Please help! Seek witnesses with camera footage

Hi, my brother's car was hit by a taxi last Friday night, 12 June 2015, at about 11.15pm, 34 South Bouna Vista Road.

 

Taxi stopped at the road side. My bro filter right to pass him then he suddenly turn right to the shophouses without checking and my bro hit onto him after jamming break.

 

Now, the taxi driver wants to claim insurance and put all the blame on my bro. So, I'm seeking for any witnesses who were there to come forward with video evidence.

Single white line can overtake.

Taxi never make sure it is safe to change direction.

87. Keep a watch on the traffic behind you by glancing in your mirror.
88. Well before you change direction, overtake or stop —

look into your mirror (if you are a motor-cyclist glance to the side or behind);

make sure that it is safe; and
(c)
give a clear signal to indicate that you intend to do so.
89. Everytime you intend to turn, stop or slow down, give the correct signal. Signal in good time and maintain the signal long enough to enable others to anticipate your movement. Make sure that your direction indicator gives the signal intended, and that it is cancelled immediately after use.

My brother's Wish was behind the taxi. Then he cut the lane to overtake him but the taxi just swerve out without checking and hit my brother's car. No camera in his car that's why asking for anyone here who was maybe there and had a camera in his car.

That is why there is a whole chunk from 87-89 for changing direction and only one line (54) for the white line.

Cars MUST have camera nowadays. Why some still refuse to install one? Then come to forum and ask to see if anyone got video evidences :dizzy:

 

Still, I hope you find that person who has a cam.

54 suggests that overtaking is allowed as long as the road is clear. This has been the case for my bro.

 

87 - 89, my bro also made sure to be safe when overtaking. Signal signs has been used and due diligence was given. Just too last minute for my bro to swerve when the taxi just cut out of the lane like that.

did the taxi signal and waiting for the opposite road to clear before making the turn? did he let passengers to alight then make the turn? or has he been stopping at the roadside for more than a minute or 2?

Doesn't look good for your bro.

 

"Taxi stopped at the road side" - the taxi can easily claim he stopped (if he really did) to look out for oncoming vehicles from the opposite direction before he makes the right turn. He was being cautious (even if overly), comparatively trying to overtake the taxi against opposite traffic would likely be seen as reckless.

 

"suddenly turn... without checking" - if the road is single lane on either side, why would the taxi even check his behind as any oncoming vehicles would only logically come from in front. Even if it was two or multi-lanes, if I am on the right lane waiting to turn right, I would also only look in front in case of any last minute fast coming vehicles and not check to see if anyone's coming at me from behind. Anyone going straight should be on the left of a right-turning vehicle, not the right.

 

And looking at the pictures, damages to the silver car (your bro's) are at the front left headlamp and bumper, whereas damages to the maroon Taxi are near the rear right door and tire, putting your bro on the right side of the taxi (where he shouldn't be due to the single lane) where he hit the taxi from a "behind" position.

 

Anyway damages don't look too bad on either vehicle, and I am not sure how much odds your bro will have at winning the case if my points above are correctly made, worth him putting his NCD on the line?

This kind ah.. I suggest private settlement with taxi la.. if you can't win 80% and more.. you lose already by both having more insurance premium next year. This kind I'll negotiate with taxi driver for below $1k to him.

From my past experience, Car that hit rear or side is always on the losing end. The front car just needed to claim the back car hit them. Even if there is camera that the Taxi turn right without checking, the behind car will still at fault. It is also difficult to fight Insurance claim with Taxi company. You will only win when the Taxi is behind. What your brother needed to claim is that the Taxi stopped and so he wanted to drive pass and suddenly the Taxi turn out. At this close distance, because your brother try to brake as fast as possible, so the car only hit the Taxi car slightly. Maybe can settle for a 50-50 case so that your brother Insurance company will not increase the insurance amount too much.

Crossing double white lines is an offence, with 4 demerit points + $$$ fine.

Crossing single white line is ok. But need to look at it this way, would you overtake at or near junctions (especially on a single lane)?

The risk is high as there might be cars, motorcycles coming in/out from junctions, or pedestrians crossing in front which you might not see when you try to overtake.

 

In any case, hope no one is hurt and all the best to your bro. Can try FB to reach out to more pple.

I guess there's nothing much you can do about it already. The taxi driver probably got advice on how to report so he will win, that's why he insist on claiming insurance. Without video, your brother is also on the losing end now. The best thing to do now is to ask your bro to install a car cam ASAP.

Nobody mention that taxi has camera, I think all now have right? So I think taxi camera footage may give some sense of whether it stopped by road side or to make right turn.

Even the taxi has the video footage, they will only use it to their advantage. Most probably they will report the cam not working or video corrupted if it is to their disadvantage. Taxi companies are the most competent in making claims one loh.
