  7. Last Friday, Toyota's stock closed at $79.56. That represents a 12-percent drop in market capitalization. For those keeping track, that's a loss of $15 billion. Naturally, there are a number of none-too-pleased shareholders hanging on to their stock in the Japanese automaker. As such, it comes as little surprise that law firm Murray, Frank & Sailer has filed a class-action lawsuit in U.S. District Court in California on behalf of any and all shareholders who purchased stock between Dec. 22, 2009 and Feb. 2, 2010. The suit contends that Toyota issued "materially false and misleading statements" and "failed to disclose ongoing safety issues and quality control problems with Toyota's automobiles," especially issues related to alleged cases of unintended acceleration. Would shareholders that purchased stock in Toyota have done so if the automaker had taken a more pragmatic stance on the problems it was about to face? It would seem that's up for a judge to decide. Peter Henning, a Wayne State University law professor cited by The Detroit News, points out that securities cases are notoriously difficult to prove. "You are going to have to prove knowledge among the corporate management. Unless something else emerges, it seems that Toyota didn't think that it would be the kind of problem that it turned out to be," said Henning. A three-judge panel is set to meet on Thursday to consider this and all other impending class action suits against the beleaguered automaker. Until then, Toyota certainly has its hands full with potential headache-inducing litigation to consider.
  8. There probably isn't a day that goes by when an automaker isn't being sued for something. Some suits are extremely serious, while others peg the needle on the frivolity scale. And while Hyundai is flying high on the sales charts right now, the Korean automaker apparently isn't immune to a trip or two the local trademark infringement court. At question is a Hyundai Sonata commercial that debuted during the Super Bowl that linked the company's new-for-2011 sedan to all things luxurious. About four seconds into the spot, a brown basketball with gold symbols is shown. Forgive us if we didn't immediately notice that the design of the ball is strikingly similar to the colors and symbols of Louis Vuitton, but the world-famous couture company caught on right away. So... are they excited about the free press during the Super Bowl? Not so much. The Car Connection reports that Louis Vuitton is suing Hyundai because the French purse maker says the Korean automaker tried "to benefit commercially from the fame and renown of the LVM Marks by creating a false association between Louis Vuitton and its automobiles." So, what does LV want for Hyundai's alleged trademark infringement? How about "triple damages, punitive damages, a halt to the alleged infringement, and other remedies." Sounds a lot more expensive than a Louis Vuitton handbag, eh? We aren't really up to speed on the legal ramifications of trademark infringement, so we aren't about to guess as to whether or not Hyundai will end up paying any fines or settlements. We do think it's a sweet-looking basketball, though, and Louis Vuitton should talk to Hyundai about borrowing that design so they can sell a few $2,300 balls.

July 25, 2008 SIA faces unpaid wages lawsuit in Chicago S'pore carrier is one of nine companies sued by ground workers at O'Hare airport By Karamjit Kaur, Aviation Correspondent GROUND workers at Chicago's O'Hare International Airport have filed a lawsuit in a United States court against Singapore Airlines (SIA) and eight other companies, saying they were not paid their wages. The other defendants being sued include two other airlines - United Airlines and Alitalia - and ground-handling companies Swissport and Air Menzies. Documents filed in the Illinois state court last week name 10 plaintiffs, all temporary workers who handled jobs such as loading cargo and food for flights. Many of them earned a minimum wage of US$7.50 (S$10.20) per hour and some claimed they had not been paid for several weeks. Their lawyer, Mr Jed Untereker, said the number of plaintiffs could swell in the coming weeks or months. 'We believe there are hundreds, maybe thousands, of workers in a similar plight,' he said. The workers had been hired by employment agency Ideal Staffing Solutions. The company - which is also being sued - supplied the workers to the other companies named in the lawsuit. SIA's alleged involvement is through its cargo unit, SIA Cargo. While the Singapore carrier did not hire any of the workers involved, SIA Cargo's planes at the airport are handled by Swissport which used workers supplied by Ideal Staffing Solutions. That does not absolve carriers from the responsibility of ensuring worker welfare, said Mr Untereker, a lawyer for Chicago's Working Hands Legal Clinic. He told The Straits Times in a telephone interview yesterday: 'We hope this case sends a message to all employers - particularly those using temporary staffing workers. If they try to shield themselves from their responsibilities, if they try to hide behind temporary staffing companies and their workers...they will be caught.' At this stage, it is difficult to say how much money is owed, he said. More details will surface as the lawsuit progresses, he added. The case came to light in November when immigration officials did a massive sweep of O'Hare airport and arrested temporary immigrant workers with fake identification cards. Investigations revealed that some of them may not have been paid for several weeks. If found guilty, the defendants will have to pay a penalty on top of the wages owed.   12. April 4, 2008 M'sian woman sues husband over losing virginity KUALA LUMPUR - A MALAYSIAN woman is suing her husband for nearly a million dollars over the loss of her virginity, a report said. The New Straits Times said on Friday the 30-year-old teacher is claiming RM3 million (S$1.3 million) in damages for false promises over their marriage, which collapsed after her in-laws disapproved. It said the pair consummated their relationship after dating for a few months, then legally registered their marriage, but they never went through the customary Chinese marriage rites. 'What she has is a marriage on paper only. It's not the kind we all know and the kind all women want. It's a marriage obtained by misrepresentation,' her lawyer, Mr Ernest Chua, told the daily. The in-laws began pressuring their son to divorce, according to the bride, who named in them in the suit for 'inducing their son to breach the contract of marriage' and for causing her 'humiliation and mental torture'. AFX News Limited ExxonMobil Malaysia units sued by service station associations - report 06.06.07, 9:25 PM ET KUALA LUMPUR (XFN-ASIA) - Associations representing some 440 Malaysian service station operators are suing ExxonMobil units Esso Malaysia Bhd and ExxonMobil Malaysia Sdn Bhd, claiming that they were forced to sign a new licensing agreement, the New Straits Times reported. Mobil Petrol Station Dealers Association of Malaysia president Zulkifli Mokti was quoted as saying the service station operators are seeking compensation of 44 mln rgt, alleging 'harassment' and 'mental anguish.' The associations are also seeking 1 mln rgt fro every service station that was forced to close as a result of the new agreement. That after a Nampa man filed a civil suit against Nissan North America. The accusation claims odometers in some Nissan vehicles are rolling-over before the miles are actually put on. KTVB Phillip King is suing Nissan North America, claiming that there could be problems with the odometer readings on his Nissan vehicles.
