bedroom from her grandmother, and would have frequent intrusive memories of the assault”.

 

The victim, who was a virgin prior to being raped, also believes she is “unworthy of others” after being rejected by her fiancé. “Ending this relationship made me feel worthless. I felt that after this thing happened to me, no one would want me anymore,” she wrote in her victim impact statement.

SINGAPORE — Over more than six years, he terrorised a pair of sisters in three episodes, getting bolder each time to the extent that he stalked them and threatened to rape and murder the elder girl.

But Tan Yao Min, 21, argued that an 18-month jail sentence imposed on him was manifestly excessive, claiming that he was remorseful, even if he could not control his “urges” to approach the sisters.

A High Court judge rubbished Tan’s claims in judgment grounds released publicly on Tuesday (Dec 12), and castigated him for being a recalcitrant who had refused to learn his lesson despite having been given chances for similar offences he had committed against the sisters twice in the past.

Justice See Kee Oon added that although Tan has autistic spectrum disorder and suffers from immature personality, these were not found to have contributed to his offending acts and were insufficient to detract from the primary sentencing objectives of deterring him from reoffending and protection of the public.

Rope-skipping coach found guilty of raping young student

 

SINGAPORE - A rope-skipping coach was found guilty on Tuesday (Feb 20) of sexual offences against a student between late 2008 and late 2010 when the girl was between 13 and 14 years old.
 
Roger Yue Jr, 59, was convicted of two counts of statutory rape and five counts of sexual penetration of a minor after the High Court accepted the victim's evidence that the sexual acts were committed through "what was at least cajoling, if not pressure" by the accused.
 
The victim, who is now 22, cannot be named because of a gag order to protect her identity.
 
She got to know Yue in 2006 when he was appointed to coach her primary school's skipping rope team. He later invited her to join in a private competitive skipping rope team and also got her to help him as he coached teams from several schools.
 
She said Yue sexually abused her until late 2010. Eventually, she told her polytechnic lecturer and counsellor what Yue had done to her. She made a police report on April 28, 2014.
 
Delivering his decision on Tuesday, Justice Aedit Abdullah said the fact that the victim did not tell anyone in authority about the incidents till about five years later "gave some pause".
 
The victim's behaviour in continuing with training and maintaining contact with Yue may also seem odd, given that she was being sexually abused repeatedly.
 
However, the judge accepted that victims of sexual abuse may not behave in a stereotypical way.
 
While early reporting gives strong support to the case against an accused person, a delayed report did not necessarily suffer from reduced credibility although it may make it more difficult to prove a case beyond reasonable doubt, said the judge.
 
Justice Aedit added that a juvenile cannot be expected to always react in the same way that is expected of an average adult, that is, to report an assault as soon as possible.
 
"The thinking process, assumptions and viewpoint of a juvenile victim may lead to a course of action that may appear unreasonable or improbable. The court must always be mindful of such possible explanations, and should not measure a child by adult standards," said the judge.
 
In this case, the judge said the victim's testimony was believable and credible to some extent, but not sufficient to convict Yue.
 
What sealed Yue's fate was a statement he had given to the police as well as an interview with a psychiatrist, which revealed that he considered himself to be in a relationship with the victim, and that he committed various acts on her, including using objects to sexually violate her.
 
Yue, who is on bail of $70,000, is expected to return to court on March 21 for sentencing arguments. The maximum jail term for statutory rape is 20 years' jail.

Company director admits to rape and sexual assault of 12-year-old son's ex-girlfriend

 

SINGAPORE - A company director, now 47, admitted in the High Court on Tuesday (March 6) that he had sexually abused a teenage girl - the former girlfriend of his younger son - over a period of 1½ years, when she was between 11 and 13 years old.
 
The man was assessing his son's Facebook account in December 2012 to find out why the boy looked moody, when he found naked pictures of the girl, who knew his son through competitive swimming.
 
The Primary 5 girl had sent the images via private messages after the Primary 6 boy asked for them, the court heard. The parties cannot be named due to a gag order.
 
The man phoned the girl to meet up, claiming he wanted to talk about her break-up with his son. He then drove her to the Copthorne King's Hotel and raped her in a room he had booked.
 
Despite initial anger over the rape, the girl grew to like the man, who told her he loved her, encouraged her when she doubted her swimming talent and showed concern for her.
 
She continued meeting him for consensual sexual acts in carparks, hotels and the rooftop of her condominium.
 
Eventually, she thought of him as her boyfriend but did not tell her family as she was afraid they would be angry at her for getting involved with a married man.
 
He showered her with gifts of expensive swimming costumes and asked her to put them on for his viewing pleasure.
 
Sexual activities were on the agenda most of the times they met, the court heard. He took her out for a meal only once - after a session of oral sex.
 
When she turned 12, he drove her to a deserted carpark and gifted her with swimming costumes, goggles and a swimming cap. He then asked her to perform oral sex on him in the backseat.
 
The man also took pictures of their sex acts with his mobile phone and asked her to send him pictures of herself in sexually provocative poses based on his directions.
 
He was also jealous and possessive, and would ask to see her social media chats.
 
In February 2014, she wanted to end the affair after getting into a relationship with a teenage boy, but the man refused to break up with her.
 
Using prepaid SIM cards, he posed as mysterious men and sent her messages threatening to post her naked pictures online. Unaware that he was responsible for the messages, she turned to him for help.
 
The man also used one of these numbers to contact the girl's new boyfriend, telling the boy to stay away from her.
 
His choice of a WhatsApp profile picture for this number - a naked image of her - eventually led to his undoing.
 
On July 4, 2014, a parent in the same social circle saw the profile picture in a chat window on his daughter's phone, and recognised the victim. It is unclear why the accused had contacted this girl.
 
The parent then informed the victim's mother and older sister.
 
That night, questioned by her older sister, the victim broke down and told her about the man. The sister took her to lodge a police report.
 
On Tuesday, the man pleaded guilty to two charges of statutory rape and one charge of sexual penetration of a minor. Fourteen other charges will be considered when he is sentenced.
 
The defence is relying on a psychiatric report for mitigation which can have a bearing on sentence. But the prosecution does not accept some parts of the report.
 
A further hearing to hear psychiatric evidence from both sides will be held before the court determines the sentence.
