This is how you can present your case. 1) ask them to prove that they did tighten the cap rather than you prove they didn't. 2) if they insist they did, ask them under what circumstances will this happen? 3)if they say you open up the cap yourself, then tell them you want to sue them. Before you come to this extend, make sure no foul play at your end. Like you or your whoever pop the bonnet and forget abt it and someone pluck you. 4) likely after this they will take out their recording in workshop to prove otherwise. PSP415 Supersonic March 8, 2012 Share March 8, 2012 (edited) U wld hv signed a discharge form when collecting yr ride after e service where u confirm all done satisfactorily blah blah.....whilst its a standard practice, it holds some water when it comes to actual legal proceedings. Personally, e 2 things that worked against yr favour - 1. Only on 3rd day the car stalled and missing radiator cap noticed. Was e car used throughout the 3 days since it left w workshop? And as one bro pointed out, a missing cap wld hv caused e car to start acting up, even aircon wld hv started blowing warm air. 2. Radiator cap missing cld be due to a few factors and e onus to prove that e agent was negligent still rests on you becos it is returned to you after service satisfactorily....whether u checked is not their responsibility. Under e circumstances, most if not all agents will deny responsibility. Even if they "open" their service records, they wld b able to produce their service checklist where radiator is "ticked" to show it has been topped up etc. There is hardly any WS tat provide a box where "radiator cap tighten" is provided. Suggest u seek 2nd opinion on whether e car needs e 5k repair bill....the problem may/may not be that serious or cost that much. Consider e legal course of action only IF u are prepared to pay....cos it may be more than e 5k and u may not win. Understandably e "injustice" is hard to swallow but a radiator cap is an item that can go missing by anyone at anytime.....not saying u did it on purpose but they can and likely will say that e car left e WS with radiator cap intact and they hv no knowledge why it was missing or when it became missing. Just my tots....a bro pm-ed u that he won in a similar case....u may wan to consider yr options with his inputs (I am unaware of what his case is and how he won). macrosszero Turbocharged March 8, 2012 Share March 8, 2012 Go to an outside WS and see if the 5k bill is still 5k. If after filling the coolant back up, the car drives fine, you're lucky. If it needs some minor parts change, take it as a lesson learnt and move on. Too much time had elapsed between you taking the car and the overheating that its hard to pin the agent for it. Worse comes to worst, buy a halfcut engine from Japan, apply to LTA to have an engine change, will not cost as much as 5k. Link to post Share on other sites More sharing options...
Beachboy7718 Clutched March 8, 2012 Share March 8, 2012 Regardless if radiator cap missing, coolant leak, thermostat, water pump not working etc. the temperature would have shot up and as a driver, you would have noticed. Visibly you can see and smell the smoke coming out, hot air coming out of the aircon vent. In such situation, have to stop driving immediately to avoid damage to the engine. Agree. As a driver, you need basic knowledge about cars. It happened to me once before on previous accord. My water temp guage was abnormal high while driving. Immediately I check the radiator system and learnt that my cap was no there and coolant flowed out. Replaced with cap and refilled coolant. Problem solved. My dad's Mazda 2 under went routine servicing with the agent 3 days ago. While on the road, the car suddenly stalled and water gushed out from under bonnet. After the car cooled, we have noticed that the cooler cap is missing. The car was unable to start thereafter, and had been towed back to the agent. We were quoted 5k for a complete engine overhaul. Obviously, we we highlighted that servicing had just been done hence how could the car gotten into such a state out of sudden. Unfortunately, the agent is unable to give a good explanation and shrug off as wear and tear :( Anyone has such experience and what actions been taken? It is really unfair that the responsibility is thrown back to us while we had diligently sent for servicing etc. If anyone has the email address for Madza public relation etc, do feel free to share too as I would like to write and share with them on my experience and the service (the lack of it actually) provided by it's agent. So if you had bought from the out-going AD, good luck No mention od other observations besides the missing radiator cap Unlikely that be the only reason for car to stalled suddenly, and can not start thereafter Some AD do quote for ceremonial servicing, minimal servicing, comprehensive servicing So there can be inadequate maintenance servicing done due to car-Owner's instruction As car-Owner, we also need to practice due diligence for our car maintenance it is within warranty period/mileageyou may report to the manufacturer, post on the ST forum. And unfortunately, it is also true that we bought from the outgoing AD hence the challenges. On my perspective - we had taken due diligence and there was no warning signs before the car decided to stall etc... but it disappointing to have the AD shrug off as wear and tear (lack of luck if I translated that term) when the servicing was done less than a week. I believe any servicing package wif ad would have a certain amount of points checks, coolant and brakes are the major, thus any faulty parts related should be included as they should replaced it or least inform owner, if the cap is faulty, they are the expert. Kb27 Supersonic March 8, 2012 Share March 8, 2012 I think all cars have some form of warning signs: 1. Engine overheating 2. No oil pressure 3. No battery charging 4. ABS 5. Low or no fuel If owner choose not to pay heed to it, then you can't blame the workshop. You are the owner of the car, not the AD, not the workshop. If Mazda 2 does not have overheat warning or is defective, then that's something you can go on. If your wheel fall off 3 days after leaving the workshop, can you prove that workshop is negligent ? Pepe Clutched March 8, 2012 Share March 8, 2012 I also got a bad experience with AD. Send car in to replace ECU. After collected car, noticed aircon not cold. Drive back immediately, they deny that touch the aircon. In the end, offered to top-up gas for me. But it didn't help and this started a 2-year aircon nightmare for me, spending almost $2K in the process. True, it may be wear and tear, but the fact that my aircon was working fine and it up-lorry IMMEDIATELY after leaving their workshop is hard to swallow. In the end suck thumb, and I have never gone back for any repairs or servicing since. But the problem in Singapore is... boycott? Very soon you will realize that the other companies more or less the same. Similar to other product or services. LL have to go back to them sooner or later. I believe you would not get proper repair from an out-going AD (no warranty/assurance from them). Just send car to other workshop if your want it repaired properly. Once we received and drove the car out of their premises, it is difficult to prove they did not do a good servicing job. Of course the need for an engine overhaul is testing their own luck with you.
