Malaysian Court awards RM351,000 to children of car repossessor allegedly shot by police http://www.thestar.com.my/News/Nation/2014/10/08/Court-awards-children-of-car-repossessor/ PUTRAJAYA: Three daughters of a man who was allegedly shot dead by police, were awarded a sum of RM351,000 in damages by the Court of Appeal which allowed their claim for loss of dependency due to the wrongful death of their father. A three-member panel led by Justice Datuk Linton Albert unanimously allowed the appeal brought by the three girls, Nurasmira Maulat Abdul Jaffar, Siti Asma Abdul Jaffar and Siti Fatimah Abdul Jaffar, to reverse a High Court’s dismissal of their civil suit against the Inspector-General of Police, the Government and a police officer, ASP Ong Seng Keong. The two other judges were Datuk Hamid Sultan Abu Backer and Vernon Ong Lam Kiat. “The police are paid through public funds with a primary duty to arrest criminals and put them for trial. They cannot be allowed to roam trigger happy as this will be in violation of the rule of law and the relevant authorities must seriously check such violations,” Justice Hamid said in his 31-page judgment. “It is trite that the police force has not been endowed with ‘executioner’ powers in the pretext of self-defence,” he said. The panel awarded RM51,000 in damages for loss of dependency and RM300,000 in exemplary damages, as well as RM50,000 in costs for the proceedings at the Court of Appeal and High Court to the girls aged 15, 8 and 7 years who through their mother, Abra Bibi Shahul Hamid, brought the suit against the police for allegedly causing the wrongful death of their father, Abdul Jaafar Abdul Mutalib, 38. “What is reprehensible and needs to be condemned are fake encounters as the facts of the instant case shows prima facie and the failure of the relevant authorities to discipline such officers and worse still, claim self-defence under the Police Act which has no relevancy to the killing,” Justice Hamid added. He said the senior federal counsel who represented the respondents had also failed to bring to the court’s attention any law that giving powers to the police and the right to shoot on sight or any law relating to self-defence or fulfilment of any Special Operating Procedure. “Section 24 of the Police Act 1967 has nothing to do with self-defence to exonerate liability from unlawful killing,” he said, adding that this section also did not give the police any power to kill. Justice Hamid said the courts had a constitutional duty to deal with “police excesses” and to provide the necessary input or directions for appropriate action by the relevant authorities to ensure the rule of law was maintained at all times. In the incident, the deceased, a car repossessor, was sitting in the front passenger seat of a Proton Waja when the car and another vehicle were ambushed by two police Special Action Force teams near a petrol station in Batu 3, Shah Alam on Sept 2, 2008 which claimed the cars had been travelling in a “suspicious manner”. The police, however, said they had opened fire in self-defence after shots were fired at them from the direction of the Proton Waja, causing the death of the deceased who sustained six gunshot wounds, and three other persons who were also in the car. The police did not dispute the killing but had said it was done in defence and had relied on Section 24 (1)(b) of the Police Act, which states that any police officer may stop and search without warrant any vehicle or vessel which he has reasonable grounds for suspecting is being used in the commission of any offence against any law in force. Counsel V. Rajadevan who represented the girls had submitted that the police should not have fatally shot the deceased, instead they should have arrested him and charged him in court if he was found to have committed any offence. They filed the civil suit in 2009 and the High Court dismissed it last year. The respondents were represented by senior federal counsel Habibah Haron. – Bernama

  11. The Seat Leon has won the prestigious Car of the Year 2013 prize at the annual Auto Express New Car Awards in London earlier this week. The award was handed over to new Seat Chairman Jurgen Stackmann during a ceremony in London by Auto Express Editor-in-Chief Steve Fowler. The Leon also scooped up the Best Compact Family Car award. Explaining why the Leon was crowned the year's best car by the U.K.'s best selling motoring weekly, Steve Fowler said, "We love its style, the way it drives, the quality and the kit. Best of all, you get all that at a bargain price, while running costs will be ultra low, too. The SEAT Leon has beaten some superb cars to be crowned Car of the Year - it's that good," Jurgen Stackmann thanked the Auto Express jury for choosing the Leon as Car of the Year.   13. The brand new Octavia III has won the overall 2013 "Tow Car of the Year award" in the UK. It also bagged the award for the "up to 1,424kg" category. Before I carry on, we are not talking about towing a broken-down car to the workshop but pulling a caravan. Caravanning is hugely popular in Britain. Auto Express teamed up with The Caravan Club and put 23 new cars through a series of tests to name the "Tow Car of the Year 2013". The award started just seven years ago. The Octavia that won the award is fitted with a 2.0-litre TDI that pumps out 150bhp with 320Nm of torque. Tipping the scale at 1,330kg (kerb weight), the Czech sedan is the lightest overall winner ever. The judges commented that the Skoda tows brilliantly and is extremely practical with a cargo space of 590 litres. It is good to drive and not costly to own. Most importantly, it proves that a great tow car doesn't need to be heavy, thirsty or expensive. There is no news regarding the Octavia III's availability in Singapore at the moment.
  14. Ford's 1.0-litre EcoBoost engine has won the "International Engine of the Year" award for the second consecutive year. Not only that, the turbocharged, direct-injection three-cylinder engine achieved the highest score in the 15 year history of the awards. "With a technology as mature as the internal combustion engine, it's very rare to achieve a true breakthrough, but that is exactly what the team accomplished with this engine," said Joe Bakaj, Ford Vice President, Global Powertrain. "You have to drive it to believe a small three-cylinder engine can deliver such performance and fuel economy." A panel of 87 automotive journalists from 35 countries around the world judged the awardees based on drivability, performance, economy, refinement and the successful application of advanced engine technology. The 1.0-litre EcoBoost engine is currently offered in cars such as Fiesta, B-MAX and the Focus. In the near future, it will also power larger cars including the new Ford Mondeo. The Infiniti Q50 sedan has been awarded the 'Best Chinese Premiere' by the organising committee of the Shanghai International Motor Show in conjunction with sohu.com, one of China's leading online magazine. The award was presented to the Managing Director of Infiniti China, Daniel Kirchert. "We are honoured and very proud that our new premium Q50 sedan received this much respected award. This is a kickstart for the Q50 in China. We are looking forward to the market launch in spring 2014 with much confidence," said Kirchert. Infiniti fronted the Shanghai Motor show with the Q50 Hybrid variant, making its debut in Asia. The car is powered by a 3.5-litre petrol V6 featuring electric motor assistance. The hybrid system's nett power is approximately 354bhp, providing strong acceleration and lean fuel economy. The engine is matched with a seven-speed automatic transmission with manual shift mode and steering-mounted magnesium paddle shifters. The Q50 is available in both rear-wheel drive and an Intelligent All-Wheel Drive. Last year, Infiniti moved its global headquarters to Hong Kong where it can serve the Chinese market better. At the Shanghai Motor Show, Infiniti announced the long wheel base versions of the Q50 and QX50, both of which are specifically developed for the Chinese market. They will be built in the Xiangyang plant which is operated by Infiniti's partner in China, Dongfeng Motors.
  17. The 2013 Mazda6 is probably the best looking mid-sized sedan to come out of Japan in recent years. The Mazda6 is the production version of the Mazda Takeri concept which personifies the brand's new 'KODO - Soul of Motion' design language. As recognition to its design, the all new Mazda6 has been awarded the prestigious 2013 Red Dot Design award by a jury that consists of a team of 37 design experts who judged the entries based on nine criteria. "We were aiming with the new Mazda6 to awaken the observer's senses and turn heads with an uncompromising balance and proportion that instantly makes one want to get in the car and drive. The red dot award for product design is a very prestigious testimony to what we have achieved at Mazda with the bold expressions personified by KODO", said Peter Birtwhistle, Chief Designer at Mazda's European R&D Centre.   18. The finalists for the 2013 World Car of the Year Awards have been named. The list for each category has been reduced to just three to four models, and the final results will be announced at the upcoming New York Auto Show. The winners will be voted by a committee of 66 journalists from 23 countries. Interestingly, the Porsche Boxster and Toyota GT86 has the opportunity of clinching two awards at the same time.   19. The 2013 Honda Civic has become the first compact car to earn the Insurance Institute for Highway Safety (IIHS) Top Safety Pick Plus (TSP+) rating. To qualify for the 2013 TSP+ award, vehicles must earn good ratings for occupant protection in at least 4 of 5 evaluations and no less than acceptable in the fifth test. The evaluations include frontal and side impact tests, rear seat based impact test, roof strength test and the latest small overlap frontal impact test. According to Chuck Thomas, Honda's chief engineer in charge of collision safety, Honda took the opportunity to make some changes to the car's structure alongside with the facelift. Specifically, the 2013 Civic gets higher-strength materials to reinforce the cabin space together with some additional components in the structure and engine compartment. Although the styling of the latest Civic may appear too 'tame' to some, there is no doubt that it is one safe sedan for your family. Joining the Civic in receiving the coveted TSP+ rating include the 2013 Volvo XC60, Lincoln MKZ and the all new Mazda 6.
